Book excerpt: The Government referred proposals concerning the draft Social Security (Flexible New Deal) Regulations 2009 to the Social Security Advisory Committee (SSAC) on 1 October 2008. These regulations will implement the Government's proposals to introduce an enhanced regime for those claiming Jobseeker's Allowance (JSA). This will include implementing the Flexible New Deal (FND) as a new employment programme for those who claim the benefit for a year, or after six months for those assessed as having greatest need of help to find work. The Committee's report gives broad support to elements of the revised Jobseekers Regime and the Flexible New Deal, but also expresses a number of concerns about the proposals, and makes eight recommendations. These fall under four broad headings: the extension of conditionality; the speed of the rollout of the full programme; the contracting out of services; and the changed economic situation. The Government sets out its response to the Committee's concerns, and has decided to proceed with the proposals as laid out in the Regulations originally referred to the Committee on 1 October 2008.

Book excerpt: Approximately half of the total UK population are in receipt of one or more welfare benefits, giving rise to the largest single area of government expenditure. The law and structures of social security are highly complex, made more so by constant adjustments as government pursues its often conflicting economic, political and social policy objectives. This complexity is highly problematic. It contributes to errors in decision-making and to increased administrative costs and is seen as disempowering for citizens, thereby weakening enjoyment of a key social right. Current and previous administrations have committed to simplifying the benefits system. It is a specific objective of the Welfare Reform Act 2012, which provides for the introduction of Universal Credit in place of diverse benefits. However, it is unclear whether the reformed system will be either less complex legally or more accessible for citizens. This book seeks to explain how and why complexity in the modern welfare system has grown; to identify the different ways in which legal and associated administrative arrangements are classifiable as 'complex'; to discuss the effects of complexity on the system's administration and its wider implications for rights and the citizen-state relationship; and to consider the role that law can play in the simplification of schemes of welfare. While primarily focused on the UK welfare system it also provides analysis of relevant policies and experience in various other states.

In doing so, the book emphasises three main ways in which administrative law's anatomy is both complex and diverse, namely: - administrative law doctrine interacts with a broad array of legislative frameworks; - administrative law adjudication seeks to accommodate a variety of legal values; and, - administrative law is concerned with legal relationships of different kinds. The second aim is to illustrate the importance of recognising the complexity and variety of administrative law's anatomy in three particular doctrinal contexts: procedural review, legitimate expectations and standing. The third and final aim is to raise an important but under-explored question: is it plausible and useful to attempt to make sense of administrative law doctrine by reference to a singular organising concept or principle? The overarching message of the book is one of cynicism. The complexity and variety of administrative law's legal structures probably means that attempts to explain the field 'monistically', while they may capture important themes, will be unhelpfully reductionist. But some customers do just enough to meet the conditions of their claim while at the same time continually failing to demonstrate the focus and discipline that is a key requirement of finding, securing and retaining employment. Mandatory Work Activity is being introduced to enable advisers to address this problem, supporting this particular group of customers at the earliest possible stage. But the Committee finds that published evidence is at best ambivalent about the chances of such 'workfare' type activity improving outcomes for people who are out of work. It is worried about the precedent set by appearing to punish claimants who are satisfying the conditionality rules (otherwise they would be subject to a sanction) but who, in the view of a Personal Adviser appear to display what is deemed to be the 'wrong attitude'. The Committee's key recommendation is that the introduction of this scheme should not continue. Its concerns cover the general principles of the proposals; the way participants will be selected; how placements will be structured and monitored; and the sanction regime attached. The Government, however, does not accept the Committee's recommendations or suggestion that the scheme is a punishment, and sets out its reasons for its position. The proposals are to go ahead.
