Book excerpt: The idea that international humanitarian law (IHL) and international human rights law (IHRL) are complementary, rather than mutually exclusive regimes generated a paradigmatic shift in the international legal discourse. The reconciliation was driven by a humanistic ethos and its purpose was to offer greater protection of the rights to life, liberty and dignity of all individuals under all circumstances. The complementarity of both regimes currently enjoys the status of the new orthodoxy and simultaneously invites critical reflection. This collection of essays accepts the invitation, offering diverse assessments of the merits of taking human rights to the battlefields of the twenty-first century. The book comprises three parts: part I focuses on the paradigmatic (security based "armed conflict" vs. human rights centered "law enforcement" paradigms) and the normative complexities of the interaction between both regimes in the "fight against terror" and in other, allegedly new, types of wars. Part II discusses the interplay between IHRL and IHL in the context of three specific regimes: belligerent occupation; the European Court of Human Rights and the protection of cultural heritage. Part III explores the potential fusion of IHL and IHRL into a new paradigm in two areas: post-bellum accountability and compensation to victims of war crimes. The range of issues, multitude of competing norms and narratives, and shifting paradigms explored in this collection, converse with each other. This conversation mirrors the process through which international law - paying deference to political realities while simultaneously seeking to transcend them - charts new pathways to advance its humanizing project.

Book excerpt: This book, based on field research in the West African country of The Gambia, explores how domestic gun control is shaped by international efforts and how local actors interact with international organizations or opt not to do so. The book also shows how the question of who can have what kind of gun under what circumstances is an intrinsic question to modern societies across the world, but it is seldom one that is addressed in sub-Saharan Africa except in cases of post-conflict countries. Small arms control and gun control are often treated as separate efforts, with the former the domain of international actors such as the United Nations and the latter being of concern to the domestic politics of countries such as the United States. By focusing on a country that has never seen the outbreak of a civil war, the book is able to disentangle the complex roots of gun control in Africa, its origins in colonial era legislation, its reverberations across social life, and how it shapes contemporary understandings of groups ranging for security guards to hunters.

Visit www.luminosoa.org to learn more. Archaeological discoveries in Jerusalem capture worldwide attention in various media outlets. The continuing quest to discover the city’s physical remains is not simply an attempt to define Israel’s past or determine its historical legacy. In the context of the ongoing Israeli-Palestinian conflict, it is also an attempt to legitimate—or undercut—national claims to sovereignty. Bridging the ever-widening gap between popular coverage and specialized literature, Finding Jerusalem provides a comprehensive tour of the politics of archaeology in the city. Through a wide-ranging discussion of the material evidence, Katharina Galor illuminates the complex legal contexts and ethical precepts that underlie archaeological activity and the discourse of "cultural heritage" in Jerusalem. This book addresses the pressing need to disentangle historical documentation from the religious aspirations, social ambitions, and political commitments that shape its interpretation.
