Upon appeal by the defendants, the Divisional Judge held that the award was inoperative as regards D. B., unless it could be shown that she had ratified the submission to arbitration, but that the award was good as regards the parties who had consented to the reference. The Divisional Judge accordingly remanded the case under Section 5622, Civil Procedure Code, for decision as regards D. B and dismissed the appeal as regards the three male defendants. Held, on further apps 1, that the decree of the Divisional Judge was bad in law. He cou] not legally dispose of the appeal finally as regards the three male defendants and re-open the case by a remand as regards the fourth, - the almost inevitable result of such procedure being that, eventually, there would be more than one, and possibly conﬂicting decrees, in the one suit. Him Singh (2), and so fares we are aware it isnovcl, but we have no clifliculty in deciding that the low: -1' Courts have taken the wrong view. 1t is to start with clear that plaiutifi is gut of Com-5 if the case is decided under Hindu Law. Not having begn conceived in 1893, he could not by Hindu Law have any established right in his father's property at the time, so as to give him a title to sue. The present claim is based on customary law only, and this is not disputed. Dealing with the case then under customary law, we cannot see how the plaintifi can be given the benefit of an allowance of time during the period of gestation. Limitation, unless expressly saved, must begin to run from the date of the incident in respect of which the law applies, that is in the present case from the 5th August 1893, Section 9 of the Act prescribes that when once time has begun'-to run, no subsequent disability or_inabilities to sue stops it. Them was a large body of reversioners in 1893, any one of whom might it he had chosen have sued prior to plaintiff's birth, and it must therefore be held that as against the whole body of reversioners--present or pr0spective--time bfgan to run at once. l'o gap in the period of limitation can be bridged over, and there is nothing tosave time from August 1899 till January l900, still less to save the further time till institution of the suit in 1904. We need not further labour a point which seems to as transparently clear, but it may he noticed that if the method of calculation adopted by the lower Courts was correct, the result is the reductio ad absurdum that under circumstances which might easily arise the limitation for a deelumatory suit of this kind would be extended almost...
