Book excerpt: Excerpt from The Canadian Franchise Act, With Notes of Decisions on the Imperial Acts Relating to Registration, and on the Provincial Franchise and Election Acts: With an Appendix, Containing the Provincial Franchises of Ontario, Quebec, Nova Scotia, New Brunswick, Manitoba, British Columbia, and Prince Edward Island The object of this book is to provide a full summary of the law affecting all classes of cases relating to the Electoral Franchise, which. Are likely to arise under the Canadian Act of 1885. The annotations aim at embodying all the leading cases which have: been decided under analogous statutes in England, and in the various Provinces supplying such brief comments as may be useful. References have also been made to decisions in the American Courts, where they add to the force of, and further illustrate, the English cases. The notes of cases illustrating the meaning of the terms resi dence and actual occupation, - Which constitute an important element in the qualification of voters, - have been made very full. It may be found difficult in a few instances to harmonize some of. The English judicial decisions referred to in the notes. The excuse of. Brett, L. J. (now Lord Esher, M. R.) will perhaps explain the reason I can only answer that if Judges seem to talk nonsense, it is because. Parliament has written nonsense: Bradley V. Baylis, 8 Q. B. D. 235. Book excerpt: This book explains why Canadians must rid themselves of interprovincial trade barriers. Canada's provinces do almost as much trade with each other as they do with the rest of the world. But trade between the provinces is harder than with foreign countries. We trouble our own house with an amazing variety of barriers: professionals and tradespeople cannot move freely and practice where they wish, regulation makes it hard for investments to flow to where they are most needed, provincial governments give contracts to local firms even though out-of-province firms can do the job at a lower cost, Ottawa pays the most generous UI to regions with the highest unemployment and thereby encourages people to stay in parts of the country with little promise. The effects of such barriers on the economy are difficult to measure, which may be the reason that little has been done about them. But Canadians cannot afford to ignore their costs. The European Community is very close to the goal of ensuring free trade among its members. Unless we unlock our potential we may fall behind other countries and communities that have recognized the importance of internal as well as external free trade.

Book excerpt: Joseph Maingot describes the parameters of the principal immunity enjoyed by Members of Parliament, that of freedom of speech, which is restricted to the context of a parliamentary proceeding and not beyond. He points out protections afforded members other than parliamentary privilege and the view of both the courts and the legislatures concerning parliamentary debates and proceedings as evidence in court. He also sets out in detail what the House of Commons considers to be and not to be a matter of privilege, as well as the corporate powers of the Houses of Parliament.

Book excerpt: This document, originally written in 1978, is a comprehensive report on the traditional forms of justice among Aboriginal peoples across Canada and the impact that western settlement had on those systems. It begins with a chapter on traditional justice among the Micmac and Naskapi. Part 2 covers the struggle for power as Europeans invaded traditional Aboriginal lands, and includes descriptions of civilizations & traditional justice of the First Nations of the central regions (Ojibwe, Iroquois, Huron). Part 3 covers traditional & European justice in the British colonial period, 1763-1867. Part 4 reviews the effect of Canadian legislation on Native peoples after Confederation, especially in the western provinces, and the numerous rebellions & protest actions against injustice. The final part covers the period from the granting of the unconditional franchise to Aboriginal peoples and the various movements for Aboriginal rights and a reformed justice system.

Book excerpt: The impact of colonial dispossession and the subsequent social and political ramifications places a unique burden on governments having to establish equitable means of addressing previous injustices. This book considers the efforts by both Canada and South Africa to reconcile the damage left by colonial expansion, in part, looking back with a critical eye, but also pointing the way towards a solution that will satisfy the common need for human dignity

Book excerpt: For over 130 years, Imperial Oil dominated Canada's oil industry. Their 1947 discovery of crude oil in Leduc, Alberta transformed the industry and the country. But from 1899 onwards, two-thirds of the company was owned by an American giant, making Imperial Oil one of the largest foreign-controlled multinationals in Canada. Imperial Standard is the first full-scale history of Imperial Oil. It illuminates Imperial's longstanding connections to Standard Oil of New Jersey, also known as Exxon Mobil. Although this relationship was often beneficial to Imperial, allowing them access to technology and capital, it also came at a cost, causing Imperial to be assailed as the embodiment of foreign control of Canada's natural resources. Graham D. Taylor draws on an extensive collection of primary sources to explore the complex relationship between the two companies. This groundbreaking history provides unprecedented insight into one of Canada's most influential oil companies as it has grown and evolved with the industry itself.

Book excerpt: The relationship between the individual and the collective has been the major force in human life from time immemorial but the character of that relationship has evolved over time. In one dark corner of this long drama, a special case of the relationship between individual and collective has been playing out in Canada in the lives of Native Indians. In this particular corner, the collective assumes an importance unthinkable in the mainstream. Indian policy, imposed by the mainstream on some Canadians - "Indians" - has built for them a world that is both a fortress and a prison. The effects on the individuals within that system have been profound.

Available in PDF, EPUB and Kindle. Book excerpt: Canada is covered by a system of law and governance that largely obscures and ignores the presence of pre-existing Indigenous regimes. Indigenous law, however, has continuing relevance for both Aboriginal peoples and the Canadian state. In his in-depth examination of the continued existence and application of Indigenous legal values, John Borrows suggests how First Nations laws could be applied by Canadian courts, and tempers this by pointing out the many difficulties that would occur if the courts attempted to follow such an approach. By contrasting and comparing Aboriginal stories and Canadian case law, and interweaving political commentary, Borrows argues that there is a better way to constitute Aboriginal / Crown relations in Canada. He suggests that the application of Indigenous legal perspectives to a broad spectrum of issues that confront us as humans will help Canada recover from its colonial past, and help Indigenous people recover their country. Borrows concludes by demonstrating how Indigenous peoples' law could be more fully and consciously integrated with Canadian law to produce a society where two world views can co-exist and a different vision of the Canadian constitution and citizenship can be created.
