That is why the “Palestine Liberation Organization“, was established in 1969 that saw a military fight and the destruction of Israel as the only options for liberating Palestine at that time. In 1974, the PLO indirectly recognized Israel as a state. The Arabic states liked the idea that a national authority should be established in the free parts of the Palestinian territories. Hence the Arabic States recognized the PLO as the only legitimate representation of the Palestinians. Over time, many Palestinian parties were established such as Fatah, who articulated and transferred its interests through the PLO and constituted the government of the Palestinians before the elections in 2006. Hamas, as the major opponent of Fatah, which was listed as a terrorist organization by the international community until today, was elected as the (quasi) government in the Gaza Strip in 2006. Since then, tensions between Palestinians (respectively Hamas) and Israel increased. After the elections of Hamas, there have been several attacks by Israel and Hamas. In November 2012, Israel and Hamas agreed on a ceasefire. However, both Israel and Hamas launched minor attacks against each other. In doing so, both have violated the agreements of the ceasefire, which still remained at that time. It can be said that a cold peace, existed between both Hamas and Israel. To this day, one of its most classic functions remains ensuring the peaceful coexistence between states. Global history is featured by conflicts between states, and even today there is no shortage of disputes. Besides principles of demarcation of territories and jurisdictions between states, the international law developed a wide range of techniques to resolve conflicts. Two of the major sub-branches of international law in this context are the ius ad bellum and the ius in bello. The former is concerned with the law that governs the use of force, whereas the latter deals with the conduct of the armed conflict itself . The legal abolishment of war was introduced by the United Nations (hereafter “UN”). Nonetheless, according to the Charter of the United Nations of 24 October 1945 (hereafter “UN Charter”), self-defence can serve as a justification for the use of force when certain conditions are met (article 51). Since the Second World War, the face of armed conflicts changed: inter-state conflicts have receded significantly in favour of new wars in which non-state actors play the leading role. Non-state actors are individuals or organisations that have a significant political influence, but are not allied to any particular state. Since the 9/11-attacks, the legality of self-defence against private violence (i.e. violence of non-state actors) has become a major question in the international ius ad bellum debate. While during the Cold War the state-paradigm dominated and states generally held on to a certain form of state involvement in case of a terrorist attack, today it seems that the international community no longer has principle objections to the exercise of self-defence against non-state actors, even if the initial attack cannot be attributed to a state. As a response to the proliferation and rise of non-state actors, attempts to stretch the limits of the definition of self-defence to include attacks by non-state actors can be witnessed. The Israel-Gaza conflict, one of the most complicated ongoing international conflicts with non-state actors, has – as a part of state practice – also contributed in the evolving standard of the right of self-defence.

But there is an important difference between confirmation and pro-active demonstration at the highest political level. The longstanding alliance between the United States and Israel has always been subject to the administration and president of the day. In this case, the Obama administrations support for Israels right to self-defense was qualified, and as a result the Israeli political leadership felt constrained in its ability to defeat Hamas militarily without risking criticism from the United States that would impact negatively on the special relationship. In its role as ally, the United States was careful not to apply direct political pressure on Israel. However, US government public criticisms relating to Gazan civilian loss of life damaged Israel on the international stage via harrowing media coverage surrounding the conflict. The Federal Aviation Administration order to airlines to stop flying to Israel enhanced Hamas claim that it had inflicted a strategic defeat to the Zionist State. For the last 70 years Israel has recognized that the United States is its primary strategic ally a principle initiated by Israels first Prime Minister and Defense Minister, David Ben-Gurion. Political and military policies have to be directed to prevent a rift. But the Protective Edge experience has brought to the fore that in times of crisis Israel cannot rely on a special relationship to secure its safety and must of necessity possess the political will and military ability to defend itself and to take actions that may result in a strained relationship.
