The policy, institutional and legal frameworks are well developed although implementation and enforcement remains weak due to ambiguities in the law and a general lack of supportive incentives. This Legal Assessment report for Tanzania examines four key challenges to the attainment of sustainable land-use investments. These comprise: Enforcement of environmental and social safeguards Tanzania has made progress in implementing the Environmental Management Act by ensuring greater compliance with the Environmental Impact Assessment regulations although exceptions exist in the construction sector, and mining legislation that often enables the government to circumvent important land tenure safeguards. Incentives for sustainable investments in the legal framework A lack of incentives exists despite the creation of the Tanzania Investment Centre, the adoption of an Investment Guide in 2013, and the incorporation of sustainability considerations into laws and policies governing investments in the agriculture, energy, and forestry and mining sectors. Land tenure security Tanzanias land law framework now includes formal recognition of customary title and the reservation of land under the category of village land exclusively for Tanzanians although improvements are still needed in terms of processes of consultation and compensation. Public awareness and lack of access to information Awareness of natural resources and investment policies, legislation and regulations is generally low amongst rural communities as well as Ward executive officers, village leaders and village land committee members. It explores the Tanzanian REDD+ policy processes and strategies at the national level, identifying barriers, limits and opportunities in national REDD+ arenas to inform future REDD+ design by providing research-based options for achieving efficient, effective and equitable REDD+ (i.e. the 3Es of REDD+). Both direct and indirect drivers of deforestation and forest degradation are at work, including forest conversion to small-scale agriculture, timber extraction driven by demand from national and international markets, fuelwood and charcoal, and population growth. The prospects for REDD+ rest on improving a number of issues: tenure arrangements, forest governance, reliability of long-term funding, benefit-sharing mechanisms, and technical, human and financial capacity. We recommend the continuation of support towards decentralized sustainable forest management and utilization of the participatory forest management model as an entry point for REDD+ initiatives. Participatory land-use planning practices coupled with improved spatial planning and strengthening mechanisms against illegal activities entrenched in driving forest degradation are needed. In addition, for REDD+ to succeed it will need to challenge and overcome the powerful actors invested in and driving the business-as-usual model.

National development plans in each country, and their crosscutting laws on land and the environment incorporate principles of sustainable development. However, sector-specific laws governing forestry, agriculture, mining and energy reflect these principles to varying degrees. Relying significantly on natural resources, these countries have witnessed consistent GDP growth in recent years. Despite their resource wealth and increased investments, poverty and resource degradation persist. Rural populations remain disproportionately affected, with limited access to basic services and increased vulnerability to the impacts of deforestation and climate change. This Synthesis report outlines four key insights on issues identified by the legal assessments that can either hinder or enable sustainable land use investments. These consist of: Reframing investment incentives and focusing on smallholder interests;Protecting customary land rights and ensuring consultation and consent:Establishing clear and effective regulations, strengthening enforcement capacity and supporting decentralization andRaising awareness, guaranteeing participation and promoting freedom of information. The report demonstrates that landscapes governance embodying the rule of law and adherence to social and environmental safeguards can create enabling conditions for sustainable investments. Equity, responsive legal and policy reforms, improved enforcement capacity, strengthened participatory mechanisms and other rule of law considerations are critical to planning and managing investments so that they contribute to sustainable development.

Book excerpt: As community involvement in natural forest management expands and matures, the need to lodge the rights and obligations of both state and community in workable and legally binding institutional frameworks becomes more pressing. This is particularly so where power and authority are being redistributed. This publication looks specifically at Tanzania, where forest-local communities are beginning to be designated as the management authority of particular woodlands and, in some cases, even their owners. Positive results are giving considerable support to community-based management as the forest management strategy of choice. Implementation has of necessity also prompted a search for accessible mechanisms through which community authority may be embedded legally. The author argues that, in this respect, Tanzania has an advantage over many sub-Saharan African states in the unusual manner of legal identity granted to rural communities, and in supporting administrative and land laws which provide for village-based control over natural resource management. Specific elements explored include the fact that rural villages in Tanzania are recognised as a formal level of government, endowed thereby with certain rights and obligations; that the rural village may attain legal corporate status allowing it, inter alia, to own and manage property in ways accountable in a court of law; and that property law provides for a modern, statutory version of communal tenure, within the bounds and accountability of a private legal person. Wily provides a step-by-step guide to the ways in which a forest-adjacent community may secure custodianship over a local natural forest, whether it be an already gazetted Forest Reserve or public land forest, and be held accountable for sound conservationary management.

Book excerpt: Tanzania's land, local government and forest laws mean that rural communities have well defined rights to own, manage and benefit from forest and woodland resources within their local areas through the establishment of village forests. This approach, known by practitioners as Community Based Forest Management (CBFM) results in the legal establishment of village land forest reserves, community forest reserves or private forests. By 2008, 1,460 villages on mainland Tanzania1 were involved in establishing or managing village forests covering a total of over 2.345 million hectares. A further 863 villages are currently involved in Joint Forest Management (JFM) approaches within government forest reserves, in which management responsibilities are shared between government and local communities. 1.78 million hectares of forest reserve under central or local government jurisdiction are now under JFM arrangements. Since 2008, the Tanzanian government has been making preparations for the establishment of systems and structures for REDD Plus (Reduced Emissions from Deforestation and Forest Degradation). Tanzania is being supported in its preparations by the World Bank's Forest Carbon Partnership Facility (FCPF), UN-REDD plus and the Norwegian Forests and Climate Initiative as well as a number of local and international Non Government Organizations (NGOs). This report has been prepared to provide inputs to the development of policy processes currently evolving in Tanzania regarding REDD plus. This review draws on almost two decades of experience within Tanzania on the development and establishment of Participatory forest management (PFM) an approach which (like REDD plus), aims to achieve the combined objectives of sustainable forest management with secure rights, improved local forest governance and secure livelihoods for forest-dependent communities.

Book excerpt: REDD+ must be transformational. REDD+ requires broad institutional and governance reforms, such as tenure, decentralisation, and corruption control. These reforms will enable departures from business as usual, and involve communities and forest users in making and implementing policies that a ect them. Policies must go beyond forestry. REDD+ strategies must include policies outside the forestry sector narrowly de ned, such as agriculture and energy, and better coordinate across sectors to deal with non-forest drivers of deforestation and degradation. Performance-based payments are key, yet limited. Payments based on performance directly incentivise and compensate forest owners and users. But schemes such as payments for environmental services (PES) depend on conditions, such as secure tenure, solid carbon data and transparent governance, that are often lacking and take time to change. This constraint reinforces the need for broad institutional and policy reforms. We must learn from the past. Many approaches to REDD+ now being considered are similar to previous e orts to conserve and better manage forests, often with limited success. Taking on board lessons learned from past experience will improve the prospects of REDD+ e ectiveness. National circumstances and uncertainty must be factored in. Di erent country contexts will create a variety of REDD+ models with di erent institutional and policy mixes. Uncertainties about the shape of the future global REDD+ system, national readiness and political consensus require exibility and a phased approach to REDD+ implementation.
