Book excerpt: Excerpt from The Law Relating to Trusts and Trustees In this Work the author has endeavoured to follow out the thought expressed by these great lawyers by extracting and formulating the principles of the law of Private Trusts in the form of a Code. By way of illustration all the important modern decisions, and such of the more ancient ones as are retained in the Revised Reports, are cited; so that the reader is enabled to see, at a glance, what the author conceives to be the law the principle) governing any particular point; he is then further presented with a series of decided cases which prove, illustrate, and explain the application of that principle; and further, in the foot notes, he is referred to other authorities if he desires to make an exhaustive search. Book excerpt: Excerpt from A Treatise on the Law of Trusts and Trustees, Vol. 1 of 2 IN all the courts of last resort in this country, the judges, continually and as a perfectly understood and settled thing, refer to Perry on Trusts as the standard authority upon all questions of law and equity pertain ing to its subject-matter. Many times eminent judges in writing their Opinions have deemed it sufficient proof of a principle or rule they wished to make use of, simply to state it with a reference to Perry; and indeed few judges could hope to arrive at more correct conclusions or more convincing proof of them than the clear, strong mind and intense industry of the author enabled him to attain. The heart's blood of his best manhood he poured into this study; many buried years bloom in this book, - it is the flower Of a vigorous life. Book excerpt: Excerpt from Concise Manual of the Law Relating to Private Trusts and Trustees Every person who has had practical experience as a lawyer, divides his professional knowledge into two distinct heads, namely: - first, his habitual knowledge - that knowledge of the rides of law which is laid up in his memory, so that whenever he has reason to apply those rules they are accurately recalled without external aid; and secondly, his knowledge of the storehouses, so to speak, where he can get the actual knowledge of any branch of law of which he is uncertain. Now of storehouses of law we have an ample supply. Putting aside the various digests, no works could well be more complete and detailed than Mr. Dart's Book on Vendors and Purchasers, Mr. Jarman's on Wills, Mr. Chitty's on Contracts, Mr. Addison's on Torts, Mr. Justice Lindley's on Partnership, and last, but far from least, Mr. Lewin's Model Treatise on Trusts. Again, we have smaller but singularly complete summaries of case law in Mr. Roscoc's Nisi Prius Evidence, and Mr. Watson's excellent Compendium of Equity, a book which ought to be in the hands of every practical lawyer. Book excerpt: Excerpt from A Digest of the Law Relating to Private Trusts and Trustees In such a state of the law it is not to be wondered at that the lay trustee should often err from ignorance of his obligations. Even the lawyer can easily go wrong. A distinguished member of the Chancery Bar, lecturing on the duties and liabilities of trustees some time since, gave an apt illustration of this' Towards the end of last sittings, he said, and almost at the close of a case relating to trustees then being tried in the Chancery Division, it became apparent from an observation made from the bench that all the four counsel engaged in the case, learned and experienced men as they were, had not considered the provisions of the most recent Trustee Act, that of 1894, though such provisions bore directly upon the subject-matter (a). It is not to be wondered at when the law, to use the lecturer's phrase, lurks in volumes of reports to be counted by hundreds or lies buried, but with a hideous power of inopportune resurrection, in some partially repealed statute. Book excerpt: Excerpt from A Digest of the Principles of the Law of Trusts and Trustees IT is intended in this work to place before the Profession, in as concise a form as the nature of the subject permits, the various principles which guide Courts of Equity in dealing With What is probably the most important branch of their jurisprudence. In adopting the title I have chosen, I am aware that, scientifically speaking, the book is not a digest in the sense in which that term is used by jurists; but it is hoped that by the process of condensation, and by the elimination of matters of comment and criticism, the term may not be found inappropriate. A perfect digest in the sense referred to, on so extensive a subject, would be a work embracing so large an area, and involving matters of detail so complex and diverse in character, that the object of this book, as stated above, would in a great measure be defeated by seeking to supply such a work. Originally published: Boston: Little, Brown and Co., 1929. 2 vols. clxxxi, 804; xviii, 805-1729 pages. Star-paged. (Total 1, 934 pp.) Reprint of the seventh and final edition of a classic treatise first published by Jairus Ware Perry [1821-1877] in 1872. "This treatise ... is the last word on this all important subject; the publishers have well selected Mr. Raymond C. Baldes of the Boston Bar to revise and enlarge [it]. For years it has been regarded as an authority upon the subject matter; here was one writer whose statements unsupported by judicial decisions made the law. The original text has been preserved as far as possible. (...) If there are defects in the execution of this work the writer of this review has failed to find them. (...) It may be that in years to come there will be found a later work upon the subject. If so, it will embody all that there is in the present volumes as revised and published; the basic principle will be the same and only as there are new inventions or later decisions, will it be found that the law has changed. [This] is a work which we cannot too highly compliment ... These two volumes should be upon the desk, or in the library of every lawyer who handles trusts of any kind and who has anything to do with trustees." --Lawyer and Banker and Central Law Journal 22 (1929) 258

Book excerpt: Excerpt from A Practical Treatise on the Law Relating to Trustees, Their Powers, Duties, Privileges and Liabilities The existence and established character of Mr. Lewin's very valuable Treatise on the Law of Trusts and Trustees, may seem to call for some apology for the appearance of the present work. It might, perhaps, be suflicient for the writer to state that his own work had been commenced previously to the appearance of that of Mr. Lewin; but, in truth, it will be seen on examination that the object, as well as the arrangement, of the two treatises is very dis similar in many material respects. The present work, as appears from its title, is written principally for the information and guidance of Trustees in the discharge of their office, and the Law of Trusts has not been gone into further than appeared absolutely essential for the development of that object. However, even with this limited purpose in view, a Treatise on' the Law relating to Trustees involved, in a greater or less degree, the consideration of the whole Law of Real and Personal Property; and the difficulty of effecting a clear and continuous arrangement, which should embrace all the branches of the subject, is proportionably great. The defects on this point, as well as many of those attending the execution of the work, are sufficiently apparent even to the writer himself; but he feels that those who will discover the imperfections must also be sensible of the difficulty of avoiding them, and will, therefore, be disposed to make the requisite allowances, and with this conviction he has greater confidence in bringing his work before the public. Book excerpt: Excerpt from Trusts for Business Purposes In all probability no part of our law is so well settled as that in reference to trusts and trustees; a rule on this subject laid down in one section of the country is usually adopted and ap plied in another. The reason for this is readily found in that the principles underlying the trust are the same throughout the country irrespective of state lines. This of course is not true of the corporation, for each state has its own acts and no state is bound by the interpretation of the corporate law of a sister state.
