Book excerpt: Excerpt from The Privileges and Immunities of State Citizenship It was undoubtedly the object of the clause in question to place the citizens of each State upon the same footing with citizens of other States, so far as the advantages resulting from citizenship in those States are concerned. It relieves them from the disabilities of alienage in other States; it inhibits discriminating legislation against them by other States; it gives them the right of free ingress into other States and egress from them. It insures to them in other States the same freedom possessed by the citizens of those States in the acquisition and enjoyment of property and in the pursuit of happiness; and it secures to them in other States the equal protection of the laws. It has been justly said that no provision in the Consti tution has tended so strongly to constitute the citizens of the United States one people as this.5 Indeed, without some provision of the kind removing from the citizens of each State the disabilities of alienage in the other States, the Republic would have constituted little more than a league of States; it would not have constituted the Union which now exists. Book excerpt: Excerpt from Citizenship of the United States In the more restricted meaning of the term, a citizen is a per son who has the right to vote for public officers and on public measures, and who is qualified to hold offices in the gift of the: people. But this definition is too narrow, for minors - who are not permitted to vote - and women - who are allowed to exercise the franchise in only a few of the states - are citizens. In the broad sense of the word, citizens are the people, the members of the state or nation, including men, women, and children. In the United States thev are the sovereign power. Book excerpt: Excerpt from The Rights and Duties of Citizens, of the United States: A Manual of Citizenship The scholars in our public schools and colleges should be instructed as to the elements that go to make up a good and useful citizen of our country, and the obligations, civil, social, and political, due to others from them. They should be instructed to yield respect and obedience to the laws, and to hold on with unflinching firmness to the Constitution and the Union of States. They should be taught the love of liberty and order, to walk in the path of patriotism, of fidelity to our country, and of duty to God. This is necessary in order that when they become of adult age they may be prepared to exhibit wisdom in the cabinet; the purest patriotism; the highest integrity, public and private; morals without a stain; and religious feelings without intolerance and without extravagance. In this little manual of the rights and duties of citizenship I sing the love of country and the pride of country to the youth of both sexes of my country. I teach the need of beating back ones country's enemies, whether they reside in or out of the United States - a most true song, to which I hope the hearts of the youth of our country will burst responsive into fiery melody, followed by fiery strokes before long. Book excerpt: Excerpt from The Adoption of the Fourteenth Amendment The Supreme Court Of the United States, in the Slaugh ter House Cases, declared that the privileges and immuni ties of citizens guaranteed by the Fourteenth Amendment are those which they possess as citizens Of the United States and not those which they enjoy by virtue of state citizenship. This decision means that those privileges and immunities which flow from state citizenship must rest for their security and protection where they have heretofore rested, namely, upon the States. In Maxwell w. Dow the Court declared that the privileges and immunities Of citi zens Of the United States do not include those enumerated in, and secured against violation on the part of the Central Government by the first eight Amendments to the Federal Constitution. The same Court, in the Civil Rights Cases, declared that Congress cannot enact direct, affirmative leg islation for the enforcement of the Fourteenth Amendment and can enact only remedial legislation. Available in PDF, EPUB and Kindle. Book excerpt: In The Second Founding: An Introduction to the Fourteenth Amendment, Ilan Wurman provides an illuminating introduction to the original meaning of the Fourteenth Amendment's famous provisions 'due process of law,' 'equal protection of the laws,' and the 'privileges' or 'immunities' of citizenship. He begins by exploring the antebellum legal meanings of these concepts, starting from Magna Carta, the Statutes of Edward III, and the Petition of Right to William Blackstone and antebellum state court cases. The book then traces how these concepts solved historical problems confronting framers of the Fourteenth Amendment, including the comity rights of free blacks, private violence and the denial of the protection of the laws, and the notorious abridgment of freedmen's rights in the Black Codes. Wurman makes a compelling case that, if the modern originalist Supreme Court interpreted the Amendment in 'the language of the law,' it would lead to surprising and desirable results today.

Book excerpt: Our Constitution speaks in general terms of liberty and property, of the privileges and immunities of citizens, and of the equal protection of the laws--open-ended phrases that seem to invite readers to reflect in them their own visions and agendas. Yet, recognizing that the Constitution cannot be merely what its interpreters wish it to be, this volume's authors draw on literary and mathematical analogies to explore how the fundamental charter of American government should be construed today.

Available in PDF, EPUB and Kindle. Book excerpt: Citizenship as Foundation of Rights explores the nature and meaning of American citizenship and the rights flowing from citizenship in the context of current debates around politics, including immigration. The book explains the sources of citizenship rights in the Constitution and focuses on three key citizenship rights - the right to vote, the right to employment, and the right to travel in the US. It explains why those rights are fundamental and how national identification systems and ID requirements to vote, work and travel undermine the fundamental citizen rights. Richard Sobel analyzes how protecting citizens' rights preserves them for future generations of citizens and aspiring citizens here. No other book offers such a clarification of fundamental citizen rights and explains how ID schemes contradict and undermine the constitutional rights of American citizenship.
