This book was released on 2018-02-09 with total page 42 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Dartmouth College Case and Private Corporations The inquiry first requires a brief consideration of the doctrine established and its applications. But it is unnecessary to examine at any length the cases in the federal and state courts in which the principle of the leading case has been applied, for this would be only a repetition of familiar learn ing. It will be su cient to notice the well-known rules flow ing from the original decision, which have been administered for the protection of private business corporations. It will appear that the decisions, during a period of sixty-five years, have a rmed a body of legal rules, as applications of the doctrine of the leading case, which, to say the least, consti tute a strong and valuable support of corporate privileges. Dartmouth College vs. Woodward (1816-1819) established significant precedents concerning state authority and the nature of private enterprise. Dartmouth College was incorporated under a royal charter in 1769 as a private corporation. In 1816 the New Hampshire Legislature attempted to transform the college into a state institution. Daniel Webster, representing the college trustees, convinced the Supreme Court that the royal charter was a contract that could not be invalidated by subsequent state legislation. The court concurred. Its decision initiated a significant constitutional limitation on state authority. It also helped to define corporations as relatively unregulated private economic entity that contributed to the public sphere through enlightened self-interest. Shirley offers a vivid account of the case, enriched by extensive quotation of primary archival sources.

Book Synopsis Origins of the Dred Scott Case by : Austin Allen
Download or read book Origins of the Dred Scott Case written by Austin Allen and published by University of Georgia Press. This book was released on 2010-01-25 with total page 287 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Supreme Court's 1857 Dred Scott decision denied citizenship to African Americans and enabled slavery's westward expansion. It has long stood as a grievous instance of justice perverted by sectional politics. Austin Allen finds that the outcome of Dred Scott hinged not on a single issue—slavery—but on a web of assumptions, agendas, and commitments held collectively and individually by Chief Justice Roger B. Taney and his colleagues. Allen carefully tracks arguments made by Taney Court justices in more than 1,600 reported cases in the two decades prior to Dred Scott and in its immediate aftermath. By showing us the political, professional, ideological, and institutional contexts in which the Taney Court worked, Allen reveals that Dred Scott was not simply a victory for the Court's prosouthern faction. It was instead an outgrowth of Jacksonian jurisprudence, an intellectual system that charged the Court with protecting slavery, preserving both federal power and state sovereignty, promoting economic development, and securing the legal foundations of an emerging corporate order—all at the same time. Here is a wealth of new insight into the internal dynamics of the Taney Court and the origins of its most infamous decision.
