Available in PDF, EPUB and Kindle. Book excerpt: The Law of Emergencies: Public Health and Disaster Management, Second Edition, introduces the American legal system as it interacts with disaster management, public health and civil unrest issues. Nan Hunter shows how the law in this area plays out in the context of real life emergencies where individuals often have to make split-second decisions. This book covers the major legal principles underlying emergency policy and operations and analyzes legal authority at the federal, state and local levels, placing the issues in historical context but concentrating on contemporary questions. The book includes primary texts, reader-friendly expository explanation and sample discussion questions in each chapter, as well as scenarios for each of the three major areas to put the concepts in to action. Prior knowledge of the law is not necessary in order to use and understand this book, and it satisfies the need of professionals in a wide array of fields related to emergency management to understand both what the law requires and how to analyze issues for which there is no clear legal answer. The book features materials on such critical issues as how to judge the extent of Constitutional authority for government to intervene in the lives and property of American citizens. At the same time, it also captures bread-and-butter issues such as responder liability and disaster relief methods. No other book brings these components together in a logically organized, step by step fashion. - Updated with expanded coverage and several new chapters - Re-organized to improve topic focus, with sections covering The President, Congress, and the Courts; Governance on the Ground; The Rights of Individuals; Disaster Management and Reconstruction; Health Emergencies; Preserving the Social Fabric; and Liability - Includes a new disaster scenario (a dirty bomb explosion in Washington, DC) to illustrate the application of key concepts - Features two new appendices that provide key excerpts from the U.S. Constitution and the Stafford Act - Includes a new glossary of legal and legislative terms

Book excerpt: This book looks at how legal frameworks can and do reduce risks arising out of disasters. The volume: analyses existing disaster laws and the challenges on the ground; brings together case studies from some of the most vulnerable regions; and proposes solutions to avert existing and possible future crises. The book offers appropriate legal frameworks for disaster management which could not only offer sustainable institutional reforms towards community resilience and preparedness but also reduce risk within the frameworks of justice, equity and accountability. It examines the intricacies of governance within which governments function and discusses how recent trends in infrastructure development and engineering technology could be balanced within the legal principles of ethics, transparency and integrity. The chapters in the volume suggest that legal frameworks ought to resonate with new challenges of resource management and climate change. Further, these frameworks could help secure citizens’ trust, institutional accountability and effective implementation through an unceasing partnership which keeps the community better prepared and more resilient. This volume will be indispensable to scholars and researchers of disaster management, law, public policy, environment and development studies as well as policymakers and those in administrative, governmental, judicial and development sectors.

Available in PDF, EPUB and Kindle. Book excerpt: This book highlights the relationship between disasters and development through a socio-cultural study of human geography and governance institutions. It studies the cause, context and consequences of disasters in one of the most fragile Himalayan regions in India. The book establishes the fact that disaster management is built within the framework of good governance, without which it has no meaning. For lack of effective and responsive governance, development has lagged behind and even though the frequency of disasters has been increasing, little is being done to redesign developmental frameworks to prevent ensuing losses. Besides, the near absence of governmental support during recurrent disasters, communities have cumulatively become reservoirs of innovations to cope up with disasters. The resilience plans need not follow implanted models but may be cost effective only if they apply a bottom up approach. Just as the region is culturally diverse so are the challenges encountered by local communities in terms of generating resilience to every disaster. Despite more than a decade of the Disaster Management Act (DMA) of 2005, most of the states in this northeastern fringe of India continue to wait for its implementation beyond mere structures and offices. The book suggests that urgent action is required in accordance with the DMA 2005 towards inter-agency coordination, proactive participation of local governance, mobilization of Community based Organizations (CBOs) and curriculum based training in every academic and technical institution. Governments of these northeastern states of India should establish accountability of State Disaster Management Authorities and inspire them to participate proactively with communities for an effective resilience building in the region.

Book excerpt: This book – “Disaster Management in India: Challenges and Strategies” - provides a practical and realistic understanding of the evolving status of disaster management in India. The book discusses techno-legal systems for disaster management and their real-life effectiveness based upon the author’s own professional experience as well as available literature including studies, reviews and audits reports.A case study of the 2001 Bhuj Earthquake conducted by the author is at the nucleus of the book and provides a clear understanding on how interdependent sub-systems (social, organisational, infrastructure) can fail during sever incidents, and the consequences thereof.Lack of resources, lack of coordination, and poor communication are endemic to severely damaged disaster environments like the 2001 Bhuj earthquake and are very commonly seen across the world. What is more important for the future is that new methods are being evolved that overcome the potential risks posed by such initial conditions for improving organizational performance. Lessons from the 2001 Bhuj earthquake highlighted in this book are still relevant and provide directions for well-designed future interventions. The book critically examines performance status of disaster management in the post DM Act 2005 period and identifies many relevant issues and challenges – including development of effective institutions for disaster risk management. At the end, the book proposes intervention strategies for strengthening and improving disaster management systems keeping in mind the latest developments and best-practices suited to Indian conditions. Drawing on the author’s decades of experience both in the domains of disaster management and technology, the book provides tips on - Emergency Operations Center design and development; Media integration into DM, emergency Resources Management systems development and Crowd management.

Available in PDF, EPUB and Kindle. Book excerpt: Information technology (IT) has the potential to play a critical role in managing natural and human-made disasters. Damage to communications infrastructure, along with other communications problems exacerbated the difficulties in carrying out response and recovery efforts following Hurricane Katrina. To assist government planning in this area, the Congress, in the E-government Act of 2002, directed the Federal Emergency Management Agency (FEMA) to request the NRC to conduct a study on the application of IT to disaster management. This report characterizes disaster management providing a framework for considering the range and nature of information and communication needs; presents a vision of the potential for IT to improve disaster management; provides an analysis of structural, organizational, and other non-technical barriers to the acquisition, adoption, and effective use of IT in disaster; and offers an outline of a research program aimed at strengthening IT-enabled capabilities for disaster management.

Book excerpt: In the devastation that follows a major disaster, there is a need for multiple sectors to unite and devote new resources to support the rebuilding of infrastructure, the provision of health and social services, the restoration of care delivery systems, and other critical recovery needs. In some cases, billions of dollars from public, private and charitable sources are invested to help communities recover. National rhetoric often characterizes these efforts as a "return to normal." But for many American communities, pre-disaster conditions are far from optimal. Large segments of the U.S. population suffer from preventable health problems, experience inequitable access to services, and rely on overburdened health systems. A return to pre-event conditions in such cases may be short-sighted given the high costs - both economic and social - of poor health. Instead, it is important to understand that the disaster recovery process offers a series of unique and valuable opportunities to improve on the status quo. Capitalizing on these opportunities can advance the long-term health, resilience, and sustainability of communities - thereby better preparing them for future challenges. Healthy, Resilient, and Sustainable Communities After Disasters identifies and recommends recovery practices and novel programs most likely to impact overall community public health and contribute to resiliency for future incidents. This book makes the case that disaster recovery should be guided by a healthy community vision, where health considerations are integrated into all aspects of recovery planning before and after a disaster, and funding streams are leveraged in a coordinated manner and applied to health improvement priorities in order to meet human recovery needs and create healthy built and natural environments. The conceptual framework presented in Healthy, Resilient, and Sustainable Communities After Disasters lays the groundwork to achieve this goal and provides operational guidance for multiple sectors involved in community planning and disaster recovery. Healthy, Resilient, and Sustainable Communities After Disasters calls for actions at multiple levels to facilitate recovery strategies that optimize community health. With a shared healthy community vision, strategic planning that prioritizes health, and coordinated implementation, disaster recovery can result in a communities that are healthier, more livable places for current and future generations to grow and thrive - communities that are better prepared for future adversities.
