Available in PDF, EPUB and Kindle. Book excerpt: Van Alstyne presents an "unhurried" historical review of the extent to which academic freedom has been accepted into domestic constitutional law. Two essays deal with the issue of tenure and academic freedom. Ralph S. Brown and Jordan E. Kurland agree that tenure reinforces academic freedom but wonder if there is not a large price to be paid for such a system. In a highly instructive review Matthew Finkin looks at academic tenure and freedom in the light of labor law. Focusing on freedom of artistic expression, Robert O'Neil raises difficult questions about what kinds of art displays taxpayers can be expected to tolerate in the colleges and universities they support. Rodney A. Smolla looks at the ways in which "hate" speech and offensive expression on campuses engage wide First Amendment jurisprudence. Judith Jarvis Thomson examines the vexed issue of selecting - and valuing - individual faculty members or disciplines with regard to ideology. Michael W.

Available in PDF, EPUB and Kindle. Book excerpt: This publication presents a close examination of conceptual, legal and related issues surrounding the dismissal of tenured higher education faculty, under the fourth exception to the Age Discrimination in Employment Act (ADEA). This exception, which will expire on December 31, 1993, permits existing, compulsory retirement-age policies to be applied to employees by their college or university employer at age 70 if the employees are "serving under a contract of unlimited tenure." The study is organized into four parts. The first, an introduction, describes the history of the development of the ADEA legislation and its amendments and exception as well as an overview of the study itself. Section II, "The Concept of Tenure," focuses on tenure's function and justification without considering the law. Part III, "The Legal Aspects of Tenure," addresses the question of whether the concept of tenure constitutes an unacceptable obstacle for institutions of higher education such that their efforts to achieve educational goals is unacceptably impaired. Part IV, "Conclusion," discusses age-neutral procedures, involuntary versus voluntary termination, the need to retain older faculty, and the role of academic tenure in the 1990s. An appendix offers dismissal procedure guidelines. Also included are a table of cases cited and an index. (JB)

Available in PDF, EPUB and Kindle. Book excerpt: Goonen and Blechman provide an analysis useful as a desk reference or as a text for practicing and prospective administrators and university counsel. They examine the legal points, ethical questions, and practical steps an administrator or university counsel should be aware of in dealing with some of the most frequently encountered issues in the administration of a college, university, or other postsecondary institution. Each chapter targets a selected area of academic affairs, and the format includes four sections—legal parameters, ethical considerations, practical suggestions, and an illustrative case. Hiring issues, compensation and employment issues, promotion and tenure, terminations, non-renewals, and reductions in force, academic freedom, student disputes on academic matters, and transcript and degree issues are all analyzed. Goonen and Blechman provide a general guide that can be readily utilized and understood by those without specific prior training in the law or in higher education administration. The discussions and information the guide contains will be valuable to current and prospective practitioners as they seek to balance the legal, ethical, and practical issues that surface in every decision in the increasingly complex higher education arena.

The concept of academic freedom and tenure has been a point of discussion between university faculty and administration since the American Association of University Professors (AAUP) established these two concepts in their 1915 Declaration of Principles on Academic Freedom and Tenure. In this book, the author examines the history of these two issues and how they became an integral part of higher education in the United States. In his detailed analysis, the author provides a review of landmark state and federal court cases and evaluates the subsequent impact of those rulings on academic freedom and tenure.
