Book excerpt: After regulating Greenhouse Gas emissions from air transport, the European Union is now contemplating taking action on emissions from the shipping sector. In order to do so, the European Commission carried out a public consultation process between January and April 2012. This article analyses the legal problems that would arise, in the light of Public International Law, should the European Union decide to follow the path of aviation and include shipping under the European Emission Trading Scheme (ETS). To do so, the focus will be placed on six different normative bodies of international law: (1) the United Nations Framework Convention on Climate Change and the Kyoto Protocol;(2) the MARPOL Convention; (3) the United Nations Convention on the Law of the Sea; (4) the General Agreement on Tariffs and Trade and the General Agreement on Trade of Services; (5) the principle of sovereignty over maritime areas; and (6) the bilateral agreements ratified by the EU containing clauses on maritime transport. The structure of each of the six normative bodies will be as follows: international commitments under each international norm, possibility of enforcement before tribunals and analysis of the legality of the EU measure in relation to that norm.

This occurred only one year after the Commission had heralded the emissions reduction agreement negotiated in the International Maritime Organization (IMO) as a significant step forward - thereby signalling support for the IMO process. We apply a multi-level reinforcement perspective to explain this apparent policy volte-face, resulting in a Commission proposal in July 2021 which is now moving through institutions in the EU. Such a perspective notes the "friendly" competition for leadership among central actors at various levels in the EU - particularly the Commission, the European Parliament, and leading member states. While such trading has seen popularity in recent years, the broad concept has been around for quite some time. In 1968, Canadian economist John Dales argued that a government should issue a certain number of pollution rights certificates and offer them for sale, while at the same time enacting a law mandating anyone discharging a certain amount of waste in a given year to own one or more pollution rights for the whole year. He further argued that this framework would benefit by having the price determined by competition between buyers and sellers of rights rather than a person or authority.4 The fundamental idea behind emissions trading has remained the same to this day. At the end of the 1960s, the United States of America were the first to experiment with governmental trading schemes.5,6,7 During the Carter administration, the US Environmental Protection Agency (EPA) continued to expand these pollution control mechanisms, notably using them to reduce and ultimately stop the use of leaded petrol in the 1980s.8 Emissions trading schemes continued to be popular in the US and were used by the following administrations.

The decision of the International Maritime Organization (IMO) in April 2018 to adopt an Initial Strategy so as to achieve by 2050 a reduction of at least 50% in maritime greenhouse gas (GHG) emissions vis-à-vis 2008 levels epitomizes the last among a series of recent developments as regards sustainable shipping. It also sets the scene on what may happen in the future. Even though many experts and industry circles believe that the IMO decision is in line with the COP21 climate change agreement in Paris in 2015, others disagree, either on the ground that the target is not ambitious enough, or on the ground that no clear pathway to reach the target is currently visible. This book takes a cross-disciplinary view of the various dimensions of the maritime transportation sustainability problem. “Cross-disciplinary” means that a variety of angles are used to examine the book topics, and these mainly include the technological angle, the economics angle, the logistics angle, and the environmental angle. The book reviews models that can be used to evaluate decisions, policy alternatives and trade-offs. For sustainable shipping, a spectrum of technical, logistics-based and market based measures are being contemplated.
