Book excerpt: The Hill Times: Best Books of 2016 A new, expanded edition of the first-ever primer on Canada’s Constitution — for anyone who wants to understand the supreme law of the land. The Canadian Constitution makes Canada’s Constitution readily accessible to readers. It includes the complete text of the Constitution Acts of 1867 and 1982 accompanied by an explanation of what each section means, along with a glossary of key terms, a short history of the Constitution, and a timeline of important constitutional events. The Canadian Constitution explains how the Supreme Court of Canada works, and describes the people and issues involved in leading constitutional cases. Author Adam Dodek, a law professor at the University of Ottawa, provides the only index so far to the Canadian Constitution, as well as fascinating background on the Supreme Court and the Constitution. This revised and expanded edition is a great primer for those coming to Canada’s Constitution for the first time, and a useful reference work for students and scholars.

Book excerpt: The Canadian constitutional reforms of 1982, which included a Charter of Rights and Freedoms analogous to the American Bill of Rights, brought about a convergence with American constitutional law. As in the U.S., Canadian courts have shown themselves highly protective of individual rights, and they have not been shy about assuming a leading and sometimes controversial political role in striking down legislation. In clear and easy-to-understand language, the contributors not only chart, but also explore, the reasons for areas of similarity and difference in the constitutional politics of Canada and the United States.

Book excerpt: The Oxford Handbook of the Canadian Constitution provides an ideal first stop for Canadians and non-Canadians seeking a clear, concise, and authoritative account of Canadian constitutional law. The Handbook is divided into six parts: Constitutional History, Institutions and Constitutional Change, Aboriginal Peoples and the Canadian Constitution, Federalism, Rights and Freedoms, and Constitutional Theory. Readers of this Handbook will discover some of the distinctive features of the Canadian constitution: for example, the importance of Indigenous peoples and legal systems, the long-standing presence of a French-speaking population, French civil law and Quebec, the British constitutional heritage, the choice of federalism, as well as the newer features, most notably the Canadian Charter of Rights and Freedoms, Section Thirty-Five regarding Aboriginal rights and treaties, and the procedures for constitutional amendment. The Handbook provides a remarkable resource for comparativists at a time when the Canadian constitution is a frequent topic of constitutional commentary. The Handbook offers a vital account of constitutional challenges and opportunities at the time of the 150th anniversary of Confederation.

Book excerpt: In October 1999, some fifteen academic experts and government practitio ners from Germany and North America gathered for two days at the Uni ver sity of Augsburg to discuss the topic of "Constitutional Reform and Consti tutional Jurisprudence in Canada and the United States." The present volume documents the results of that conference, a collaborative effort of the De partment of Political Science, University of Erlangen-Nuremberg, and the Institute for Canadian Studies, University of Augsburg. In organizing this workshop, we were guided by two basic sets of ideas and assumptions: First, all "established" democracies are regularly confron ted with the need to adjust their constitutional order to changes in their envi ronment lest democratic stability be transformed into rigidity; in many wes tern nations, including Canada and the United States, developments such as the crisis of the Keynesian welfare-state or the emergence of increasingly heterogeneous, postmodern societies have ushered in an era of heightened, yet not always successful constitutional reform activity. Secondly, however, there is no unique path towards, or model of, an "optimal" constitutional order, however defined; rather, constitutional reform processes, their under Iying normative principles and their outcomes are strongly path and context dependent. Therefore, the participants of the workshop and authors of this volume were asked to examine the specific preconditions, context, nature and impact of recent constitutional reform processes in the Uni ted States and Canada.

Book excerpt: In the Fall of 1992, public events in Canada reached a climax that had far-reaching effects for the future of the country. For the first time in their history, Canadians were asked to give their approval to a sweeping set of constitutional proposals in a national referendum. The first serious and informed analysis of these proposals took place at a conference at York University that September. Sponsored by the Centre for Public Law and Public Policy, and the Robarts Centre for Canadian Studies at York University, the conference drew major speakers including Peter Lougheed, former premier of Alberta; Peter Hogg of Osgoode Hall Law School; Judy Rebick, president of the National Action Committee on the Status of women; Senator Gerald-A. Beaudoin; Professor Ronald Watts of Queen’s University; Michael Adams of Environics Research Group; Jeffrey Simpson of the Globe and Mail; Reg Whitaker of York University; Maude Barlow, National Chairperson, Council of Canadians; David Elton, president of Canada’s West Foundation; and Raymond Giroux of Le Soleil, among others. The papers of the conference, most of which were later revised in light of the 26 October referendum results, present a record of Canadian thought during a period of profound national change. They are grouped here under such topics as ‘The Reform of Central Institutions,’ ‘The Division of Powers,’ ‘Distinct Society, Aboriginal Rights, and Fundamental Canadian Values,’ ‘The Referendum,’ and ‘The Future of Canada.’ In this book, leading scholars, government decision-makers, interest groups, and journalists come together to debate the country’s future. Their papers provide an independent and informed analysis of the choices confronting Canadians at a decisive moment in their collective history.
