Available in PDF, EPUB and Kindle. Book excerpt: The law of the sea provides for the regulation, management and governance of the ocean spaces that cover over two-thirds of the Earth's surface. This book provides a contemporary explanation of the foundational principles of the law of the sea, a critical overview of the 1982 United Nations Convention on the Law of the Sea and an analysis of subsequent developments including the many bilateral, regional and global agreements that supplement the Convention. The second edition of this acclaimed text takes as its focus the rules and institutions established by the Convention on the Law of the Sea and places the achievements of the Convention in both historical and contemporary context. All of the main areas of the law of the sea are addressed including the foundations and sources of the law, the nature and extent of the maritime zones, the delimitation of overlapping maritime boundaries, the place of archipelagic and other special states in the law of the sea, navigational rights and freedoms, military activities at sea, and marine resource and conservation issues such as fisheries, marine environmental protection and dispute settlement. As the Convention is now well over a quarter of a century old, the book takes stock of contemporary oceans issues that are not adequately addressed by the Convention. Overarching challenges facing the law of the sea are considered, including how new maritime security initiatives can be reconciled with traditional navigational rights and freedoms, and the need for stronger legal and policy responses to protect the global ocean environment from climate change and ocean acidification.

Book excerpt: Excerpt from The Extent of the Marginal Sea: A Collection of Official Documents and Views of Representative Publicists The present volume of views and documents bearing upon the extent of the marginal sea isdivided into two sections: Part I con tains excerpts from the publications of representative publicists; Part II is a compilation of official documents. The documents in Part II are printed in chronological order under countries in al phabetical order. When a document, as a treaty, emanates from two Governments, it is noticed under both countries, but the text appears under only one of them, a footnote reference being made under the other to the page where the text is to be found. Treaties which are expressions of more than two Governments, as the North Sea and the Hague Conventions, are to be found at the beginning of Part II, in the section termed Polynational. In many of the documents the words indicating the extent of the territorial sea have been printed editorially in italics to assist the eye. Owing to the limited time available for collecting documents, a number of them are entered only by captions and reference to the authors citing them. Also, a few documents, which were located too late to be inserted in their proper places in the body of the text, have been appended as supplementary documents. Available in PDF, EPUB and Kindle. Book excerpt: This book places contemporary problems of ocean use management in historical context beginning with the time of Hugo Grotius, whose seminal 1609 work The Freedom of the Seas was the basis of ocean law for the next three centuries. Individual use problems are dealt with in detail and include overfishing, migrating fish stocks and fish wars, oil drilling, deep sea mining and marine pollution. Throughout the author notes the need to seek solutions in ocean management from a more integrated perspective. Emphasis is placed on the United Nations Conference on the Law of the Sea and the resulting agreements. This book therefore presents a unique breadth of view which will make it salient to policy makers, diplomats, scholars and ocean users.

This book was released on 2013-12-01 with total page 130 pages. Available in PDF, EPUB and Kindle. Book excerpt: It is a truism that the increasingly rapid movement in technology is forcing change and shift in the norms of international law. The 149 states of the Law of the Sea Conferences of the United Nations have been attempting to establish and develop adequate legal norms that will take into account the need for the orderly growth and use of the changing technological capabilities and the resulting economic development that cannot and should not be hindered by in adequate law. When such norms are identified and agreed by a substantial majority of states, they are usually set out and placed into multilateral treaties. The rules governing the resource and non-resource allocation of the oceans and the uses ofthe oceans have posed major difficulties for the development of international law for many years. The Geneva Conference of 1958 building upon the groundwork of the International Law Commission of the United Nations shaped a rough structure for a 20th Century Law of the Seas and for mulated the effort in four major international conventions. But a majority of the states failed to ratify or accede to the conventions. Even had they become effec tive as the expression of the Law of the Seas in the second half of the 20th Cen tury, there was one glaring area of omission: a conventional law for the waters of mid-ocean archipelagos and archipelagic states.

Book excerpt: This is the first comprehensive study on archipelagic regimes published since the adoption of the United Nations Convention on the Law of the Sea in 1982. The book traces the historical evolution of the archipelagic concept in international law and examines the definition of archipelagos and archipelagic states. The nature, status and regime of the waters of different types of archipelagos is examined and analysed from the perspective of archipelagic states and is based on the requirement of such states for territorial integrity and self-determination. The book introduces the concept of `Ocean States' and links Ocean States with the archipelagic concept. The archipelagic concept is viewed as a practical as well as a functional basis for the determination of the territorial limits of Ocean States.

Covering time scales varying from years to decades, it provides a comprehensive review of the long-term changes in various physical variables, including sea level, sea surface temperature, water mass index, current and transport, as well as local issues such as sea ice and tidal mixing, and the processes and dynamics that govern them. The book also examines biogeochemical variables, such as nutrients, oxygen, pH, water transparency, ocean acidification, eutrophication and productivity, and explores future trends. Offering a holistic view of the changes that have occurred in the Asia-Pacific marginal seas and those that are likely to occur in the future, this book will appeal to readers from all fields of oceanography.
