Book excerpt: "The present thesis provides a new theorization of rules of international humanitarian law (IHL) and international human rights law (IHRL) in view of States' relationships toward their own population, civilian or military. IHL is usually perceived in terms of inter-States' interactions, while IHRL is concerned with States' obligations toward their civilians. Nonetheless, both sets of provisions can be reinterpreted: IHL provisions could be seen as generating legal obligations for a State toward its own people and IHRL provisions can apply to military forces as well as civilians. The following thesis will include two main sections: States' obligations toward their own civilian population and States' obligations towards their own military forces. Each section will take into account considerations pertaining to both bodies of law, IHL and IHRL, namely contained in the Geneva Conventions and Additional Protocols and specific Human Rights Covenants. States' obligations will be detailed, focusing on civilians and soldiers' rights. It will be shown that, with respect to civilians, States have obligations toward them before the outbreak of a conflict, during conflict and post-conflict. With regards to military forces, States have an obligation to respect the Force Protection obligation, while also being responsible of assessing reasonable risks imposed to soldiers. Recent case laws as well as relevant governmental policies from different jurisdictions will finally be analyzed to illustrate the current judicialization of soldiers' rights and correlative recognition of States' obligations towards them." --
