These rights are described by legal scholars as "negative rights," specifically as freedoms from infringements rather than as positive rights that affirm personhood and human dignity. The contributors to this volume offer "positive rights" instead. The Universal Declaration of Human Rights (UDHR), written in the middle of the last century, inspires these updates. Nearly every other constitution in the world has adopted language from the UDHR. The contributors use intersectionality, critical race theory, and contemporary critiques of runaway economic inequality to ground their interventions in sociological argument.

Besides, there were instances when the US became a passive collaborator to human rights abuses committed by several of its allies, particularly in Latin America and Asia. Also, there were certain Presidencies as Nixon and Reagan that gave more rhetorical speeches and statements on human rights with little follow-up action. On the whole, the US human rights policy has been active, assertive and dynamic, and its application been region and situation specific.

Book excerpt: Many Americans believe that the United States has a tradition of federal constitutional protection for fundamental human rights, dating back to adoption of the Bill of Rights in 1791. That belief is mostly wrong. For most of U.S. history, protection for fundamental rights depended primarily on state law, not federal law. This article documents the transfer of regulatory authority over human rights from the states to the federal government, which we call the “federalization” of human rights. Before 1930, state governments exercised primary or exclusive regulatory authority for most fundamental rights. Federalization occurred in two phases: from 1930 to 1947 (the New Deal revolution) and from 1948 to 1976 (the “human rights” revolution). We show that the period from 1948-76 was the critical period for federalization of human rights law in the United States.This article also examines two other processes that occurred in the same time period: the advent of modern international human rights law (the “internationalization” of human rights) and the incorporation of human rights norms into national constitutions in numerous countries (the “constitutionalization” of human rights). The power of ideas is an important factor that contributes to legal change. The period from 1948 to 1976 witnessed the global diffusion of a distinctive set of ideas that we call the “political morality of human rights.” We contend that the global diffusion of human rights morality was an important causal factor that contributed to the internationalization and constitutionalization of human rights, as well as the federalization of human rights in the United States.Conventional wisdom depicts the United States as insulated from transnational forces that led to the global diffusion of human rights norms. This article contends that the conventional wisdom is wrong. The global diffusion of human rights morality in the decades after World War II contributed to the development of a new tradition of robust federal protection for human rights in the United States.

Book excerpt: The civil rights problem of the mid-twentieth century was one of the greatest challenges to the American social fabric since the Civil War. Riots in scores of cities, and serious intergroup tensions and conflicts in thousands more, underlined the seriousness of the problem. Administrative Implementation of Civil Rights examines the role, operation, and contribution of the device most often relied on by local and state governments for dealing with intergroup problems—the human- relations commission. First used in the early 1940s to deal with discrimination against blacks, this commission was later often charged with implementing the civil rights of other minority groups and of women, the elderly, the handicapped, and the poor. It is Joseph Parker Witherspoon’s thesis that the human-relations commission was not used effectively, that an agency of this type has great strengths that most local and state governments did not utilize, and that its weaknesses are susceptible of remedy and must be eliminated. He explains these weaknesses and develops proposals for correcting them. Witherspoon examines the roles of the local, state, and federal governments in solving this country’s complicated and serious civil rights problem and demonstrates that a program that carefully coordinates action by the federal government with action by local and state governments could be made to work effectively. As a part of this demonstration he proposes the enactment of a new form of comprehensive civil rights legislation at local, state, and national levels, and presents a series of four model statutes—the Alpha Model Acts—for effectuating his proposals. The approach emphasized in these statutes greatly strengthens the role of the human-relations commission as a law-enforcement agency and, in particular, focuses the operation of federal and state action upon life in the individual community. The book concludes with a group of appendices listing all state and many local commissions and agencies handling human-relations problems at that time, and summarizing the type of authority, the jurisdiction, the operating budget, and the legislative basis for each. This list will be of interest to those studying the history of civil rights and public policy in the United States.
