Book excerpt: This is a companion volume to The Law of Evidence in Nigeria (Aguada, 1974). It specifically reports Nigerian cases conducted under Nigerian jurisdiction and the principles of stare decisis in Nigerian jurisprudence, as opposed to cases under foreign jurisdiction, and therefore addresses a perceived imbalance in the documentation of decisions under Nigerian law of evidence as against foreign decisions. The work is organised under the following headings: preliminary matters; relevancy; proof; documents; production and effect of evidence; and witnesses. The author is a member of th Nigerian Court of Appeal and has written on many aspects of Nigerian law, particularly women's and human rights issues.

Available in PDF, EPUB and Kindle. Book excerpt: The Evidence Act, 2011, repealed the old Evidence Act. In doing so, the new Act introduced some changes in the Law of Evidence. Ever since, there has been an urgent need for scholastic guidance, in the proper approach to the interpretation of the provisions embodying those changes. This is particularly so, as the courts have been issuing contradictory interpretations of these provisions. In his new book, Law of Evidence in Nigeria: Practice and Procedure, the veteran author and urbane man of letters, Professor Simon Uchenna Ortuanya, masterfully plumbs the intention of the draft's persons of the Act. The result is a five-hundred-and-forty-page treatise of redoubtable erudition. The succinct titles of the different chapters are quite captivating just as the logical presentations of ideas are very illuminating. The book bears the imprints of the erudite author's versatility in the Law of Evidence - a course he has taught, admirably, in two public universities years.

Available in PDF, EPUB and Kindle. Book excerpt: Academic Paper from the year 2021 in the subject Law - Civil Action / Lawsuit Law, grade: 5.0, University of Lagos (Law), course: Law, language: English, abstract: This paper sets out to analyze the application of good and bad character evidence to criminal proceedings within the corpus of the Evidence Act, 2011. The term "character" has been defined by several legal writers and Judges for the purpose of determining its scope in the light of the law of evidence. The general consensus from the several definitions is that “character” is the general reputation as opposed to his disposition. Under the Nigerian Evidence Act 2011, the same definition was given pursuant to section 77 which defines the expression “character” to mean reputation as distinguished from disposition. It goes on to state that except as mentioned in sections 78 to 82, evidence may be given only of the general reputation, and not of the particular acts by which reputation or disposition is shown. Unlike in civil proceedings, the Evidence Act creates a distinction between bad and good character for the purpose of determining the admissibility of character evidence in criminal proceedings.

Book excerpt: In most jurisdictions, particularly common law jurisdictions, the Law of Evidence is a key component of the legal system as it sets the yardstick for regulating civil and criminal proceedings in courts of law. The annotation of the Evidence Act 2011 undertaken by The Nigerian Institute of Advanced Legal Studies (NIALS) is a welcomed development for researchers, academics, legal practitioners, judicial officers and the public as previous annotations of the Evidence Act were based on the Evidence Act, Cap E14 Laws of the Federation, 2004. This annotation provides current information on the decided cases and relevant publications on provisions of the Evidence Act. It is particularly unique as it deals with vital amendments of the Act such as the provisions on admissibility of electronic/computer generated evidence which for a long time formed the basis of several judicial proceedings.

Available in PDF, EPUB and Kindle. Book excerpt: The Law of Evidence in Ireland explores the development of a particular Irish dimension to evidence scholarship, grounded in the constitutional concept of fairness and influenced by the case law of the ECHR. The phenomenon and impact of the non jury Special Criminal Court are considered, as are legislative changes targeting organised crime and sexual offences, as well as developments facilitating forensic testing as part of criminal investigation and evidence, under the Criminal Justice (Forensic Evidence and DNA Database System) Act 2014. Now in its fourth edition, this text has been updated with new sections including: - A look at judicial consideration of fairness in the pre-trial process in light of a changing societal context and delivery on the accused's right to fair trial, as reflected in analysis of Supreme Court decisions such as JC and Dwyer - The developing concept of transnational fairness in facing the challenge of cooperation in combating crime and instruments such as the European Arrest Warrant reflected in cases such as Celmer - The changing approach of Irish courts to traditional rules including those relating to expert witness testimony, evidence of bad character and prior misconduct, as well as assertions of new headings of privilege The text is of interest to all those working in the Irish legal system, the criminal legal system in particular, as well as to policy makers and those studying more general issues related to matters of trial, adjudication and fact-finding in various contexts.
