Book excerpt: This book aims to give a comprehensive picture of law, government and the constitution in Malaysia, and to set constitutional developments in their proper political and social context. It is written in such a way that lawyers may see how perspectives other than the purely legal can enrich the understanding of constitutional issues in Malaysia and that others may comprehend the lawyer's perspective on these issues. There has been an increasing interest in constitutional issues in Malaysia since the mid-1980s following a number of important events, including the advent of judicial activism and the curtailment of royal powers. There is now a pressing need for a reappraisal of the Malaysian constitution in terms of its political and social dimensions and dynamics, and the extent of its adherence to, or its interpretation of, those principles which are collectively known as `constitutionalism', that is, democratic government, the rule of law, the separation of powers, and the observance of fundamental human rights and liberties. The book examines how the constitution has adjusted to its environment, how it actually operates and how its abstractions differ from reality. The author concludes that the principles of the constitution have been eroded to such a degree that a new constitutional settlement is needed - one which makes it clear what the basic tenets of the Malaysian polity are.

Book excerpt: Why have Islamic insurance systems developed well in some countries, but not in others? Malaysia is considered as Islamic insurance elite due to its relatively large number of operators it houses as well as the sustained growth of Islamic insurance sales within the country, while Indonesia and Pakistan are still in early stages of development. Analyzing the political and social history of Islamization of insurance systems in these three Muslim majority countries in Asia since 1980s, this book demonstrates the development gap between these countries on Islamic insurance results from; firstly, complex bargains made between various groups within each country polity, and those bargains are structured by the country's fundamental political institutions. Secondly, the gap is also an outcome of different societal transformations during the Islamization that 'produce Islam(s)' in these countries. The revival of Islamic principles in these countries does not only create Sharia-compliant financial products but produces Islamic norms, identities, ethics, and practices enacted in the way the communities manage their risk.

This book demonstrates how these conflicts stem from four unresolved schisms dating from the decolonisation period: race, class, language, and the meaning of self-determination. The author argues that these schisms drove the events of decolonisation, the creation of Malaysia, and Singapore’s separation and continue to actively shape Singapore today. Using contemporary English- and Chinese-language sources from a wide array of perspectives, as well as numerous declassified official documents, this book provides a new approach to the most formative period of Singapore history. It explains in detail the different ideologies, institutions, and conflicts which shaped Singaporean politics and society during decolonisation. In particular, the book focuses on the leaders of the main groups which most heavily influenced Singapore’s anti-colonial nationalism – the Chinesespeaking, the working class, and left-wing intellectuals.
