Book excerpt: Excerpt from The Herrin Conspiracy IN a wooded grove midway between the mining towns of Herrin and Marion in Williamson County, a crime was committed on the morning of Thursday, June 22, that stirred the indignation and aroused the horror of America as had not been done since the stories of war atrocities committed by the Huns ceased coming across the ocean. Five men are upon trial following indictment by a special grand jury in this county charging the murder of one Howard Hoffman. The crime of murder involves various elements, proof of all of which by the prosecution is required. All killings are not murder. Killings of human beings are called by the law homi cides. The killing of a human being may be excusable, it may be justifiable. The elements which make the killing of a human being murder are: (1) The killing must be unlawful; (2) It must be felonious; (3) It must have been done with malice aforethought; (4) A human being must have been killed who was then in the Peace of the People. The burden of establishing all these elements rests upon the state in this case. If all or any of these elements are missing the crime of murder is not established. Book excerpt: Excerpt from The Conspiracy There are some queer fish in New York, queer human fish that swim and wriggle in the great pool of life that spreads from shore to shore of Manhattan. They come seldom to the surface, and When they do it is only to blink and dive beneath again to seek their own familiar haunts. They are a school by themselves, these queer fish; book-worms, savants, inventors, philosophers, SO buried in their own thoughts and pursuits that they neither know nor see how time and progress gradually change them, at least in outward appearance, into veritable specimens for museums. Book excerpt: Excerpt from When It Was Dark: The Story of a Great Conspiracy The clerk, a small, rotund man, clerical in aspect, and wearing a round t'elt hat, pulled out a large old-fashioned watch. Time for the bell, William, he said. The parish church was a large building in sham Perpendicular. It stood in a very central position in the Manchester main road, rising amid a bare triangle of flat gravestones, and only separated from the street pavement by high iron railings. It was about half-past four on a dull autumn afternoon. The trams swung ringing down the black, muddy road, and the long procession of great two-wheeled carts, painted vermilion, carried coal from the collieries six miles away to the great mills and factories of Salford. Book excerpt: Excerpt from The Gowrie Conspiracy and Its Official Narrative Writers, as from the special opportunities they had of giving an independent opinion on a subject they had studied with profound interest. I am not prepared to question the conclusions at which they have arrived, for I think these, when the whole case has been put under review and every available document scrutinised, are well founded. There are some curious things connected with this event. For example, we are met at the threshold by the absolute want of a Ruthven narrative and the consequent difficulty of estimating the value of that published by the King. On this hangs the whole question. The execution of the plot showed that it was deliberately planned, although all trace of negotiations has been withheld and absolutely nothing dis closed. That Gowrie conspired against the King and was the head of the conspiracy the official narrative tries to make clear; but it is not well put together. It is rather a clumsy piece of composition, and its special pleading Condemns it. Take for example the scene in. Book excerpt: Excerpt from The Development of the English Law of Conspiracy The following pages contain the results of a study of the English law relating to criminal conspiracy, begun in the spring of 1906, and continued with little interruption until May, 1908. The author's purpose has been to present an exhaustive discussion of the subject based upon an examination of all the available material extant. Accordingly, he has considered every relevant statute and case, from the earliest to the latest, which a careful search through ancient and modern law writings has enabled him to bring to light. There is scarcely a more complex topic in the entire domain of British national jurisprudence than that of illegal combinations. The law relating to them has been more than ordinarily the creature of accident and special conditions. The resultant contradiction and confusion introduced into the cases renders extremely difficult the task of extracting the underlying principles, tracing their rise and growth, and giving an intelligible account of the causes which have determined their subsequent history. The author desires to acknowledge his indebtedness to Professor W. W. Willoughby for the inspiration which made the work possible, as well as for his helpful suggestions and unfailing friendly interest. Book excerpt: Excerpt from A Social Conspiracy, or Under the Ban: A Novel In a grandeur-vaunted city, Where the water giant glides Like a belt of burnished silver Through a gorge in its rocky sides, Where the pictured hills and valleys Dotted are with palace homes, The blue arch of heaven bending Down to meet her climbing domes, Named for a saint in glory, Worshipping a golden god, Cluster, 'mong her oak trees hoary, Castles proud to gem her sod. Tapering towers throng her air-lofts, Shimmering like swords of fire Brandished by cohorts of churches Challenging high heaven's ire! Pity, O Christ, the mock worship Breathed in Thy consecrate aisles, With Love and Charity banished, And hatred dressed up in their smiles. The earth lay like a flower garden, 'neath her June tent of unclouded blue. The sun, midway on its descent, threw slant bars of gold along the deep river banks, flooding the low, projecting wharves with sheets of splendor. Upon one of these deserted berths, seemingly afloat, so nearly parallel was it to the water's surface, two little girls were playing. Book excerpt: Excerpt from Hone's Interesting History of the Memorable Blood Conspiracy A right Reverend Prelate once informed the good people of this country, that they had nothing to do with the laws but.to obey them; and many genteel persons are so favourable to the doctrine, that they are scandalised at every expression of honest indignation excited by some notable proof of their impolicy, partiality, or in. Justice. The indulgence claimed for the laws, too, must be ex tended to their administrators; and we are gravely called upon, not only to make the usual allowances for human infirmity, but abso Iutely to forego that vigilance and exposure Of abuses, without which laws would soon become the mere discretion of the magistracy. Now; with all due respect to the powers that be, it may be con tended that almost every improvement, both in theory and practice, has originated in this country from extra-official interference and that public opinion, freely but decently expressed, is as essen tial to the regulation of the magistrate as the criminal. All the world knows what implicit confidence engenders in this respect, and how round and voluble the exclamation of Ali's well is xc echoed from one worshipful quarter to another, until humane and public-spirited individuals penetrate into the painted sepulchre, and draw forth the rottenness and bones. Away, then, with this trust and this apathy, which cannot be afforded to any body of men. If an administrator of criminal law be seen presiding over a case of life and death with the Spirit of a rat-catcher, acting as counsel, nay as a friend, to the prosecutors; and if, disregarding the light and shade of circumstance, a human being should be hurried out of the world whose guilt is more than doubtful, let not respectable persons stifle their genuine feelings, and exclaim It is a sad thing, to be sure; but the individual is hanged now, and if we meddle it will only unsettle the minds of the lower orders. Lower orders -it would be difficult to discover an order lower than that which contains minds to whom such abuses are indii ferent.
