Challenging the dominant view that women were victimized by the Japanese family laws and its patriarchal biases, Sungyun Lim argues that Korean women had to struggle equally against Korean patriarchal interests. Moreover, women were not passive victims; instead, they proactively struggled to expand their rights by participating in the Japanese colonial legal system. In turn, the Japanese doctrine of promoting progressive legal rights would prove advantageous to them. Following female plaintiffs and their civil disputes from the precolonial Choson dynasty through colonial times and into postcolonial reforms, this book presents a new and groundbreaking story about Korean women’s legal struggles, revealing their surprising collaborative relationship with the colonial state.

Determined by the Civil Code and the Koseki Law, for activists challenging it, the koseki is also an ideological structure, which has produced patriarchal control through single-surname households. Based on ethnographic fieldwork in Tokyo, this book engages with issues of gender hierarchy and structural inequality in Japanese society. Studying several decades of feminist activism and critique of the koseki system, it analyses the strategies of activists who have creatively circumvented koseki rules in order to maintain their natal names in marriage. It examines the case studies of members of the fūfubessei (separate surname movement) and the movement to end discrimination against children born out of wedlock, and in so doing this book illuminates the contradictions in current family law and koseki practice that have animated a generation of feminists in Japan. Focusing on the stem family and the gender division of labor, presenting detailed quantitative evidence, and testing the theories on family change and gender revolution, the book provides a comprehensive examination of change, continuity, and regionality in the Japanese family system over the twentieth century. By analyzing data from a nationally representative life course survey with event history techniques, it investigates factors affecting post-marital intergenerational co-residence and proximate residence along with those influencing continuous and/or discontinuous employment of married women across the life course. In this way, it reveals the mechanisms underlying the stem family formation and those behind married women’s M-shaped employment pattern. It further explores regionality in the Japanese family system, applying a demographic mapping method to data from a nationally representative community survey and official statistics. The mapping analyses demonstrate persistent geographical contrasts between two types of living arrangements (single-household versus multi-household) in the stem family accompanied by two types of maternal employment (full-time versus part-time). They also reveal a historical correlation between traditional communal parenting systems and modern childcare services, linking past to present from the late nineteenth to the early twenty-first century.
