Book excerpt: Excerpt from Testamentary Forms and Notes on Wills A previous work on wills by the same author, designed for use in Massachusetts, has been of service to the profession in that State. The present volume is prepared with a view to its use in every American jurisdiction. The greater part of the work is devoted to forms, and the suggestions not only embrace the recognized principles of law but numerous practical points which it is believed are to be found hi no other work. Briefly stated, the purpose is to provide the attorney with a book which, after receiving instructions from the testator, he may consult in order to learn if these instructions are permissible and proper, or should be abridged or enlarged, and in which he may find the form he desires. Download or read book The Law of Wills, Vol. 1 written by Isaac F. Redfield and published by Forgotten Books. This book was released on 2018-01-31 with total page 754 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of Wills, Vol. 1: Embracing the Jurisprudence of Insanity, the Making and Construction of Wills, and the Effect of Extrinsic Evidence Upon Such Construction; With Forms and Instructions for Preparing Wills The Second Part of the work, which is confined to the practical detail of the Settlement of Estates, and the crea tion, construction, and administration of Testamentary Trusts, including Devises and Legacies, is nearly ready for the press, and may be expected in a few months. Some few of the topics discussed in Jarman will more naturally fall into this portion of the work. It is scarcely necessary for the author to say much of the character of his work, since that must depend more upon-the work itself, than upon any. Thing which may be said of it, even by the most disinterested. But it may not be improper to give an outline of what has been attempted. It has been the purpose of the writer to refer to all the leading or important English cases upon the several topics discussed, and to give the precise point determined, either in the text or the notes. And where there was any conflict in the decisions, it has been his purpose to give the history of the different classes of authorities, in such a manner, as to present the true principle to be ex tracted from all the cases bearing upon the point. And upon every point to bring the cases down to the latest moment, so as to give the true state of the English and American law at the time of publication. In this way, it is believed, the work will be found to present in a compact and perspicuous form, the elementary principles involved; and at the same time such a digest of the decided cases, as to become a useful commentary upon the subjects discussed, and a reliable guide, both for the student and the practitioner. Book excerpt: Excerpt from A Concise Treatise on the Construction of Wills Since the last edition of this work the Land Transfer Act, 1897, has come into operation. The statute makes important changes in the law relating to testamentary disposition. Though the Act has now been in Opera tion for more than two years, hardly any cases under it have come before the Courts. Sect. 4, which deals with executors' powers of appropriation, has been judiciously allowed to remain dormant by omitting to make rules under it. The decisions upon the construction of wills have been numerous. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Download or read book Probate Cases written by Jacob Singer and published by . This book was released on 2015-07-14 with total page 358 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Probate Cases: Being Cases Heard and Decided by the Register of Wills; For the County of Philadelphia; 1901-1904 During my term of office a considerable number of interesting, if not important, cases came before me for judicial determination. The questions involved were often elaborately argued and briefed by learned counsel, and much thought was given to the preparation of the opinions filed. There being no place for these in our systems of Reports, the suggestion has been made by several leading members of the Philadelphia Bar, that their publication would be of interest to the legal profession. I have acted upon this suggestion and the more important cases, syllabused and indexed, with notes indicating final decision on appeal, I have caused to be printed in a limited number for distribution among those who I thought would feel interested. If I might be permitted to entertain the hope that the recipients of this volume would receive it as nothing more than a slight evidence of my deep appreciation of the very flattering expression of approval of my work as Register sent to me by my brethren of the Philadelphia Bar at the close of my term of office, and which I have caused to be herein inserted, I should feel amply repaid for any effort expended in and about its publication. In the arrangement of this book, I am much indebted to my friends, Alex. Simpson, Jr., Esq., for valuable suggestions; Jerome J. Rothschild, Esq., for generous and indispensable assistance, and Robert M. Boyle, Esq., for material aid.
