Available in PDF, EPUB and Kindle. Book excerpt: After more than a decade of British membership of the European Community, there is still a widespread lack of appreciation of what goes on within the Community institutions, and of its significance for UK political and legal processes. This book aims to provide a concise introduction to the institutions and law-making processes of the Community, and to set them im their proper perspective as part of UK public law. The prime focus is upon the Community institutions and their inter-relations, however, reference is also made as appropriate to the effects which Community decision-making has on Westminster and Whitehall and in the English courts. In particular, the book examines the sources of Community law, the organisation and composition of the main institutions after the accession of Portugal and Spain, and the decision-making processes involved in the enactment of the Community's legislation. There are also chapters on the budgetary process and on the role of the European Court of Justice. Despite the UK emphasis some comparative material is used to put the UK approach into perspective. To enhance its value to readers cominig to the subject for the first time, the book also contains the text of selected articles of the Treaty of Rome.

Book excerpt: In this book - intended for everyone interested in EU decision making - two main research questions will be answered. Firstly, what is the relationship between the European Council and the other EU institutions? Secondly, what are the various roles of the European Council in the EU decision-making process? The results of this research will show that European Council conclusions have been used extensively in this decision-making process, and this has increased considerably over time. Based on the analysis of European Council conclusions and legal texts a typology is created to provide an orderly picture of the European Council's various roles, such as the European Council as a political initiator, as an interpreter of the Treaties and as an appeals council.

Book excerpt: The Law of the European Union is a complete reference work on all aspects of the law of the European Union, including the institutional framework, the Internal Market, Economic and Monetary Union and external policy and action. Completely revised and updated, with many newly written chapters, this fifth edition of the most thorough resource in its field provides the most comprehensive and systematic account available of the law of the European Union (EU). Written by a new team of experts in their respective areas of European law, its coverage incorporates and embraces many current, controversial, and emerging issues and provides detailed attention to historical development and legislative history of EU law. Topics that are constantly debated in European legal analysis and practice are touched on in ways that are both fundamental and enlightening, including the following: .powers and functions of the EU law institutions and relationship among them; .the principles of equality, loyalty, subsidiarity, and proportionality; .free movement of persons, goods, services, and capital; .mechanisms of constitutional change – treaty revisions, accession treaties, withdrawal agreements; .budgetary principles and procedures; .State aid rules; .effect of Union law in national legal systems; .coexistence of EU, European Convention of Human Rights (ECHR), and national fundamental rights law; .migration and asylum law; .liability of Member States for damage suffered by individuals; .competition law – cartels, abuse of dominant position, merger control; .social policy, equal pay, and equal treatment; .environmental policy, consumer protection, public health, cultural policy, education, and tourism; .nature of EU citizenship, its acquisition, and loss; and .law and policy of the EU’s external relations. The fifth edition embraces many new, ongoing, and emerging European legal issues. As in the previous editions, the presentation is notable for its attention to how the law relates to economic and political realities and how the various policy areas interact with each other and with the institutional framework. The many practitioners and scholars who have relied on the predecessors of this definitive work for years will welcome this extensively revised and updated edition. Those coming to the field for the first time will instantly recognize that they are in the presence of a masterwork that can always be turned to with profit and that helps in understanding the rationale underlying any EU law provision or principle.

Available in PDF, EPUB and Kindle. Book excerpt: The policies of the European Union profoundly affect the lives of people in Europe and around the world. The new edition of this highly successful textbook outlines how and why such decisions are made, as well as the key challenges faced by policy-makers in the current political and economic climate. Policy-Making in the European Union begins by clarifying the institutional framework of the EU and the analytical approaches used to understand it. A wide range of crucial and illustrative policies are then explored in detail by subject experts. This volume includes new chapters on ways of analyzing the EU's policy process and on energy policy. A central theme to the volume is how the recent expansion to twenty-seven member states has affected policy-making across the different policy sectors. The conclusion reflects on how this challenge and the protracted constitutional stalemate have affected policy-making in the EU. It also explores the impact of the financial and economic crises that have struck Europe over the past several years. The sixth edition is fully up-to-date, and is the ideal text for all those with an interest in the policy-making of the European Union.

Book excerpt: Moves towards democracy in Eastern Europe and the new world order debates have launched the EC into a new stage in its evolution, and are testing the strength of the Community on the eve of the Single European Market. Arguments within the EC, on issues of national sovereignty, monetary union, and Germany's role, are likely to continue, but contradict the EC's desire to show itself an effective force in world politics. In the midst of the polemic and rhetoric, it is easy to lose sight of the EC's original aims and the extent to which they may be seen to have succeeded or failed. This text covers all aspects of the EC, including its historical development since the Second World War, its institutional framework, its main policy initiatives (agricultural, economic, regional, social, environmental and foreign) and its relations with the rest of the world. A concluding chapter assesses the prospects for its development during the 1990s.

Book excerpt: Seminar paper from the year 2010 in the subject Politics - International Politics - Topic: European Union, University of Flensburg, course: Course "European Governance", language: English, abstract: The concepts of governance have the advantage of including the informal aspect of decision-making into their scope of analysis. The intention of this paper is the application of a fitting conceptual derivative of governance on the decision making process inside the institutional framework of the Commission of the European Union. The notion to be tested is the one of the Commission being by its institutional heritage inclined to promulgation of consensus among its principal actors, the members of the college of Commissioners. So what kind of governance might be characteristic for the Commission? The political setting is that of the European Union, which is on the one hand an intergovernmental organization of member states on equal terms, but on the other hand a political institution. Apart from partly being established on a supra-national echelon, which is rationally designed and controlled for the purpose action and intervention to foster economic prosperity and integration in accordance with the concepts of functional and rational-choice institutionalism characteristic for social and political institutions of modernity. As the EU is itself an extension of the mostly politically pluralistic and socially fragmented Member States (MS), certain elements and processes influencing the promulgation of the political will on all legislative governmental echelons are present in the context of governance in the European Union as well. The hypothesis of this paper consists of the following notions: Due to the "sui generis"-character the EU,1 employing decisions by consensus even on intergovernmental as well as on supranational level is most effective politics possible. Applying concepts of governance to the Commission‟s competences, institutional framework and formal as well as, i

Book excerpt: The European Union and Global Governance: A Handbook aims to analyse contemporary debates in European Studies in order to provide lessons for the development, design and normative evaluation of global governance. It brings together scholars of European studies and international relations, where much of the literature on regional and global governance is located, thereby providing interdisciplinary lessons from the study of European Union and its governance that can be used to re-evaluate processes of global governance. Each chapter examines methodological, theoretical or empirical discussions within European studies in order to draw insights for current developments in global governance.
