This book was released on 2015-03-08 with total page 966 pages. Available in PDF, EPUB and Kindle. Book excerpt: Issues of the war that have provoked public controversy and legal debate over the last two years—the Cambodian invasion of May-June 1970, the disclosure in November 1969 of the My Lai massacre, and the question of war crimes—are the focus of Volume 3. As in the previous volumes, the Civil War Panel of the American Society of International Law has endeavored to select the most significant legal writing on the subject and to provide, to the extent possible, a balanced presentation of opposing points of view. Parts I and II deal directly with the Cambodian, My Lai, and war crimes debates. Related questions are treated in the rest of the volume: constitutional debate on the war; the distribution of functions among coordinate branches of the government; the legal status of the insurgent regime in the struggle for control of South Vietnam; prospects for settlement without a clear-cut victory; and Vietnam's role in general world order. The articles reflect the views of some forty contributors: among them, Jean Lacouture, Henry Kissinger, John Norton Moore, Quincy Wright, William H. Rhenquist, and Richard A. Falk. Originally published in 1972. Book excerpt: When American and South Vietnamese forces, led by General Creighton Abrams, launched an attack into neutral Cambodia in 1970, the invasion ignited a firestorm of violent antiwar protests throughout the United States, dealing yet another blow to Nixon's troubled presidency. But, as John Shaw shows, the campaign also proved to be a major military success. Most histories of the Vietnam War either give the Cambodian invasion short shrift or merely criticize it for its political fallout, thus neglecting one of the campaign's key dimensions. Approaching the subject from a distinctly military perspective, Shaw shows how this carefully planned and executed offensive provided essential support for Nixon's "decent interval" and "peace with honor" strategies-by eliminating North Vietnamese sanctuaries and supply bases located less than a hundred miles from Saigon and by pushing Communist troops off the Vietnamese border. Despite the political cloud under which the operation was conducted, Shaw argues that it was not only the best of available choices but one of the most successful operations of the entire war, sustaining light casualties while protecting American troop withdrawal and buying time for Nixon's pacification and "Vietnamization" strategies. He also shows how the United States took full advantage of fortuitous events, such as the overthrow of Cambodia's Prince Sihanouk, the redeployment of North Vietnamese forces, and the late arrival of spring monsoons. Although critics of the operation have protested that the North Vietnamese never did attack out of Cambodia, Shaw makes a persuasive case that the near-border threat was very real and imminent. In the end, he contends, the campaign effectively precluded any major North Vietnamese military operations for over a year. Based on exhaustive research and a deep analysis of the invasion's objectives, planning, organization, and operations, Shaw's shrewd study encourages a newfound respect for one of America's genuine military successes during the war.

Book excerpt: From the historic launch of the organization by such luminaries as Elihu Root and Charles Evans Hughes, to the recent era when international law is more and more in the public realm, Kirgis's book traces the evolution of the organization and its relationship to events in the United States and around the world. As he says in the preface: "'...In the end, the reader will have to make his/her own judgment about how well the Society has run the course it set out for itself in 1906. I hope this book will provide a basis for that judgment. And of course no judgment at this stage can be final. The American Society of International Law will carry on into its second century with new and continuing programs that take into account what it has done in its first one hundred years. It will continue to do its best to demonstrate not only what international law is or should be, but also that, in the words of former ASIL President Louis Henkin, international law matters.'"

Book excerpt: This concluding volume of The Vietnam War and International Law focuses on the last stages of America's combat role in Indochina. The articles in the first section deal with general aspects of the relationship of international law to the Indochina War. Sections II and III are concerned with the adequacy of the laws of war under modern conditions of combat, and with related questions of individual responsibility for the violation of such laws. Section IV deals with some of the procedural issues related to the negotiated settlement of the war. The materials in Section V seek to reappraise the relationship between the constitutional structure of the United States and the way in which the war was conducted, while the final section presents the major documents pertaining to the end of American combat involvement in Indochina. A supplement takes account of the surrender of South Vietnam in spring 1975. Contributors to the volume—lawyers, scholars, and government officials—include Dean Rusk, Eugene V. Rostow, Richard A. Falk, John Norton Moore, and Richard Wasserstrom. Originally published in 1976. Book excerpt: This collection of scholarly and critical essays about the legal aspects of the Vietnam War explores various crimes committed by the United States against North Vietnam: war of aggression; war crimes in bombing civilian targets such as schools and hospitals, and using napalm, cluster bombs, and Agent Orange; crimes against humanity in moving large parts of the population to so-called strategic hamlets; and alleged genocide and ecocide. International lawyer Richard Falk, who observed these acts personally in North Vietnam in 1968, uses international law to show how they came about. This book brings together essays that he has written on the Vietnam War and on its relationship to international law, American foreign policy, and the global world order. Falk argues that only a stronger adherence to international law can save the world from such future tragedies and create a sustainable world order.
