Book excerpt: Excerpt from The Heart of Blackstone: Or Principles of the Common Law The design and object of the laws is to ascertain what is just, honorable, and expedient; and when that is discovered, it is proclaimed as a general ordinance, equal and impartial to all. This is the origin of law, which, for various reasons, all are under an obligation to obey: but especially because all law is the invention and gift of Heaven, the sentiment of wise men, the correction of every offense, and the general compact of the state: to live in conformity with which is the duty of every individual in society. - Demosthenes. History informs us that the boys of ancient India were required to learn the civil and criminal laws of their country that they might be more able to understand and apply them when they became men. The laws of Athens were inscribed on wooden tablets set up in the public square, where all citizens could read them. The laws of ancient Rome were condensed into a simple form known as the Twelve Tables, which the small boys were obliged to commit to memory, that the significance of their principles might be indelibly impressed upon mind and heart. The "Great Law" enacted by the first General Assembly of Pennsylvania, in the year 1682, contained a provision requiring it to be taught in the schools of that province and its territories. Book excerpt: Scholars have long debated the meaning of the pursuit of happiness, yet have tended to define it narrowly, focusing on a single intellectual tradition, and on the use of the term within a single text, the Declaration of Independence. In this insightful volume, Carli Conklin considers the pursuit of happiness across a variety of intellectual traditions, and explores its usage in two key legal texts of the Founding Era, the Declaration and William Blackstone’s Commentaries on the Laws of England. For Blackstone, the pursuit of happiness was a science of jurisprudence, by which his students could know, and then rightly apply, the first principles of the Common Law. For the founders, the pursuit of happiness was the individual right to pursue a life lived in harmony with the law of nature and a public duty to govern in accordance with that law. Both applications suggest we consider anew how the phrase, and its underlying legal philosophies, were understood in the founding era. With this work, Conklin makes important contributions to the fields of early American intellectual and legal history.

Available in PDF, EPUB and Kindle. Book excerpt: In this updated and expanded edition of The Tyranny of Good Intentions, Paul Craig Roberts and Lawrence M. Stratton renew their valiant campaign to reclaim that which is rightly ours–liberty protected by the rule of law. They show how crusading legislators and unfair prosecutors are remaking American law into a weapon wielded by the government and how the erosion of the legal principles we hold dear–such as habeas corpus and the prohibition against self-incrimination–is destroying the presumption of innocence. A new introduction and new chapters cover recent marquee cases and make this provocative book essential reading for anyone who cringes at the thought of unbridled state power and sees our civil liberties slowly slipping away in the name of the War on Drugs, the War on Crime, and the War on Terror.
