The two theories of government, the despotic and the demdcratic, spring from the logical necessities of the governed. If ignorant, the government must be despotic; if educated, it may be republican. Despotisms rest their claims upon an assumption that the people are without capacity for self-rule, and that the superior intelligence of kings rules. By both divine right and human' necessity. Under this. Theory of gov ernment, knowledge is as worthless to the subject as wings to a caged eagle. Liberty -of conscience and civil equality cannot exist, and accident of birth is above fact of merit. To obey is the supreme duty of the subject; to rule, the divine right of the sovereign. Citizenship implies obedience without responsibility, and men become parts of a machine, moved by a power they neither see inor. Understand. The limit of individual action is less than the natural. Bounds of uncultivated manhood; hence training for citizenship is a dwarfing process, by which ambition is crushed, will subdued, and self-respect subordinated to respect for the reigning power. Book excerpt: Excerpt from The Genesis of the Kansas Nebraska Act While the Senate was debating the Pacific railroad bill, the House passed a bill for the organization of Nebraska. De cember 13, 1852, Hall of Missouri reported a bill for the organ ization of the Territory of the Platte, which was referred to the committee on territories. February 2, 1853, Richardson reported from this committee a substitute bill for the organiza tion of Nebraska, without mention of slavery, and the bill passed February 10 by a vote of 98 to 43. Nearly all the votes against the bill came from the South, and both Hall and Richardson 1° charged in the debate that they were based upon opposition to a northern route for the Pacific railway. Reply ing to Howard of Texas, Mr. Hall said: He wishes to treat with those Indians, to go through that slow process and in the meantime all the great objects of the bill will be lost and the emigration to the Pacific will be driven to another portion of the Union from the route that it now follows. Elsewhere in the speech he exclaimed: Everybody is talking about a rail road to the Pacific. In the name of God, how is a railroad to be made, if you will never let people live on the lands through which it passes?11 Douglas made repeated efforts to get the House bill before the Senate. On the last day of the session (march 3, 1853) it was laid on the table by a vote of 27 to 17. Of those voting, every Southern senator voted against the bill, except the two from Missouri,12 and every Northern senator for it, except five from the Northeast. Opposition in both houses was ostensibly based on the fact that the Indian title had not been extinguished, although the bill provided that it should not take effect until this had been done. The only progress that was made toward organization was the passage of an appropriation for the extinction of this title. Book excerpt: Excerpt from The Just Supremacy of Congress Over the Territories We shall begin what we have to say upon this subject with the free admission, that there are a good many elements Of popularity both in Mr. Douglas's character and in his present position. The public man who presents himself as an advocate for the right of self-government for any people, however they are situated, will always command popular sympathy in this country. But we are not now concerned with Mr. Douglas's chances or means of political success, but with the soundness and correctness of his constitutional Opinions. Whether he is or is not of that order Of men who would rather be right than be President, we do not presume to decide; but we are sure for ourselves, that, having no personal interest in the matter, we would rather be right than be able to prevent him or any other man from reaching the Presidency, if we had the power of all the nominating conventions or of all the voters in the land. It is the purpose of Mr. Douglas's article to maintain, that the people Of a Territory have the right to decide, independently of the will Of Congress, whether the institution Of slavery shall or shall not exist among them while they are in the Territorial condition. On a cursory reading of his paper, we were a little at a loss to determine whether he meant to be understood that this power belongs to the people of a Territory because the organic act bestows upon them general legisla tive power, or, as in the case of Kansas, declares that they shall be free to form their own institutions in their own way; or whether he holds that the people of a Territory are originally free to establish or prohibit slavery without any Congressional declaration or grant of such a power, or even against a Congressional prohibition. But, on a more careful perusal, we find that his argument goes the entire length Of maintaining, that, in reference to what he calls their local concerns and internal polity, the people of a Territory are absolutely sovereign in the same sense in which the people of a State are sovereign. In order to establish what he calls popular sovereignty in the Territories, Mr. Douglas undertakes to define the dividing line between federal and local authority; and he places it, in respect to the Territories, substan tially where it is in respect to the States. He sums up the whole dis cassion in the following principle, that every distinct politicalcommunity, loyal to the Constitution and the Union, is entitled to all the rights, privileges, and immunities of self-government in respect to their local concerns and internal polity, subject only to the Constitution of the United States.
