Available in PDF, EPUB and Kindle. Book excerpt: This report is one of a series of reviews, commissioned by the Chancellor of the Exchequer, to accompany the pre-Budget report 2006 (to be published 6 December 2006, Cm. 6984, ISBN 0101698429). It sets out recommendations to reform the planning system in England in support of sustainable economic growth and prosperity, whilst securing delivery of wider objectives including promoting community involvement, supporting local democracy and enhancing the environment. Key issues identified include the need: to ensure the planning system is more responsive to the market whilst delivering sustainable development; to ensure the appropriate use of land and to better manage the growing demand for development land; to streamline the planning system to increase certainty, reduce complexity and costs; to enhance the speed and quality of local authority decision-making; and to improve the appeals system to reduce delays. Recommendations include: the introduction of a new system for dealing with major infrastructure projects, based around national Statements of Strategic Objectives, and with a new independent Planning Commission to determine applications; the promotion of a positive planning culture within the plan-led system so that applications should be approved unless there is good reason to believe that the environmental, social or economic costs will exceed respective benefits; encouraging planning bodies to review their green belt boundaries to promote sustainable new development beyond towns and cities; and removal of the need for minor commercial developments that have little wider impact to require planning permission.

Book excerpt: Land Tax in Australia demonstrates how land tax operates and is administered across State and local governments in Australia. International expert Vincent Mangioni reviews the current status and emerging trends in these taxes in Australia and compares them with the UK, USA, Canada, Denmark and New Zealand. Using substantial original research, the author sets out what Australia must do through practice and policy to reform and bring this tax into the 21st Century. The need for fiscal reform and strengthening the finances of Australia’s sub-national government is long overdue. These reforms aim to minimise the taxpayer revolts encountered in previous attempts at land tax reform, while improving tax effort in line with other advanced OECD countries. This book provides an essential resource for all property professionals working in development, valuation, law, investment, as well as accountants, tax economists and government administrators. It is highly recommended for students on property, taxation, legal and social science courses.

Book excerpt: Described as 'ground-breaking' in Kent McNeil's Foreword, this book develops an alternative approach to conventional Aboriginal title doctrine. It explains that aboriginal customary law can be a source of common law title to land in former British colonies, whether they were acquired by settlement or by conquest or cession from another colonising power. The doctrine of Common Law Aboriginal Customary Title provides a coherent approach to the source, content, proof and protection of Aboriginal land rights which overcomes problems arising from the law as currently understood and leads to more just results. The doctrine's applicability in Australia, Canada and South Africa is specifically demonstrated. While the jurisprudential underpinnings for the doctrine are consistent with fundamental common law principles, the author explains that the Australian High Court's decision in Mabo provides a broader basis for the doctrine: a broader basis which is consistent with a re-evaluation of case-law from former British colonies in Africa, as well as from the United States, New Zealand and Canada. In this context, the book proffers a reconceptualisation of the Crown's title to land in former colonies and a reassessment of conventional doctrines, including the doctrine of tenure and the doctrine of continuity. 'With rare exceptions ... the existing literature does not probe as deeply or question fundamental assumptions as thoroughly as Dr Secher does in her research. She goes to the root of the conceptual problems around the legal nature of Indigenous land rights and their vulnerability to extinguishment in the former colonial empire of the Crown. This book is a formidable contribution that I expect will be influential in shifting legal thinking on Indigenous land rights in progressive new directions.' Available in PDF, EPUB and Kindle. Book excerpt: Onshore unconventional gas operations, in most jurisdictions, operate on the legal principle that all activities during exploration and extraction are ‘temporary’ in nature. The concept that the onshore unconventional gas industry has a temporary effect on the land on which it operates creates a regulatory paradox. On one hand, unconventional gas activities create energy security, national wealth and a bourgeoning export industry. On the other, agricultural land and agriculturalists may be significantly disadvantaged by unconventional gas activities potentially producing permanent damage to non-renewable fertile soils and spoiling the underground water tables. Thus, threatening future food security and food sovereignty. This book explores the socio-regulatory dimensions of coexistence between agricultural and onshore unconventional gas land uses in the jurisdictions with the highest concentration of proven unconventional gas reserves – Australia, Canada, the USA, the UK, France, Poland and China. In exploring the differing regulatory standpoints of unconventional gas land uses on productive farming land in the chosen jurisdictions, this book provides an original three-part categorisation of regulatory approaches addressing the coexistence of agricultural land and unconventional gas namely: adaptive management, precautionary and, finally, statism. It offers a timely and topical approach to socio-legal natural resource governance theory based on the participation, transparency and empowerment for agricultural landholders, examining how differing frameworks such as the collective bargaining framework can create equitable and sustainable contractual arrangements with unconventional gas companies.

Book excerpt: Over the last decade the regulatory evaluation of environmental and public health risks has been one of the most legally controversial areas of contemporary government activity. Much of that debate has been understood as a conflict between those promoting 'scientific' approaches to risk evaluation and those promoting 'democratic' approaches. This characterization of disputes has ignored the central roles of public administration and law in technological risk evaluation. This is problematic because, as shown in this book, legal disputes over risk evaluation are disputes over administrative constitutionalism in that they are disputes over what role law should play in constituting and limiting the power of administrative risk regulators. This is shown by five case studies taken from five different legal cultures: an analysis of the bifurcated role of the Southwood Working Party in the UK BSE crisis; the development of doctrines in relation to judicial review of risk evaluation in the US in the 1970s; the interpretation of the precautionary principle by environmental courts and generalist tribunals carrying out merits review in Australia; the interpretation of the WTO Sanitary and Phytosanitary Agreement as part of the WTO dispute settlement process; and the interpretation of the precautionary principle in the EU context. A strong argument is thus made for re-orienting the focus of scholarship in this area.

Available in PDF, EPUB and Kindle. Book excerpt: Conflict over the extraction of coal and gas resources has rapidly escalated in communities throughout the world. Using an environmental justice lens, this multidisciplinary book explores cases of land use conflict through the lived experiences of communities grappling with such disputes. Drawing on theories of justice and fairness in environmental decision making, it demonstrates how such land use conflicts concerning resource use can become entrenched social problems, resistant to policy and legal intervention. The author presents three case studies from New South Wales in Australia and Pennsylvania in the US of conflict concerning coal, coal gas and shale gas development. It shows how conflict has escalated in each case, exploring access to justice in land use decision making processes from the perspective of the communities at the heart of these disputes. Weaknesses in contemporary policy and regulatory frameworks, including ineffective opportunities for public participation and a lack of community recognition in land use decision making processes, are explored. The book concludes with an examination of possible procedural and institutional reforms to improve access to environmental justice and better manage cases of land use conflict. Overall, the volume links the philosophies of environmental justice with rich case study findings, offering readers further insight into both the theory and practice of land use decision making.
