Despite progress in certain areas, the Committee says that the main problem with the Government's project to gather information electronically on all travellers entering or leaving the UK, is that what it requires will make it illegal to operate on intra-EU routes under the EU treaty. An EU Member State cannot impose any requirement other than simple production of a valid identity document on an EU citizen except in exceptional circumstances. The Committee says the UK Border Agency (UKBA) is imposing expensive requirements on the private transport sector for the eBorders programme, in the name of urgent public good, without apparently having ascertained that the programme requirements are lawful. There are also problems with national data protection laws.

Book excerpt: On current projections the Home Office's e-Borders programme and its successors will cost over a billion pounds, be delivered 8 years late and not provide the benefits expected for transport carriers and passengers. A major reason for this delay was the termination by the Department in 2010 of its e-Borders contract with Raytheon. This had required Raytheon to deliver its own solution to meet the Department's objectives to a fixed price and timescale which turned out to be unrealistic as government had detailed and evolving requirements, and wanted high assurance that the proposed solution would work. The Department was emphatic that our borders are secure. However, the Department needs to accept that its assertion that it checks 100% of passports is both imprecise and unrealistic due to the complexity of our border. It is now five years since the e-Borders contract was cancelled yet the capabilities delivered so far still fall short of what was originally envisaged. Since 2010 the Major Projects Authority has issued seven warnings about these programmes. The Department's complacency about progress to date increases our concerns about whether the programme will be completed by 2019 as the Department now promises, and whether tangible benefits for border security, transport carriers and passengers will result.

It has had to prioritise passenger checks at the expense of its other duties thereby weakening security at the border by neglecting other duties, such as the examination of freight for illicit goods, and checks in Calais on lorries to detect concealed illegal entrants. It was not able to meet and check up to 90,000 private planes or private boats arriving in the UK each year, leaving the UK border vulnerable and raising issues about resourcing and how priorities are set. The Border Force acknowledged that it had missed 8 of its 19 seizure and detection targets. Recommendations: set out how it will ensure that it delivers its full range of duties across all ports to provide the required level of national security; demonstrate that it can deliver its workload within the resources available; must address the gaps in the data it receives on people arriving in the UK, and the existing data needs to be cleansed to increase the quality, reliability and usefulness of the intelligence generated; set out how, and by when, it will have in place the functional IT systems it needs to underpin the security of the UK border; senior management must provide the organisation with a clear sense of purpose and tackle those barriers which inhibit the flexible and effective deployment of its staff.

However, most of the 70,400 reduction was achieved by simply loading pending cases onto the computer, and in some categories-such as those applying for further leave to remain on the basis of marriage or civil partnership-the backlog had actually grown. The Committee has no objection in principle to the introduction of a charge for access to the National Health Service for those who are in the UK only temporarily. However it expresses concerns about the possible application of the scheme to vulnerable people who have been trafficked into the country and recommends that the Government should pilot an alternative option for visa applicants to take out private health insurance instead. This has been a chaotic summer for immigration policy. First we had the controversial AdVans which were rightly ridiculed, and then it was revealed that Capita had botched the contract to clear the migration refusal pool by asking British citizens to leave their own country. Finally we saw a u-turn on visa bonds, however the uncertainty has already done damage. A more effective and less menacing message would be that the Government is willing and able to support those who are here illegally to return home if they want to. Tough enforcement action should be taken against those who are determined to remain here illegally, but for the target audience of potential voluntary returners, the effectiveness of the carrot is potentially undermined by the ostentatious brandishing of the stick

It welcomes the fact that the Home Office is acting on its earlier recommendation to extend the use of the compulsory national framework for police procurement, however expresses concern about the progress of the e-borders programme and the lack of clarity over plans to introduce privatisation into policing. The Committee found that the costly joint procurement exercise being undertaken by Surrey and West Midlands Police lacked clarity. The Committee were not convinced that the Forces fully understood, or were fully able to articulate the process they were undertaking. With the overall costs of exploring this process set at £5 million, the Committee called on the Home Office to take responsibility for ensuring the public and stakeholders were aware of the process and to postpone the exercise till after the election of the Police and Crime Commissioners. Also, despite the letting of new contracts to Serco and IBM in preparation for the London Olympics, the Committee remains concerned about the progress of the e-Borders programme. The Committee also found that an unacceptable level of claims under the Riot Damages Act were still outstanding and recommends that the Home Office work with police authorities to publish a timetable for the payment of all outstanding claims. All those who made a legitimate claim should receive their payments by the first anniversary at the latest

It explores the ways in which scientific advice, risk and evidence are being managed in relation to technologies that are continually developing. The Home Office has followed good practice by the establishment of advisory committees, the use of Office of Government Commerce (OGC) Gateway Reviews and the development of risk management strategies, along with a policy of gradual implementation. But the Committee has identified weaknesses in the use of scientific advice and evidence. There has been a lack of transparency surrounding the incorporation of scientific advice, the procurement process and the ICT system. Consultations have been limited in scope and their objectives have been unclear. Only some aspects of the scheme such as the biometrics have been determined. The Home Office's decisions demonstrate an inconsistent approach to scientific evidence, and the Committee is concerned that choices regarding biometric technology have preceded trials. With extensive trialling still to take place, the Committee is sceptical about the validity of projected costs. The Committee recommends that the Home Office seeks advice on ICT from senior and experienced professionals and establishes an ICT assurance committee. It is crucial that the Home Office increases clarity and transparency across the programme, not only in problem areas. The programme should also be flexible enough to change should evidence emerge that contradicts existing assumptions.
