This book examines the link between climate change and human rights in a comprehensive manner. It looks at human rights approaches to climate change, including the jurisprudential bases for human rights and the environment, the theoretical framework governing human rights and the environment, and the different approaches to this including benchmarks. In addition to a discussion of human rights implications of international environmental law principles in the climate change regime, the book explores how the human rights framework can be used in relation to mitigation, adaption, and adjudication. Other chapters examine how vulnerable groups –women, indigenous peoples and climate "refugees" – would be disproportionately affected by climate change. The book then goes on to discuss a new category of people created by climate change, those who will be rendered stateless as a result of states disappearing and displaced by climate change, and whether human rights law can adequately address these emerging issues.

Both Technology Transfer and the Clean Development Mechanism are seemingly associated with human rights implications. Therefore, this paper will analyse the current state-of-the-art with regard to Technology Transfer and the Clean Development Mechanism in their interplay with human rights standards, and as based on relevant provisions of the Kyoto Protocol and of the EU legislation. In order to proffer solutions, this paper will assess the shortcomings of Technology Transfer and then explain the current actions that are implemented under the UNFCC to stimulate Technology Transfer and the CDM as strategies for climate change mitigation. In light of this goal, a human rights-based approach in terms of climate change mitigation strategies and its relevance will be explored.

By focusing on the impacts of climate change on the rights of individuals, communities, and peoples, a human rights lens emphasizes the human dimensions of climate change, recognizes how forms of systemic discrimination engender and exacerbate vulnerability, and focuses attention on the implications of social and environmental justice for climate governance. Moreover, states and private actors' human rights obligations and responsibilities have specific implications in relation to climate change. State and non-state actors are not only obliged to take effective mitigation and adaptation measures that respect, protect, and fulfil human rights, but they must also ensure that these measures do not in of themselves infringe human rights. Finally, rights-based approaches emphasize the importance of public participation, access to information, and access to justice in the development, implementation, and review of climate decisions. Despite its promise, the transformative potential of rights-based approaches for addressing climate change and delivering climate justice remains unrealized.

Book excerpt: In December 2015, 196 parties to the United Nations Framework Convention on Climate Change (UNFCCC) adopted the Paris Agreement, seen as a decisive landmark for global action to stop human- induced climate change. The Paris Agreement will replace the 1997 Kyoto Protocol which expires in 2020, and it creates legally binding obligations on the parties, based on their own bottom-up voluntary commitments to implement Nationally Determined Contributions (NDCs). The codification of the climate change regime has advanced well, but the implementation of it remains uncertain. This book focuses on the implementation prospects of the Agreement, which is a challenge for all and will require a fully comprehensive burden- sharing framework. Parties need to meet their own NDCs, but also to finance and transfer technology to others who do not have enough. How equity- based and facilitative the process will be, is of crucial importance. The volume examines a broad range of issues including the lessons that can be learnt from the implementation of previous environmental legal regimes, climate policies at national and sub-national levels and whether the implementation mechanisms in the Paris Agreement are likely to be sufficient.
