The emergence of these policies coincides with a dramatic increase in unionization among public employees, and an important puzzle is the direction of causality between the laws and public employee unionization. A key piece of the solution is understanding the evolution of the public policy in this area, and this is the focus of the analysis in this study. A Markov model of the evolution of these laws is developed based on the idea that states will change their existing policy if and only if their preferences deviate from the existing policy by more than the cost of a change in policy. The key underlying constructs are 1) the intensity of state preferences for or against public sector collective bargaining and 2) the cost of changing an existing policy or enacting a new policy. The model is implemented empirically using state level data on policy for each year from 1955 to 1984. The results suggest that state preferences for a pro-bargaining policy are positively related to 1) the COPE score (a measure of pro-union congressional voting behavior on labor issues), 2) income per capita, and 3) the size of the public sector and negatively related to southern region. The costs of policy change were hypothesized to be a function of structural measures of the legislative process, but no support for this was found in the data. Use of the estimates to predict probabilities of states having laws of various kinds suggests that the model can predict the aggregate distribution of laws relatively well but that the model does less well at distinguishing between states with laws of different types

The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted. Book excerpt: This study uses a Cox proportional hazards model to estimate ther elationship between state-level collective bargaining policies and union growth in the public sector. The proportional hazards analysisis performed with data on approximately eight hundred municipal police departments. The timing of unionization in these departments clearly indicates that unionization rarely precedes the enactment of a statute. Where bargaining laws have not been enacted, formal collective bargaining between municipalities and their police is virtually nonexistant. Moreover, the proportional hazards analysis that controls for the effects of other state-level and municipal-level covariates indicates that the bargaining laws and policies are the most important determinant of unionization among police. Among different types of bargaining policies, "duty-to-bargain" provisions lead to higher unionization rates than do statutes that permit, but do not require, employers to bargain with police. However, after controlling for for the effects of other covariates, there appears to be no difference in the unionization rates between the states that have duty-to-bargain provisions along with an interest arbitration mechanism and those states that have duty-to-bargain provisions without such a dispute resolution mechanism

Book excerpt: The 2011 battle in Wisconsin over public sector employees' collective bargaining rights occasioned the largest protests in the state since the Vietnam War. Protestors occupied the state capitol building for days and staged massive rallies in downtown Madison, receiving international news coverage. Despite an unprecedented effort to oppose Governor Scott Walker's bill, Act 10 was signed into law on March 11, 2011, stripping public sector employees of many of their collective bargaining rights and hobbling government unions in Wisconsin. By situating the events of 2011 within the larger history of public sector unionism, Alexis N. Walker demonstrates how the passage of Act 10 in Wisconsin was not an exceptional moment, but rather the culmination of events that began over eighty years ago with the passage of the Wagner Act in 1935. Although explicitly about government unions, Walker's book argues that the fates of public and private sector unions are inextricably linked. She contends that the exclusion of public sector employees from the foundation of private sector labor law, the Wagner Act, firmly situated private sector law at the national level, while relegating public sector employees' efforts to gain collective bargaining rights to the state and local levels. She shows how private sector unions benefited tremendously from the national-level protections in the law while, in contrast, public sector employees' efforts progressed slowly, were limited to union friendly states, and the collective bargaining rights that they finally did obtain were highly unequal and vulnerable to retrenchment. As a result, public and private sector unions peaked at different times, preventing a large, unified labor movement. The legacy of the Wagner Act, according to Walker, is that labor remains geographically concentrated, divided by sector, and hobbled in its efforts to represent working Americans politically in today's era of rising economic inequality.
