The supreme law, that is, the general plan of American government, was amended, and many causes of irritation, and the princi pal cause of contest, were removed. The vast change caused by this reorganization is narrated in the third volume. Its great theme is emancipation and the exten sion of the suffrage. Book excerpt: Excerpt from Commentaries on the Constitution of the United States, Vol. 1 of 3: With a Preliminary Review of the Constitutional History of the Colonies and States, Before the Adoption of the Constitution Imperfect, however, as these Commentaries may seem to those, who are accustomed to demand a perfect finish in all elementary works, they have been attended with a degree of uninviting labour, and dry research, of which it is scarcely possible for the general reader to form any adequate estimate. Many of the materials lay loose and scattered; and were to be gathered up among pamphlets and discussions of a tempo rary character; among obscure private and public documents and from collections, which required an exhausting diligence to master their contents, or to select from unimportant masses, a few facts, or a solitary argument. Indeed, it required no small labour, even after these sources were explored, to bring together the irregular fragments, and to form them into groups, in which they might illustrate and support each other. Book excerpt: Excerpt from Constitutional History of the United States, From Their Declaration of Independence, to the Close of Their Civil War, Vol. 1 of 2 If the historical accuracy of my former work has ever been called in question, I have not been aware of it. Nor have I met with anything in the writings of other authors who have Since treated the same subject which has led me to doubt the correct ness of my statements, or the soundness of my interpretations. The work to which I refer has been so often consulted and relied upon by those who have had to construe the Constitution that I may be pardoned for believing that it is reliable. I have, there fore, retained the whole of my former text, unchanged, excepting in a very few matters of mere style, and have incorporated the two volumes of the original work in the first volume of the pres ent history. A full and minute index was added to the second volume of the former work. This I have repeated at the end of the first volume of the new work, and have made a new index for the second volume. It seemed to me that this would be more convenient to readers than it would be to incorporate the former index with the new one. Book excerpt: When the first two volumes of William Crosskey's monumental study of the Constitution appeared in 1953, Arthur M. Schlesinger called it "perhaps the most fertile commentary on that document since The Federalist papers." It was highly controversial as well. The work was a comprehensive reassessment of the meaning of the Constitution, based on examination of eighteenth-century usages of key political and legal concepts and terms. Crosskey's basic thesis was that the Founding Fathers truly intended a government with plenary, nationwide powers, and not, as in the received views, a limited federalism. This third volume of Politics and the Constitution, which Crosskey began and William Jeffrey has finished, treats political activity in the period 1776-87, and is in many ways the heart of the work as Crosskey conceived it. In support of the lexicographic analysis of volumes 1 and 2, volume 3 shows that nationalist ideas and sentiments were a powerful force in American public opinion from the Revolution to the eve of the Constitutional Convention. The creation of a generally empowered national government in Philadelphia, it is argued, was the fruition of a long-active political movement, not the unintended or accidental result of a temporary conservative coalition. This view of the political background of the Constitutional Convention directly challenges the Madisonian-Jeffersonian orthodoxy on the subject. In support of his interpretation, Crosskey amassed a wealth of primary source materials, including heretofore unexplored pamphlets and newspapers. This exhaustive research makes this unique work invaluable for scholars of the period, both for the primary sources collected as well as for the provocative interpretation offered.

Book excerpt: Excerpt from A Short Constitutional History of the United States The basis of this book is the material consulted in the preparation of the author's larger works, - "A Constitutional History of the American People, 1776- 1850," and "The Constitutional History of the United States, 1765-1895," - the former a narrative of the civil development of the states; the latter, of the federal union. The present volume narrates the constitutional history both of the Union and of the states, showing the common basis of American local and general government. In a book of small compass, adapted to those who desire the essentials of our civil development, it has seemed sufficient if there were related, (1) the origin of our civil system; (2) the principles on which it is founded; (3) the adaptation of the plan of government to public needs, by amendment and construction; and, (4) the interpretation of the principles of the government by the supreme tribunal, - the courts. The chapters on the state constitutions treat of a subject too much neglected. A study of the subject quickly reveals its importance. Useful for its early twentieth-century Northern perspective, Volumes I and II relate the framing and adoption of the Constitution and the first ten amendments. Volume III recounts the history of the Civil War amendments. Francis Newton Thorpe [1857-1926] was a Professor of American Constitutional History at the University of Pennsylvania and the author of numerous works including The Spoils of Empire (1903), The Civil War: The National View (1906) and The Federal and State Constitutions, Colonial Charters, and Other Organic Laws of the State, Territories, and Colonies Now or Heretofore Forming the United States of America (1909). "The account of the formation and adoption of the Constitution and the early amendments is very complete. The votes in the Constitutional Convention are carefully recorded, the debates there and in the ratifying conventions fully summarized, and the sources of each provision noted. The same method is pursued with all the amendments." --H.L.B., Harvard Law Review 14 (1900-01) 553
