Book excerpt: This report finds that progress has been made in implementing many of the recommendations made by the Public Accounts Committee (PAC) in December 2012. However, there are a number of areas where the Ministry and its contractor Capita still need to improve. The Ministry is now performing audit checks of the security status of interpreters and some data generated by Capita. In addition, the number of interpreters available to work under the contract has increased significantly; spending outside the contract has decreased substantially for civil courts and tribunals; and the Ministry now routinely collects and monitors management information. However, Capita is still not meeting the target to fulfill 98 per cent of bookings of interpreters, and performance fell temporarily by 8 per cent between December 2012 and April 2013 as a result of Capita's reducing mileage payments to interpreters. The work the Ministry has undertaken has not established whether, and if so to what extent, there is an ongoing problem with the recording of customer cancellations, although it has just introduced 100 per cent checks of these bookings. More than twice as many Tier 3 interpreters are being used under the contract since the NAO last reported. The Ministry has also been slow to implement some PAC recommendations. A new assessment system for interpreters has not been implemented and an independent review of quality standards has not yet been performed

Book excerpt: Before January 2012, the Ministry generally booked interpretation services directly with individual interpreters, many of whom were listed on the National Register of Public Service Interpreters (NRPSI). This approach was administratively inefficient and the Ministry decided to set up a new centralised procurement system. The Ministry awarded the contract to a company, ALS, that was clearly incapable of delivering. Despite having been warned that ALS was too small to shoulder a contract worth more than £1 million, it went ahead and handed them an annual £42 million national contract. The Ministry did not understand its own basic requirements and ignored the views of interpreters, who had serious concerns about the contract. Capita took over ALS in late 2011. The Ministry needed access to 1,200 interpreters when the contract went live but the company had only 280 properly assessed interpreters willing to work for it. The Ministry, though, still decided to go live nationally in one go. Many of the 'interpreters' it thought were available had simply registered an interest on the company's website and had been subject to no official checks. As a result, the company was able to meet only 58% of bookings causing a sharp rise in delayed, postponed and abandoned trials; individuals being kept on remand solely because no interpreter was available; and the quality of interpreters has at times been appalling. However Capita has only been fined £2,200 to date for failing to meet the terms of the contract. Capita-ALS is now fulfilling more bookings, but it is still struggling

Book excerpt: Evidence suggests that the MoJ did not have a sufficient understanding of the complexities of court interpreting work. Significant concern was revealed that quality standards could be diminished by the imposition of a tiered system to enable a wider pool of interpreters, and by the introduction of lower levels of pay. However, the Department pushed ahead with the contract and failed to properly anticipate or address the potential for problems with Applied Language Solutions' (ALS) capacity to deliver on its promises. ALS, and more recently Capita, has been unable to recruit qualified and experienced interpreters in sufficient numbers. Professional interpreters have largely boycotted the new arrangements and Capita-ALS clearly needed significantly more resources than it had at its disposal. It also only paid lip service to the regulatory duties accepted under the Framework Agreement, yet did not have the capacity to cope with complaints or to implement basic vetting procedures. The MoJ has had to monitor Capita-ALS very closely to secure the level of improvement necessary to make the Agreement workable, and continues to do so. The existing arrangements may not be financially sustainable as Capita is propping up the continuation of the Agreement, which mean that the Department's savings, originally projected to be £15million, are effectively being secured at the company's expense. Actions taken by MoJ also had the effect of hampering the inquiry when HMCTS issued an edict to its staff instructing them not to participate in the Committee's online consultation, established to invite direct observations from frontline staff of the performance of ALS

Book excerpt: In the memorandum 'The role of major contractors in the delivery of public services' the NAO sets out some of the benefits that can be achieved through contracting but highlights three issues that deserve greater public scrutiny. First, it raises questions about the way public service markets operate. This includes the need for scrutiny over whether public service contracts are sufficiently competitive and whether the rise of a few major contractors is in the public interest. Secondly, it highlights the issue of whether contractors' profits reflect a fair return. Understanding contractors' profits is important to ensure that their interests are aligned properly with that of the taxpayer. But transparency over rewards that contractors make is at present limited. Thirdly, the report asks how we know that contractors are delivering services to the high standards expected. In particular, government needs to ensure that large companies with sprawling structures are not paying 'lip-service' to control and that they have the right culture and control environment across their group. This requires transparency over contractors' performance and the use of contractual entitlement to information, audit and inspection. This should be backed up by the threat of financial penalties and being barred from future competitions if things are found to be wrong. Unfortunately, over-reliance on such outsourcing has given rise to significant dangers, including information asymmetry, goal divergence, and risk. Legal Translation Outsourced provides the only current reference on commercial legal translation performed outside institutions. Juliette Scott casts a critical eye on the practice as it now stands, offering an analysis of key risks and constraints. Her work is informed by empirical data of the legal translation outsourcing markets of 41 countries. Scott proposes original theoretical models aimed both at training legal translators and informing all stakeholders, including principals and agents. These include models of legal translation performance; a classification of constraints on legal translation applying upstream, during and downstream of translation work; and a description of the complex chain of supply. Book excerpt: The Ministry of Defence has now reported on the affordability of its ten-year forward plan to purchase and support military equipment (the Equipment Plan) totalling some £159 billion, as well as its progress on delivering its largest projects in 2012. The Department has made a good start but there are concerns about over-optimistic assumptions, the completeness and robustness of support cost estimates, and risks to capability. The affordability of the Plan is based on an agreement between the Department and HM Treasury that it will receive a one per cent annual increase in its equipment budget over the period from 2015-16 to 2020-21. If this is now not achieved in the current fiscal circumstances then the current plan may well be unaffordable. The addition of a contingency provision of £4.8 billion is a positive step, however this may not be sufficient to absorb cost growth. In addition, the Department lacks a robust understanding of the support costs, and the associated risks, including the size of the budget that may be required to recover equipment from Afghanistan. The Department also faces a particular challenge in delivering projects to agreed timescales. Ultimately, the Department bears the risk of these delays in terms of military capability and we need greater transparency on these risks and how they are mitigated. This includes the Department being clear on the impact on capability if the £8 billion that is currently unallocated in the budget cannot be used for purchasing new equipment because it is needed to absorb cost growth

Book excerpt: The National Offender Management Service directly manages 117 public prisons, manages the contracts of 14 private prisons, and is responsible for a prisoner population of around 86,000. It commissions and funds services from 35 probation trusts, which oversee approximately 165,000 offenders serving community sentences. For 2012-13, the Agency's budget is £3,401 million. The Agency achieved its savings targets of £230 million in 2011-12 and maintained its overall performance, despite an increase in the prison population. However, the Agency's savings targets of £246 million in 2012-13, £262 million in 2013-14 and £145 million in 2014-15 are challenging. The Agency believes it has scope to make the prison estate more efficient by closing older, more expensive prisons and investing in new ones. These plans, however, assume the prison population will stay at its current level. Furthermore, the Agency has not yet secured the up-front funding for the voluntary redundancies needed to bring down prison staffing costs. Unless overcrowding is addressed and staff continue to carry out offender management work it is increasingly likely that rehabilitation work needed to reduce the risk of prisoners reoffending will not be provided. The Agency has not done enough to address the risks to safety, decency and standards in prisons and in community services arising from staffing cuts implemented to meet financial targets. The Agency plans to increase the role of private firms and the third sector in probation but the probation trusts don't appear to have the infrastructure and skills they need to commission probation services from these providers effectively

The Cabinet Office is responsible for overseeing implementation of the Plan. The Committee hope that the reforms and enhanced capabilities will help prevent the failures in project and programme delivery it has seen so often, but is concerned, however, that government has not set itself objective measures for assessing the impact of its reforms. If the public is to have confidence in the system for holding permanent secretaries accountable, the Government must be clear about the detail of what each permanent secretary is expected to achieve and how their performance will be assessed. Commercial and contracting skills in the civil service remain weak and underdeveloped, despite the many attempts to address this skills deficiency in recent years. Efforts to fill skills gaps are hindered by real or perceived barriers to recruiting people with the necessary expertise and paying them enough. The process for overseeing major projects lacks real teeth and is seemingly unable to stop ill-conceived or poorly-managed projects. Yet the Government will only be successful in cutting public spending with minimum impact on frontline services if it finds new and innovative ways to deliver its programmes. This innovation can only be implemented if the Civil Service has the necessary skills and competencies.

This is at considerable cost to the taxpayer and can create misery and hardship to the claimants themselves. This poor decision-making is damaging public confidence and generating a lot of criticism of the Department's contractor for medical assessments, Atos Healthcare - but most of the problems lie firmly within the DWP. The Department's view that appeals against decisions are an inherent part of the process is unduly complacent. Nearly 40 per cent of appeals are successful, with a third of those successful appeals involving no new evidence. The Work Capability Assessment process hits the most vulnerable claimants hardest. The one size fits all approach fails to account adequately for mental health conditions or those which are rare or fluctuating. While the Department has started to improve, the process is still too inflexible and too often is so stressful for applicants that their health simply gets worse. A key problem is that the Department has been unable to create a competitive market for medical assessment providers, leaving Atos in the position of being a near monopoly supplier. The Department is too often just accepting what Atos tells it. It seems reluctant to challenge the contractor. It has failed to withhold payment for poor performance and rarely checked that it is being correctly charged. The Department also cannot explain how the profits being made by Atos reflect the limited risk that it bears
