Available in PDF, EPUB and Kindle. Book excerpt: "In gathering the information needed to write this book, the authors came to appreciate several themes. First, the Colorado Constitution and case law offer a novel and refreshing perspectives on the history of the state. Most major social movements, crises, embarrassments and celebrations ended up in state courts, with a constitutional argument by at least one major participant. The courts' role was often decisive and occasionally miscast in traditional histories. Second, over long stretches of time the Colorado Supreme Court's performance was less than exemplary. The original three-judge court in the 1880s launched the judicial branch very well, and the modern court is professional and conscientious. During many other periods, the court was blatantly partisan and at times, well, just zany. The court's relationship to the legislature vacillated from too little deference, such as the court's pro-business and anti-labor stance during the 1890-1920 period or the court's strange interference with relief for the poor during the Depression, to too much deference, such as the court's blessing after 1905 of numerous taxing and debt schemes pushed by the legislature to subsidize a variety of private industries. The framers' rules for the structure and processes of government, however, have held up and continue to serve. Since the 1850s this beautiful spot of geography has been witness to a turbulent, tumultuous, occasionally violent boom-and-bust style of human society that continues. For residents it has been and is life in high, unpredictable winds"--

The second edition includes an updated history of the constitution that focuses on events and amendments that have transformed the state in recent years including population growth, background and interpretations of Colorado's complex and unique tax revolt, known as TABOR, the state's extensive provisions for direct democracy, the initiative, veto referendum, and recall of elected officials. The Oxford Commentaries on the State Constitutions of the United States is an important series that reflects a renewed international interest in constitutional history and provides expert insight into each of the 50 state constitutions. Each volume in this innovative series contains a historical overview of the state's constitutional development, a section-by-section analysis of its current constitution, and a comprehensive guide to further research. His presence is still felt today. He had a special magnetism- flair, aspirations to great deeds, and contagious confidence. And his tenure in the White House occurred in the midst of dramatic world events and personalities. After an initial honeymoon with historians, many of whom were seduced by the Camelot myth, in recent years Kennedy has been more carefully scrutinized, resulting in a wide range of assessments of his presidency and his life.

Available in PDF, EPUB and Kindle. Book excerpt: Colorado has recently been at the center of major shifts in American politics. Indeed, over the last several decades the political landscape has altered dramatically on both the state and national levels. State of Change traces the political and demographic factors that have transformed Colorado, looking beyond the major shift in the dominant political party from Republican to Democratic to greater long-term implications. The increased use of direct democracy has resulted in the adoption of term limits, major reconstruction of fiscal policy, and many other changes in both statutory and constitutional law. Individual chapters address these changes within a range of contexts--electoral, political, partisan, and institutional--as well as their ramifications. Contributors also address the possible impacts of these changes on the state in the future, concluding that the current state of affairs is fated to be short-lived. State of Change is the most up-to-date book on Colorado politics available and will be of value to undergraduate- and graduate-level students, academics, historians, and anyone involved with or interested in Colorado politics.

Available in PDF, EPUB and Kindle. Book excerpt: Colorado Legal Research guides researchers through the resources and methods of Colorado legal materials. It describes the organization of the Colorado legal system, including the type of law that each branch creates and where it is published. Readers will learn how to find current and historical Colorado statutes; locate Colorado case law; use Colorado's online database to find Colorado regulations; research local government law; and formulate searches to efficiently and effectively locate law in databases. Researchers will also learn how to use Colorado practice materials and other resources to understand the law. The second edition builds upon the foundation of the first edition by expanding the coverage of research topics and methods. In Part I, researchers will find a new chapter on citator research and expanded and revised chapters on Colorado regulatory research and legislative history research, both of which are particularly challenging in Colorado. In Part II, readers will find step-by-step guides with illustrations on researching primary and secondary authority. The text covers all of the major legal database providers including Bloomberg Law and Casemaker, the legal research database of the Colorado Bar Association. It also shows how to use Colorado government websites to find the law. Colorado Legal Research goes beyond resources and methods to present an overall framework through which to carry out legal research assignments. The framework provides suggestions on how to analyze and conceptualize legal research problems, and offers pointers on how to understand legal research concepts and publishing techniques to identify and navigate the underlying legal research system. The clear explanations of resources and methods coupled with illustrations will make Colorado Legal Research useful for all researchers of Colorado law. This book is part of the Legal Research Series, edited by Tenielle Fordyce-Ruff, Director of the Legal Research and Writing Program, Concordia University School of Law.

Available in PDF, EPUB and Kindle. Book excerpt: Colorado Constitutional Law and History provides students, lawyers, and citizens with historical background, case precedents, and practical analysis of the entire state Constitution. While the U.S. Constitution is terse, the Colorado Constitution is detailed and prescriptive. It covers topics as diverse as gambling, mining, schoolchildren's textbooks, and old age pensions. Adopted in 1876, the Colorado Constitution was the longest that had ever been written. It is even longer today, thanks to the many amendments created via the people's rights of initiative and referendum. When settlement from "the States" began in the 1858 gold rush, Coloradans spontaneously created their own ad hoc governments. Colorado's Constitution later declared Coloradans' "sole and exclusive right of governing themselves." The independent spirit has continued to the present, including in the modern constitutional amendments that defied federal marijuana prohibition. Past and present, Coloradans have wanted an active government, and have also expected that the people in the government will abuse their powers. Colorado's unusually detailed state Constitution is Coloradans' continuing effort to keep government officials under the people's control. Yet over two dozen sections of the Colorado Constitution have been nullified by the Colorado supreme court or by other branches of state government. The majority of nullified sections involve the Constitution's rules against special government aid to politically powerful businesses, and the rules allowing taxation and debt only by voter consent. Colorado Constitutional Law and History describes the successes and failures in the people's attempts to use the Colorado Constitution to regulate governments in Colorado, and to protect Coloradans' rights of governing themselves.

Available in PDF, EPUB and Kindle. Book excerpt: When we think of constitutional law, we invariably think of the United States Supreme Court and the federal court system. Yet much of our constitutional law is not made at the federal level. In 51 Imperfect Solutions, U.S. Court of Appeals Judge Jeffrey S. Sutton argues that American Constitutional Law should account for the role of the state courts and state constitutions, together with the federal courts and the federal constitution, in protecting individual liberties. The book tells four stories that arise in four different areas of constitutional law: equal protection; criminal procedure; privacy; and free speech and free exercise of religion. Traditional accounts of these bedrock debates about the relationship of the individual to the state focus on decisions of the United States Supreme Court. But these explanations tell just part of the story. The book corrects this omission by looking at each issue-and some others as well-through the lens of many constitutions, not one constitution; of many courts, not one court; and of all American judges, not federal or state judges. Taken together, the stories reveal a remarkably complex, nuanced, ever-changing federalist system, one that ought to make lawyers and litigants pause before reflexively assuming that the United States Supreme Court alone has all of the answers to the most vexing constitutional questions. If there is a central conviction of the book, it's that an underappreciation of state constitutional law has hurt state and federal law and has undermined the appropriate balance between state and federal courts in protecting individual liberty. In trying to correct this imbalance, the book also offers several ideas for reform.
