Book excerpt: "This addition to the Model Jury Instructions series, published by the ABA Section of Litigation, provides clear and balanced instructions for presentation to juries in copyright, trademark and trade dress litigation. These models accurately and impartially present the elements and critical definitions of copyright, trademark and trade dress law in language that is understandable and familiar to the average juror. The book includes a CD-ROM of the jury instructions that allows for easy adaptation to particular cases or points. Chapter introductions give overviews of the current state of the law, including the major recent cases in most jurisdictions, with discussions of the practical issues you might have to consider. Individual instructions are followed by commentary that includes discussion of the cases from which the instruction was derived, as well as how and when to adapt the instruction to particular cases, to the laws of particular states, to the requirements of particular jurisdictions, or in the light of inconsistent authority. Besides making it easy to present first-rate instructions, the models and supporting citations give you an excellent starting place from which to investigate the nuances of a particular jurisdiction. This book gives you the framework for preparing and trying your case, from analyzing the fact situation and planning strategy to preparing your final argument."--Publisher's website.

Book excerpt: Excerpt from A Treatise on the Law of Instructions to Juries in Civil and Criminal Cases, Vol. 1: With Forms of Instructions Approved by the Courts Out of the dim and distant past in juridical history there has come, and now abides with us, the Jury System, impregnably in trenched in constitutional guaranty. In civil actions, and in crim inal prosecutions, one of the greatest elements of the contest is involved in the inquiry, What are the Facts? The Wisdom of mankind has reached the definite and decisive conclusion that the determination of questions of fact rests, not with the jurist, but with a body of laymen, possessing no intimate knowledge of the' law, but endowed with the faculties and experience of the common and average man. This body, known as the common-law Jury, is intrusted with the task of sifting the truth from circumstances, the frailties of human memory, the passions and evil designs of factions, and the defects of understanding. This task is made the Function of the jury, _ and the law, in positive and certain terms, declares that that function shall not be invaded by the trial judge. But the Law of the Case is to be pronounced by the judge in Instructions, couched in plain and unambiguous terms. In these instructions the judge is required rigidly to refrain from expressing his own views as to the facts, from intimating to the jury the weight to be given to particular testimony, and from as suming the existence of facts not clearly admitted by both parties to the litigation. To accomplish this result the judge is required to resort to a most adroit and painstaking literary effort, and to. Produce a Charge which will withstand the assaults of counsel for the unsuccessful party in the appellate court. Available in PDF, EPUB and Kindle. Book excerpt: How are juries selected in the United States? What forces influence juries in making their decisions? Are some cases simply beyond the ability of juries to decide? How useful is the entire jury system? In this important and accessible book, a prominent expert on constitutional law examines these and other issues concerning the American jury system. Randolph N. Jonakait describes the historical and social pressures that have driven the development of the jury system; contrasts the American jury system to the legal process in other countries; reveals subtle changes in the popular view of juries; examines how the news media, movies, and books portray and even affect the system; and discusses the empirical data that show how juries actually operate and what influences their decisions. Jonakait endorses the jury system in both civil and criminal cases, spelling out the important social role juries play in legitimizing and affirming the American justice system.
