Their answer is, the danger which would accrue to good government from universal suf frage. It would seem to devolve upon them to show that we do possess an exceptionally superior government, that our elections are purer, and our public servants better, than those of other Commonwealths, where the franchise is free. This they cannot do. On the contrary, during the twenty years that Rhode Island has been ruled by a minority, corruption in politics has been rife - as bad, perhaps worse, in proportion to the num ber of inhabitants, than in any other State. We have proved no exception to the rule that the pocket borough is the most easily bought and sold, a fact which furnishes a strong argument why, since our borders cannot be extended, we should increase the voting population by broadening the basis of suffrage. As to the quality of our public servants, suffice it to say that during the twenty years past of the men who have been sent to Con gress one only, Hon. Thomas A. J enckes, has acquired an enviable national reputation, while other States, with no better material for stat-es men, have been represented during all that period by one or more men of international fame. They were not intended as literary or didactic treatises. They relate to a subject of no slight importance in the history and institutions of our American States, settled indeed in many, yet undetermined in some, - a subject upon which but little has been written. An English nobleman, than whom no one in foreign lands is more instructed, very recently told an American citizen that he was not able to find anything in print upon the subject of the mode of changing the American State constitutions. Jameson had indeed, in his work upon conventions, written some years since, given attention to the subject. But our works upon general constitutional law hardly refer to it. The action of our States has not yet passed into written history. The purpose of the compilation is to show that there are at least two methods of constitutional change in a State constitution; the first and original one consisting in the action of a convention of delegates elected by the people to frame a new or amended constitution, and the adoption of such new constitution by vote of a majority of the people of the State; all the proceedings being conducted pursuant to a law passed by the existing government. The second method arises from an express provision of an existing constitution (first introduced about 1820), which authorizes a legislature, with certain precautions, to propose amendments of the constitution to the people, to be determined by their majority vote. Neither Providence nor Rhode Island was invited to enter the union, nor was a direct request from them destined to receive a favorable reply. On the eve of what might have proved a serious Indian war, the only concession to be gained was permission for Newport to buy one barrel of powder. Even this was denied to Providence. Indications that the United Colonies would soon substitute aggression for Simple non-intercourse, was a potent factor in bringing about a union under a patent from the home government. The band of settlers at Moshassuck had no intention of founding a state. Their early organization was that of a town, composed of joint proprietors dwelling apart from any regularly constituted authority. Their government was a pure democracy. The householders met once a week to consult on the common peace, watch and planting. Mutual consent, says Williams, have finished all matters with speed and peace.2 The first written compact entered into declared for government by the majority.3 When a modification was found necessary, the sparing hand with which power was delegated is remarkable. Five Dis posers were elected to have charge of the proprietary and governmental interests of the town. These officers were elected for the term of three months, at the end of which time they were to give an account of their doings to the town. Any one aggrieved by the action of the disposers might appeal to the town in town meeting. Private disputes were settled by arbitration.' Ial criminal prosecutions, the accused shall enjoy the privilege of a speedy and public trial, by an im partial jury; to be informed of the nature and cause of the accusation, to be confronted with the witnesses against him, to have compulsory process for obtaining them in his favor, and to have the assistance of counsel in his de fence, and be at liberty to speak for himself; nor shall he be deprived of life, liberty, or property, unless by the judgment of his peers, or the law of the land. Sec. 7. The person of a debtor, where there is not strong presumption of fraud, ought not to be continued in prison, after he shall have delivered up his property for the benefit of his creditors, in such manner as shall be prescribed by law. Sec. 8. No {retrospective, or] ex post facto law, or law impairing the obligation of contracts, shall be made. Sec. 9. No man in a court of common law shall be compelled to give evidence criminating himself. Sec. 10. Every man being presumed innocent, until pronounced guilty by the law, all acts of severity, that are not necessary to secure an accused person, shall be re pressed.
