When the store's only other customer made her purchase and left, the youth strolled to the checkout counter, pulled a .357 revolver out of his jacket, pointed it at the clerk and ordered the frightened boy to lie down on the floor. He grabbed the $87 that was in the cash register and ran for the door, where he collided with an elderly woman trying to enter. At the sight of his weapon she fainted to the sidewalk. Her next week would be spent in Grady Hospital recovering from what was called a slight heart attack. The robber reached his car parked beside the curb, but even before he could get it started the police had been flagged down by an onlooker and were in the parking lot. Their quarry surrendered meekly; he was handcuffed and carried downtown. In a darkened apartment, the lights turned off for nonpayment, his wife and child were left without support. It was almost a routine event. An armed robbery occurs every few hours in Atlanta. The damage was relatively slight in this case: a woman temporarily hospitalized, a trembling store clerk vowing that he will quit his job as soon as he can find another way to pay his college tuition. The "suspect in custody" received 10 years in prison, but he had been there before. He was nine years old the first time he got busted, for stealing a baseball bat, and he spent three months in a Dekalb County juvenile facility waiting for the court to find him a foster home. Now his record, as the police say, is as long as your arm.

In the groundbreaking decision Griggs v. Duke Power (1971), the United States Supreme Court ruled in favor of the plaintiffs, finding such employment practices violated Title 7 of the Civil Rights Act of 1964 when they disparately affected minorities. In doing so, the court delivered a significant anti-employment discrimination verdict. Legal scholars rank Griggs v. Duke Power on par with Brown v. Board of Education (1954) in terms of its impact on eradicating race discrimination from American institutions. In Race, Labor, and Civil Rights, Robert Samuel Smith offers the first full-length historical examination of this important case and its connection to civil rights activism during the second half of the 1960s. Smith explores all aspects of Griggs, highlighting the sustained energy of the grassroots civil rights community and the critical importance of courtroom activism. Duke Power Co., brought by thirteen African American employees who worked as common laborers and janitors at one of Duke Power’s facilities. The decision, in plaintiffs’ favor, marked a profound and enduring challenge to the dominance of white males in the workplace. In this book, Robert Belton, who represented the plaintiffs for the NAACP Legal Defense Fund and argued the case in the lower courts, gives a firsthand account of legal history in the making—and a behind-the-scenes look at the highly complex process of putting civil rights law to work. Title VII of the Civil Rights Act of 1964 eliminated much blatant discrimination, but after its enactment and before Griggs, businesses held the view that a commitment to equality required only eliminating policies and practices that were intentionally discriminatory—the "disparate treatment" test. In Griggs v. Duke Power Co., the Supreme Court ruled that a "disparate impact" test could also apply—that the 1964 Civil Rights Act extended to practices with a discriminatory effect. In tracing the impact of the Griggs ruling on employment practices, this book documents the birth, maturation, death, and rebirth of the disparate impact theory, including its erosion by later Supreme Court decisions and its restoration by congressional action in the Civil Rights Act of 1991. Belton conducts us through this historic case from the original lawsuit to the Supreme Court decision in Griggs and beyond as he traces the post-Griggs developments in the lower courts, the Supreme Court, and Congress; he provides informed insights into both litigators' and judges' perspectives and decision-making.
