Book excerpt: Article 11 in the Treaty on the Function of the European Union (TFEU) sets out that: 'Environmental protection requirements must be integrated into the definition and implementation of the Union policies and activities, in particular with a view to promoting sustainable development.' The environmental integration that this rule mandates for the EU is arguably a necessary contribution to achieve policy coherence for sustainable development, or sustainability - as it currently often denoted. However, the mere existence of this provision is clearly not sufficient to achieve the environmental integration in all EU policies and activities, let alone policy coherence to facilitate global sustainability. For the duty of environmental integration to make a significant contribution to achieving such policy coherence, the environmental integration must have a clearly defined goal. Including environmental concerns at some level or other, an attempted 'greening' of European policies, is insufficient. Article 11 TFEU sets out the goal as one of 'promoting sustainable development'. This goal must be defined in light of natural science. This is necessary to mitigate the problem of sustainability being an extremely overused and broad concept with multiple definitions, and to reduce the danger of regulatory and policy capture. The reference to natural science is not to say that sustainability only has an environmental dimension; it clearly does not. However, the environmental literally must set the framework within which the balancing sustainability requires must take place. This chapter draws on state-of-the-art natural science on planetary boundaries to flesh out what this means. Thereafter the chapter discusses the potential transformational effect of Article 11 TFEU through the duties it arguably sets out for the EU institutions and the rights, and emerging duties, for the EU Member States. The full realization of this potential could lead to cross-sectorial discussions on necessary changes to achieve policy coherence for sustainability. The chapter concludes with some reflections on how to realise the potential.

In the context of this policy, the Community adopted measures that were designed to control environmental pollution caused by, for example, intensive farming, road transport and power generation from fossil fuels. In the context of its other policies, the Community has at the same time encouraged or contributed to the development of, for example, large agricultural holdings, major road transport networks and the liberalisation of the internal electricity market. It could be argued that such Community action is inconsistent with Community action in the environmental field. Data does in fact show that other Community measures undermine the effectiveness of the Community environmental measures. Article 6 of the EC stipulates that environmental protection requirements must be integrated into other Community policies and activities. This book examines the extent to which, if at all, this Treaty provision requires the Community policy maker to adjust policies so as to ensure that they are more compatible or even supportive of EC environmental policy. It analyses both theory (what should be) and practice (what is) of what has often been referred to as the 'integration principle'. This book, the second in the Avosetta Series, provides useful insights for both practicing and academic lawyers, especially those interested in environmental, agricultural, transport and energy issues. In addition, it should be observed that the book contains specific suggestions for the Community policy maker and, indirectly, for national administrations in the EU. About the author: Nele Dhondt was born in Oudenaarde (Belgium) in 1973. She graduated in law from the University of Ghent in 1996. The following year, she was awarded a Master of Laws (LL.M) in international law at the University of London. She has worked for the European Commission (DG Competition) in Brussels as an intern. As a result environmental concerns must also be integrated into Community competition law and policy. Taking Article 6 EC as a starting point, this book begins with the construction of a model of integration. This model requires that environmental concerns are awarded a role that will ultimately result in the internalisation of environmental concerns and therefore lead to a mutually reinforcing relation between competition and environmental protection. After an examination of Articles 81, 82, 86 and 87 of the EC Treaty, the useful effect doctrine (Article 10 in connection with 81 EC) and the Merger Regulation as well as the application of these competition rules in cases that involve environmental protection concerns, some conclusions are drawn with regard to the integration of environmental protection requirements and EC competition law. These conclusions are followed by a comparative legal research in which their validity is tested. On the basis of these findings it is concluded that the model of integration is being applied in parts of EC competition law. In those areas, competition policy towards environmental restrictions of competition actually increases the chances of a competition for the environment coming about. This, it is submitted, is an important step in the direction of achieving sustainable development. About the author: Hans Vedder (1974) graduated from the University of Groningen in 1997. From 1998 to 2001 he worked as a researcher at the Centre for Environmental Law of the University of Amsterdam. Since 2001 he is lecturer in European law at the University of Groningen. He has published several articles and chapters in books on various aspects of competition and environmental law.
