Available in PDF, EPUB and Kindle. Book excerpt: Legal scholars and authorities generally agree that the law should be obeyed and should apply equally to all those subject to it, without favour or discrimination. Yet it is possible to see that in any legal system there will be situations when strict application of the law will produce undesirable results, such as injustice or other consequences not intended by the law as framed. In such circumstances the law may be changed but there may be broad policy reasons not to do so. The allied concepts of dispensation and economy grew up in the western and eastern traditions of the Christian church as mechanisms whereby an individual or a class of people could, by authority, be excused from obligations under a particular law in particular circumstances without that law being changed. This book uncovers and explores this neglected area of church life and law. Will Adam argues that dispensing power and authority exist in various guises in the systems of different churches. Codified and understood in Roman Catholic and Orthodox canon law, this arouses suspicion in the Church of England and in English law in general. The book demonstrates that legal flexibility can be found in English law and is integral to the law of the Church, to enable the Church today better to fulfil its mission in the world.

Available in PDF, EPUB and Kindle. Book excerpt: This fourth revised edition brings an invaluable text thoroughly up to date in light of recent and forthcoming changes to ecclesiastical law. Theological students and clergy need to know the canon law in which much of their theology and parish work is embedded. Practising lawyers will find here information on the immediate problems arising in ecclesiastical cases as well as the background of ecclesiastical law in which they are set. This book deals with the basic principles on which canon law is built and with the complications which arise by reason of the Establishment, and gives in outline the constitution of the Church of England, and the law relating to its worship, sacraments, property, and persons.

Book excerpt: Written by experts from within their communities, this book compares the legal regimes of Christian churches as systems of religious law. The ecumenical movement, with its historical theological focus, has failed to date to address the role of church law in shaping relations between churches and fostering greater mutual understanding between them. In turn, theologians and jurists from the different traditions have not hitherto worked together on a fully ecumenical appreciation of the potential value of church laws to help, and sometimes to hinder, the achievement of greater Christian unity. This book seeks to correct this ecumenical church law deficit. It takes account of the recent formulation by an ecumenical panel of a Statement of Principles of Christian Law, which has been welcomed by Pope Francis and the Ecumenical Patriarch of Constantinople, leader of the Orthodox Church worldwide, as recognizing the importance of canon law for ecumenical dialogue. This book, therefore, not only provides the fruits of an understanding of church laws within ten Christian traditions, but also critically evaluates the Statement against the laws of these individual ecclesial communities. The book will be an essential resource for scholars of law and religion, theology, and sociology. It will also be of interest to those working in religious institutions and policy-makers.

Available in PDF, EPUB and Kindle. Book excerpt: This book provides the first comprehensive analysis of the principal legal landmarks in the evolution of the law of the established Church of England from the Reformation to the present day. It explores the foundations of ecclesiastical law and considers its crucial role in the development of the Church of England over the centuries. The law has often been the site of major political and theological controversies, within and outside the church, including the Reformation itself, the English civil war, the Restoration and rise of religious toleration, the impact of the industrial revolution, the ritualist disputes of the 19th century, and the rise of secularisation in the twentieth. The book examines key statutes, canons, case-law, and other instruments in fields such as church governance and ministry, doctrine and liturgy, rites of passage (from baptism to burial) and church property. Each chapter studies a broadly 50-year period, analysing it in terms of continuity and change, explaining the laws by reference to politics and theology, and evaluating the significance of the legal landmarks for the development of church law and its place in wider English society.

Book excerpt: This highly useful book provides quick reference and accessibility to the current canon law of both churches. The entry for every canonical term presents its definition and the law relating to it in each canon. There are cross-references throughout to help the reader make further significant connections. Also included are terms not easily translated across the two canons, and some common terms from the Eastern Catholic Church. The appendices contain changes to the Universal law of the Roman Catholic Church which are outside the 1983 Code of Canon law. At a time when Christians are increasingly working side by side, this is an essential resource for pastoral workers, scholars and clergy in all the churches.

Available in PDF, EPUB and Kindle. Book excerpt: The Anglican Communion is the third largest Christian denomination and claims a membership of some 80 million members in about 164 countries. Given that there are only around two hundred countries in the world, this makes the churches of the Anglican Communion the most geographicallywidespread denomination after Roman Catholicism. The 44 essays in this volume embrace a wide range of academic disciplines: theological; historical; demography and geography; and different aspects of culture and ethics. They are united in their discussion of what is effectively a newinter-disciplinary subject which we have termed "Anglican Studies". At the core of this volume is the phenomenon of "Anglicanism" as this is expressed in different places and in a variety of ways across the world. This Handbook covers a far broader set of topics from a wider range of perspectives than has been hitherto attempted in Anglican Studies. At the same time, it doesn't impose a particular theological or historical agenda. The contributions are drawn from across the spectrum of theological views andopinions. It shows that the unsettled nature of the polity is part of its own rich history; and many will see this as a somewhat lustrous tradition. In its comprehensive coverage, this volume is a valuable contribution to Anglican Studies and helps formulate a discipline that might perhaps promotedialogue and discussion across the Anglican world.

Book excerpt: Church polity, as a theological discipline, has become increasingly aware of the challenge of contextuality, due to tendencies like secularization in the global North and a renewed awareness of inherited cultural and religious traditions in the global South. The ecumenical movement offers a particular framework for reflection on such developments. Contexts I and Contexts II of Protestant Church Polity in Changing Contexts contain proceedings from an international conference held in Utrecht in November 2011. Contexts I (ISBN 978 3 643 90310 5) includes essays in the fields of ecclesiology, church history, missiology, inter-cultural theology, and practical theology. The companion Contexts II (ISBN 978 3 643 90311 2) presents a number of case studies. (Series: Church Polity and Ecumenism. Global Perspectives - Vol. 2)

Book excerpt: This volume presents in English the official Joint Declaration on the Doctrine of Justification, confirmed by the Lutheran World Federation and the Roman Catholic Church in Augsburg, Germany, in October 1999. The result of decades of Lutheran-Roman Catholic dialogue, this primary document represents an ecumenical event of historical significance. Included in the volume are the Joint Declaration on the Doctrine of Justification and the Official Common Statement with its Annex. These texts are recommended for careful study in seminaries and parishes and for reading by individual Christians. It is hoped that the Joint Declaration will deepen understanding of the biblical message of justification and also serve to further reflection within the wider ecumenical movement.

Religious courts, the wearing of religious symbols and faith schools have given rise to increased legislation and litigation. This is the first student textbook to set out the fundamental principles and issues of law and religion in England and Wales. Offering a succinct exposition and critical analysis of the field, it explores how English law regulates the practice of religion. The textbook surveys law and religion from various perspectives, such as human rights and discrimination law, as well as considering the legal status of both religion and religious groups. Controversial and provocative questions are explored, promoting full engagement with the key debates. The book's explanatory approach and detailed references ensure understanding and encourage independent study. Students can track key developments on the book's updating website. This innovative text is essential reading for all students in the field.
