Scientific capabilities to search for evidence of extant or relic life outside Earthâ€"among the principal goals of solar system explorationâ€"are advancing rapidly. In this time of rapid transition in exploring solar system bodies, the importance of reexamining planetary protection policies, including the need for clarity in how NASA establishes such policies, has become more urgent. Overall, this study seeks to review the current state of planetary protection policy development, assess the responsiveness of the policy development process to contemporary and anticipated needs, and recommend actions that might assure the effectiveness of NASA's future coordination and execution of planetary protection. This interim report focuses on the goals of and rationales for planetary protection policies and suggests a working definition of planetary protection consistent with those goals. It does not address future commercial planetary missions, human missions to planetary bodies, or roles and responsibilities for implementing policies, but these issues will be addressed in the final report.

Book excerpt: This work investigates the permissibility and viability of property rights on the - lestial bodies, particularly the extraterrestrial aspects of land and mineral resources ownership. In lay terms, it aims to ?nd an answer to the question “Who owns the Moon?” The ?rst chapter critically analyses and dismantles with legal arguments the issue of sale of extraterrestrial real estate, after having perused some of the trivial claims of celestial bodies ownership. The only consequence these claims have on the plane of space law is to highlight the need for a better regulation of extraterrestrial landed property rights. Next, thebook addresses theapparent silenceofthelawinthe?eldofextraterr- trial landed property, scrutinizing whether the factual situation on the extraterrestrial realms calls for legal regulations. The sources of law are examined in their dual dimension – that is, the facts that have caused and shaped the law of extraterrestrial real estate, and the norms which express this law. It is found that the norms and rules regarding property rights in the celestial realms are rather limited, failing to de?ne basic concepts such as celestial body.

Book excerpt: The purpose of this book is to propose a legal regime to govern the exploitation of natural resources of the moon and other celestial bodies. Considering, on the one side, the interest shown by states and private operators to extract and use extraterrestrial natural resources and, on the other, the absence of specific rules dealing with such an option, the establishment of a legal framework to regulate the exploitation of natural resources of the moon and other celestial bodies is needed so as to ensure its peaceful, safe and orderly development.

These instruments constitute the principal body of international space law and will continue to provide, further into the twenty-first century, an effective framework for the expanding and increasingly complex tasks aimed at the exploration and use of outer space for peaceful purposes. May they continue to support humankind's space activities throughout the years to come.

Book excerpt: "Palatino-Roman" The moon, the stepping-stone to exploring the unknown of outer space, is an extremely hostile environment without an atmosphere and climate comparable to that of Earth. Despite such forbidding characteristics, however, the moon has recently attracted attention as China, the ESA, NASA, and even commercial enterprises plan missions to the moon in the near future. This new race to the moon could be a source of future conflict, but the moon is not devoid of legality. The Moon Treaty entered into force with five member states on December 1, 1984. However, as of January 1, 2004, only ten states have ratified the treaty which has been interpreted as placing a moratorium on any lunar exploitation. Although the comparable Antarctic Treaty has had a limited number of members, its impact has nevertheless been considerable. Also, a number of international agreements have developed under the auspices of the Moon Treaty's predecessor, the comprehensive Outer Space Treaty. These agreements have all contributed to the establishment and strengthening of international space law. However, the controversial Moon Treaty is considered to have future effects on the political, economic, and security interests of the international community as a whole by encompassing the Common Heritage of Mankind principle. The purpose of this study is to investigate the low level of ratification of the Moon Treaty and to examine whether and to what extent the parent Outer Space Treaty, the Moon Treaty, subsequent U.N. resolutions, bilateral treaties, and unilateral actions can create, together or independently, a legal regime for the moon that could be claimed to be valid erga omnes, applicable to all. Thestudy thus includes a general discussion of the provisions, rules, and norms of international law. Although the pacta tertiis rule which only binds nations with their consent is undoubtedly recognized as a basic rule of international law, there exist exceptions or qualifications to that rule with respect to the Moon Treaty, and in this case pacta tertiis might not be as strict as once believed. It is argued that certain provisions found in the Moon Treaty are expressions of customary law or have acquired customary law status since they have been recognized and accepted by the international community. Therefore, the study contains a detailed analysis of the Moon Treaty including content textual analysis and recourse to its travaux priparatoires. Emphasis is also placed on provisions of similar treaties for hostile environments such as the Antarctic Treaty and the Convention on the Law of the Sea. Since the Moon Treaty is not the sole source of law relating to the international commons, it has been necessary to examine to what extent these and other legal instruments may be relevant for the creation of customary international law for the moon. The existence of these somewhat overlapping and sometimes colliding legal systems is the nucleus of this work.

Book excerpt: The opening of space to exploration and use has had profound effects on society. Remote sensing by satellite has improved meteorology, land use and the monitoring of the environment. Satellite television immediately informs us visually of events in formerly remote locations, as well as providing many entertainment channels. World telecommunication facilities have been revolutionised. Global positioning has improved transport. This book examines the varied elements of public law that lie behind and regulate the use of space. It also makes suggestions for the development and improvement of the law, particularly as private enterprise plays an increasing role in space.

Book excerpt: This contributed volume addresses the future development of space law in light of our ever-growing space activities, the multiplicity of new space actors and the challenges posed by novel space technologies. Unlike existing space law literature, it sets its sights on the future, envisaging how space law could and should evolve in coming decades. Written by experienced professors, academics and practitioners in the field, this edited volume constitutes a valuable tool for understanding the current state of space law, the challenges it is called upon to address and the new phase it is about to enter. In addition, this book initiates a discussion de lege ferenda, addressing the letter and spirit of space law in the world of modern and future space activities. These papers were presented at “The Space Treaties at Crossroads: Considerations de lege ferenda,” held on August 28 to 29, 2015, in Athens, Greece. The conference was jointly organized by the National and Kapodistrian University of Athens and the Institute of Air and Space Law of McGill University

Available in PDF, EPUB and Kindle. Book excerpt: Space exploration is a development which began with the launching of the first artificial satellite in 1957. Since then an incredible progress has been made, leading to the landing of man on the moon. A quick look at the number of launchings which have been registered with the United Nations will show the influence of space science and technology on human endeavours. For example, satellites can be used for com munication, weather forecasting, education, and remote sensing of the resources of the Earth. The United Nations Committee on the Peaceful Uses of Outer Space is the focal point of international co-operation in space activities. The Committee regulates these activities through its Legal Sub-Committee. The setting up of the Committee was preceded by an Ad Hoc Committee which was established on 31 December 1958. The initial difficulty which confronted the Ad Hoc Committee was the issue of its member ship. The USSR, Czechoslovakia and Poland decided not to participate in its work because they were dissatisfied with the composition of the Ad Hoc Committee. Later, both the UAR and India also decided not to participate in its work. Although the Ad Hoc Committee succeeded in producing a report in 1959 (UN document A/4141), the progress of work of the Main Committee was in limbo for a while. It was not until 1961 that the disagreements were resolved. The Committee conducts its business without voting -the Chairman simply states the consensus of views which have been expressed.

Available in PDF, EPUB and Kindle. Book excerpt: The relevance and substance of space law as a branch of public international law continues to expand. The fourth edition of this long-time classic in the field of space law has been substantially rewritten to reflect new developments in space law and technology of the past ten years. This updated text includes new or expanded material on the proliferation of non-state and commercial entities as space actors, the appearance of innovations in space technology, the evolving international law of satellite telecommunications in a networked world, and the adoption of national laws and international soft law mechanisms that complement the international treaty regime. In this up-to-date overview of space law, the authors offer a clear analysis of the legal challenges that play a role in new and traditional areas of space activity, including the following: - the peaceful uses of outer space; - protection of the space environment; - the emergence of new legal mechanisms in space law; - the role of Europe in space; - telecommunications; - the commercial use of space resources; - human space flight; - small satellites; - remote sensing; and - global navigation satellite systems. Additionally, the five United Nations Treaties on space are included as Annexes for easy reference by students and professionals alike. In light of the many new developments in the field, this thoroughly updated Introduction to Space Law provides a clear overview of the legal aspects of a wide array of current and emerging space activities. Lawyers, policy-makers, diplomats, students, and professionals in the telecommunication and aerospace sectors, with or without a legal background, will find concise yet comprehensive guidance in this book that will help them understand and address legal issues in the ever-changing field of space activities. The authors are close former collaborators of the late pioneers of space law and authors of the earlier editions of this volume, Isabella Diederiks-Verschoor and Vladimír Kopal.

Book excerpt: In the wake of the euphoria consequent to the Soviet space forays and the US landing on the moon, innovative space law evolved rather rapidly in just two decades and then came a stalemate. In this hasty growth of nascent space law, some gaps remained, some inadvertently due to lack of vision and some deliberately, due to lack of consensus or because half-baked concepts remained pending till the achievement of a better understanding of space phenomena or development of supportive technology. These issues have since started jumping to centre-stage and this book falls in this niche of deficiencies. A few challenges and unresolved contingencies that stare us in the face, needing to be addressed suitably, are space jurisprudence in jus cogens of space law, pointers on policy issues for India, hesitancy to incorporate international cooperation in domestic space statutes, futility of reiteration of the Convention Law in International Codes of Conduct as soft law adjuncts, absence of a legal regimen governing mining on asteroids by private enterprises, explication of the concept of Common Heritage of Mankind and modalities for sharing of benefits between nations, procedure for nomination of an astronaut as an envoy of mankind in space by name or designation to avoid confusion in the eventuality of multiple astronauts of multiple nationalities, all being at one place at the same time, et al. This book is a modest effort to help resolve issues in that direction.

Book excerpt: The progressive development and codification of international law constitutes one of the principal responsibilities of the United Nations in the legal field. An important area for the exercise of such responsibilities is the new environment of outer space and, through the efforts of the United Nations Committee on the Peaceful Uses of Outer Space and its Legal Subcommittee, a number of significant contributions to the law of outer space have been made. The United Nations has, indeed, become a focal point for international cooperation in outer space and for the formulation of necessary international rules. Outer space, extraordinary in many respects, is, in addition, unique from the legal point of view. It is only recently that human activities and international interaction in outer space have become realities and that beginnings have been made in the formulation of international rules to facilitate international relations in outer space. As is appropriate to an environment whose nature is so extraordinary, the extension of international law to outer space has been gradual and evolutionary - commencing with the study of questions relating to legal aspects, proceeding to the formulation of principles of a legal nature and, then, incorporating such principles in general multilateral treaties.
