Book excerpt: The premise of this report is based on Kenya's policy blueprint, Vision 2030, which places rule of law at the center of its goals. It was commenced at the same time as the nation was recuperating from the post-election poll, which resulted in many Kenyans expressing disappointment at the nation's democratic institutions. The study, produced by AfriMAP and the Open Society Initiative for Eastern Africa, examines and makes recommendations for the following topics: justice sector and rule of law; legal and institutional framework; government track record in respect to rule of law; management of the justice system; independence of the bench and bar; criminal justice; access to justice; and the role of donor agencies.

Available in PDF, EPUB and Kindle. Book excerpt: The United Nations estimates that four billion people worldwide live outside the protection of the law. These people can be driven from their land, intimidated by violence, and excluded from society. This book is about community paralegals - sometimes called barefoot lawyers - who demystify law and empower people to advocate for themselves. These paralegals date back to 1950s South Africa and are active today in many countries, but their role has largely been ignored by researchers. Community Paralegals and the Pursuit of Justice is the first book on the subject. Focusing on paralegal movements in six countries, Vivek Maru, Varun Gauri, and their coauthors have collected rich, vivid stories of paralegals helping people to take on injustice, from domestic violence to unlawful mining to denial of wages. From these stories emerges evidence of what works and how. The insights in the book will be of immense value in the global fight for universal justice. This title is also available as Open Access.

Book excerpt: The golden thread that cuts across the various chapters of the book is the emphasis that good constitutions anchor certain tenets that have garnered recognition as hallmarks of democratic dispensation. These hallmarks include the concept of separation of powers; the doctrine of the rule of law; constitutionalism and human rights. These attributes have largely been secured by the 2010 Constitution. Thus, this book is expected to contribute to this new promise by making knowledge on the Constitution accessible through breaking down and contextualising its provisions. It is certain to be useful to law and government students, lawyers, researchers and other persons who seek to understand the new constitutional order.

This book was released on 2020-06-15 with total page 32 pages. Available in PDF, EPUB and Kindle. Book excerpt: Essay from the year 2018 in the subject Law - Comparative Legal Systems, Comparative Law, , language: English, abstract: This paper discusses the Kenyan constitutional and legal framework for the enforcement of county laws. It exposes the inadequacy of the legal and institutional framework as the root of all other challenges experienced in the enforcement of county laws in Kenya. These challenges include lack of capacity for the enforcement of county laws by the counties, corruption menace, lack of a uniform code of conduct for county askaris, the novelty of devolution to county askaris and the general public and the lack of county courts to resolve disputes involving counties and enforce county laws. Proposals for addressing these challenges are given stressing on the need to enact legislation to provide for the legal and institutional framework for the enforcement of county laws in Kenya. This is important because one of the ways through which the objects of devolution can be achieved in Kenya is through the effective and efficient enforcement of county laws and regulations. Kenya adopted a new Constitution on 27th August 2010 with devolution1 being one of its most transformative aspects. Devolution was a good solution to the problems of marginalization, inadequate service delivery and regional disparities in development which was associated with the highly centralized system of government. With devolution, two levels of government were created: national and county governments.

Download or read book Modern Law of Criminal Procedure in Kenya written by Munyao Sila and published by Partridge Africa. This book was released on 2014-10-25 with total page 418 pages. Available in PDF, EPUB and Kindle. Book excerpt: The law on criminal procedure in Kenya has tremendously changed after the Constitution of Kenya of 2010. New institutions with an impact on the criminal process such as the National Police Service, the Office of the Director of Public Prosecutions, and the Supreme Court were created. Certain rights that were hitherto unavailable were entrenched in the constitution, including the right to bail irrespective of the offence and the right to legal representation. The superior courts have had a busy time in the interpretation of the current law, and groundbreaking jurisprudence has emerged. There is no doubt that the study of criminal procedure has significantly changed. This book covers all important aspects of criminal procedure, taking into consideration the changes brought about by the Constitution of 2010. It fills a void created by the lack of updated texts on the law of criminal procedure. It utilizes simple, easy-to-understand language and makes reference to both local and international case law. This book will prove to be an invaluable companion to students of criminal procedure, legal practitioners, researchers, and the general public.
