Book excerpt: The British Transport Police (BTP) is responsible for delivering a safe railway environment on the national overland railway network, and a number of other mass transit systems such as the London Underground, London Docklands Light Railway, Midland Metro Tram System and the London Croydon Tramlink. A Government review published in September 2004 rejected any suggestion that the BTP should be merged or linked to the Metropolitan Police or Home Office county forces. Yet the Committee was surprised that another review - the fourth in five years - was announced in October 2005, coinciding with the review of 43 local police forces by the Home Office. The Metropolitan Police Authority, in response to the Home Office review, suggested a strategic merger of the Met Police and the London element of the BTP. The Committee finds no valid reasons for this proposal, as clear up rates for serious crime are little different, there are no communication problems between the forces, and no details have been presented of the plan itself nor of value for money savings of a merger. The BTP's effectiveness in anti-terrorism operations had been questioned, but the Committee finds no evidence that would justify the force's break-up on those grounds. The Committee exhorts the Government to establish a sensible system of funding, to remove the necessity for protracted negotiations with the train operating companies about their contributions and timely payment. Finally the Committee rejects the "bizarre" notion of privatisation of the force, which is one of the current review's options.

Book excerpt: This book traces the history of the British Transport Police, the National Police Force responsible for policing the railways of England, Scotland and Wales. The roots of the Force go back almost 200 years, starting with the development of the railways during the Nineteenth Century. Hundreds of railway companies were founded and although mergers and amalgamations took place, by the end of the century, well over 100 railway companies were operating, most of which employed railway policemen. The first railway policemen were recruited to work on the Stockton and Darlington Railway in 1826. Other railway companies quickly followed and by the 1850s, railway policemen with their smart uniforms and top hats were a common sight on Britain’s railways. During the Twentieth Century, railway companies continued to merge before being nationalized in 1948. The following year, the British Transport Commission (BTC) was created to oversee not only the newly nationalized railway network, but also the nation’s docks, shipping, inland waterways, road transport, road haulage and other companies. Also in 1949, the British Transport Commission Police (BTC Police) was created to take over the policing of these newly nationalized institutions. All the former railway, dock and canal police forces were then absorbed into the new BTC Police Force. The BTC was abolished in 1962, having incurred serious financial losses. The BTC Police was renamed the British Transport Police in 1963 and has continued to operate ever since. It no longer polices the docks, harbors and canals for reasons outlined in this book.

Book excerpt: Winner of the 2008 British Society of Criminology Book Prize Sex offenders, particularly those who offend against children, feature prominently in contemporary law and order debates. Child sexual abuse is a small component of the broader category of 'gendered and sexualised violence' which causes significant trauma for victims yet continues to evade conventional approaches to justice. This is evidenced not only by the low number of prosecutions, due mostly to low levels of reporting and evidential difficulties at trial, but also by the failure of the justice system to prevent re-offending, largely due to the limited availability and effectiveness of prison treatment programmes. Following Braithwaite's dichotomy of 'reintegrative' and 'disintegrative' shaming, this book argues that contemporary popular and state-led responses to the risk posed by sex offenders are largely disintegrative in nature. At best, the offender may be labelled, stigmatised and ostracised from the community, while at worst, he may be subjected to violence and vigilante action and ultimately return to offending behaviour. The failure of these retributive responses means there is considerable scope for exploring alternative forms of justice and their potential for improving the outcome for victims, offenders and communities affected by sexual offences. This book examines the controversy of whether restorative justice can be applied to child sexual abuse as one of the most intractable of contemporary societal problems, and if so, what special considerations might apply. Although restorative schemes with sex offenders are in short supply, a few initiatives have developed in Canada and parts of the United States which have effected significant benefits in 'reintegrative shaming.' The book examines whether such ad hoc schemes may be of general application with child sexual abuse and whether they may be implemented on a more holistic basis.

Book excerpt: The Joint Committee on Human Rights accepts the need for a counter-terrorism power to stop, question and search travellers at ports and airports without reasonable suspicion, but calls for a reasonable suspicion threshold to be introduced for the more intrusive powers such as detention, searching and copying the contents of personal electronic devices like mobile phones and laptops, and taking biometric samples. The Committee welcomes the improvements made to the powers in Schedule 7 of the Terrorism Act 2000 to stop, question, search and detain at ports, but still considers that a number of significant human rights compatibility concerns remain with those powers even after the changes have been made. The Committee recommends a number of other amendments to the Bill with regards to preventive measures against anti-social behaviour. Whilst cautiously welcoming the Bill's provision to criminalise forced marriage, the Committee believes the new law must be implemented and monitored carefully to ensure that it is not counter-productive for victims. The Committee also recommends additional measures to protect against the potential for prolonged retention of DNA and other personal samples in criminal investigations.

An earlier report on reforms that could be introduced in the short term published in March 2011 (Cm. 8024, ISBN 9780101802420) and made recommendations for savings of £1.1 billion over 3 years, most of which are being implemented following a determination of the Police Arbitration Panel. This report makes recommendations which could realise gross savings of £1.9 billion with £1.2 billion reinvested in policing. The recommendations will provide the police service with the ability to attract and retain high calibre candidates with different skills and experiences, to maintain operational resilience by maximising the deployment of fit and healthy officers, and to manage office numbers according to need and in the public interest. Entry into the police service and advancement within would be according to the sole criterion of merit. The recommendations for reform of the pay review apparatus will have a profound effect, establishing a well-resourced professional pay review body ensuring that officers' pay is determined on sound evidence.
