Over the past decade, legal challenges have arisen in the Global South over patents on genetically modified crops. In this ethnographic study, Karine E. Peschard explores the effects of these disputes on people’s lives, while uncovering the role of power—material, institutional, and discursive—in shaping laws and legal systems. The expansion of corporate intellectual property (IP), she shows, negatively impacts farmers’ rights and, by extension, the right to food, since small farms produce the bulk of food for domestic consumption. Peschard sees emerging a new legal common sense concerning the patentability of plant-related inventions, as well as a balance among IP, farmers’ rights, and the public interest. Peschard examines the strengthening of IP regimes for plant varieties, the consolidation of the global biotech industry, the erosion of agrobiodiversity, and farmers’ dispossession. She shows how litigants question the legality of patents and private IP systems implemented by Monsanto for royalties on three genetically modified crop varieties, Roundup Ready soybean in Brazil and Bt cotton and Bt eggplant in India. Peschard argues that these private IP systems have rendered moot domestic legislation on plant variety protection and farmers’ rights. This unprecedented level of corporate concentration in such a vital sector raises concerns over the erosion of agricultural biodiversity, farmers’ rights and livelihoods, food security, and, ultimately, the merits of extending IP rights to higher life forms such as plants.

Of these institutions, however, land is central, whether in internal migration, international migration, or global migration. Historically or currently, the evidence also clearly shows that migration and migrants transform both the sites where migrants are resident and the places from which migrants travelled. The change is more transformational than previous accounts have established, sometimes involving turning around dead cities and towns into vibrant local economies and reconstructing food networks for entire regions and nations. This book also raises serious analytical questions about three bodies of literature: mainstream economic accounts of migration, environment, and inequality; mainstream sustainability science and alternatives to it (e.g. ecological economics); and conservative and nativist claims about population problems and alternatives to them centred only on the freedom that a borderless world could create. Obeng-Odoom argues that much of the crisis of migration and sustainability can be understood as a reflection of global long-term inequalities and cumulative stratification, reflected at different scales in the global system, though the form of migration is conditioned by more than economic forces. The so-called migration crisis, therefore, seems quite routine and familiar. It is an outward expression of the political-economic system in which socially created value is privately appropriated as rents by a privileged few who use institutions such land and property rights, race, ethnicity, class, and gender to keep others in their place in the global economic and stratification ladder"--

She finds that many of these new farmers rely on farming practices from their home countries—including growing multiple crops simultaneously, using integrated pest management, maintaining small-scale production, and employing family labor—most of which are considered alternative farming techniques in the United States. Drawing on extensive interviews with farmers and organizers, Minkoff-Zern describes the social, economic, and political barriers immigrant farmers must overcome, from navigating USDA bureaucracy to racialized exclusion from opportunities. She discusses, among other topics, the history of discrimination against farm laborers in the United States; the invisibility of Latino/a farmers to government and universities; new farmers' sense of agrarian and racial identity; and the future of the agrarian class system. Minkoff-Zern argues that immigrant farmers, with their knowledge and experience of alternative farming practices, are—despite a range of challenges—actively and substantially contributing to the movement for an ecological and sustainable food system. Scholars and food activists should take notice.
