Societies emerging from violent conflict often opt for a bill of rights as part of a wider package of constitutional reform. Where conflict is fuelled by longstanding ethno-national divisions, these divisions are often addressed through group-differentiated rights. Recent constitutional settlements have highlighted the difficulties in drafting a bill of rights in divided/post-conflict societies, where the aim of promoting unity is frequently in tension with the need to accommodate difference. In such cases, a bill of rights might be a rallying point around which both minorities and the majority can articulate a common vision for a shared society. Conversely, a bill of rights might provide merely another venue in which to play out familiar conflicts, further dividing an already divided society. The central questions that animate the collection are: (1) Can constitutional rights provide a basis for unity and a common 'human rights culture' in divided societies? If so, how? (2) To what extent should divided societies opt for a universalistic package of rights protections, or should the rights be tailored to the specific circumstances of a divided society, providing for special group-sensitive protections for minorities? (3) Is a divided society more or less likely to adopt a bill of rights? (4) How does the judiciary figure in the management or resolution of ethno-national conflict? (5) What are the general theoretical and philosophical issues at stake in a rights-based approach to the management or resolution of ethno-national divisions or other conflicts?

This book argues that the recent conflicts over social policy represent key elements in strategies that parties designed in an attempt to consolidate their hold over the federal government. Long frustrated by divided government, each party exceeded its electoral mandate in hopes of enacting major policy reforms aimed to shift politics in their direction for the foreseeable future. The book traces the overreaching and limited legislative success that characterized the first Clinton administration's approach to three distinctive features of politics and policymaking: the polarization of political elites; the predominance of advertising campaigns and intense interest group politics as political parties have ceased to mobilize ordinary people; and the unprecedented role that budgetary concerns now play in social policymaking. Although neither party managed to enact its major transforming agenda, Congress did pass new policies--most notably welfare reform--that together with a host of other changes in the states and the private sector altered the landscape for social policy. The poor have been the biggest losers as Democrats and Republicans have fought to win the middle class over to their vision of the future. The authors first analyze the institutions and tools of policymaking, including Congress, the political use of public opinion polling, and the politics of the deficit. They then consider policies designed to win over the middle class, including health care policy, employer-provided social benefits, wages and jobs, and crime policy. Thus, it's typical for members of the worker elite to identify themselves as middle class, though of course some workers may adopt that term merely as an inspiration. For the most part, workers decide that they are middle class on a very practical basis: their distinct, all-around preferential status as wage earners, consumers, and "citizens." These workers believe themselves to be separate in essential ways from the proletariat. We should take this perception seriously! These notes take a critical view of the role of the worker elite under capitalism. That doesn't mean I hate middle class workers. I'm one myself. I don't hate intellectuals or farmers or shopkeepers either. Middle class people aren't free under this system. And ultimately we can make individual choices; we can resist capitalism or not. What I have learned to hate are the illusions and the opportunism that go along with middle class privilege. These are what continuously persude the worker elite to join the other middle classes in embracing capitalism. They also motivate the class to manipulate, dominate, and strnagle the freedom struggles of other workers for its own benefit. The main force for revolution will come from within the working class. I believe that today, more than ever. But it will not come from the privileged worker elite.
