Book excerpt: Excerpt from The Bench and Bar of Georgia, Vol. 2: Memoirs and Sketches, With an Appendix, Containing a Court Roll From 1790 to 1857, Etc The next question which agitated the country was the removal of the public deposits from the Bank of the United States, and the dismissal from office of Mr. Duane, because, as Secretary of the Treasury, he refused to sign the order. This proceeding took place in September, 1833. Mr. Taney, then attorney-general, was next appointed Secretary of the Treasury, who made the order as resolved upon by the Cabinet paper which President Jackson refused to submit to the Senate after being requested, by a formal resolution of that body, to communicate a copy. He would not recognise the authority of the Senate to inquire into or supervise his Cabinet consultations. For these he was responsible to the country in the general exercise of his duties, and to no other tribunal. In the war which ensued between the President and the Senate. Book excerpt: Los Angeles Times Book Prize Finalist in History A dramatic work of historical detection illuminating one of the most significant—and long forgotten—Supreme Court cases in American history. In 1820, a suspicious vessel was spotted lingering off the coast of northern Florida, the Spanish slave ship Antelope. Since the United States had outlawed its own participation in the international slave trade more than a decade before, the ship's almost 300 African captives were considered illegal cargo under American laws. But with slavery still a critical part of the American economy, it would eventually fall to the Supreme Court to determine whether or not they were slaves at all, and if so, what should be done with them. Bryant describes the captives' harrowing voyage through waters rife with pirates and governed by an array of international treaties. By the time the Antelope arrived in Savannah, Georgia, the puzzle of how to determine the captives' fates was inextricably knotted. Set against the backdrop of a city in the grip of both the financial panic of 1819 and the lingering effects of an outbreak of yellow fever, Dark Places of the Earth vividly recounts the eight-year legal conflict that followed, during which time the Antelope's human cargo were mercilessly put to work on the plantations of Georgia, even as their freedom remained in limbo. When at long last the Supreme Court heard the case, Francis Scott Key, the legendary Georgetown lawyer and author of "The Star Spangled Banner," represented the Antelope captives in an epic courtroom battle that identified the moral and legal implications of slavery for a generation. Four of the six justices who heard the case, including Chief Justice John Marshall, owned slaves. Despite this, Key insisted that "by the law of nature all men are free," and that the captives should by natural law be given their freedom. This argument was rejected. The court failed Key, the captives, and decades of American history, siding with the rights of property over liberty and setting the course of American jurisprudence on these issues for the next thirty-five years. The institution of slavery was given new legal cover, and another brick was laid on the road to the Civil War. The stakes of the Antelope case hinged on nothing less than the central American conflict of the nineteenth century. Both disquieting and enlightening, Dark Places of the Earth restores the Antelope to its rightful place as one of the most tragic, influential, and unjustly forgotten episodes in American legal history.

Book excerpt: Published in 1948, this work provides a detailed account of the constitutional history of Georgia from the Charter of 1732 to the adoption of the Constitution of 1945 and includes an analysis of the 1948 Georgia Constitution. Albert B. Saye presents the major constitutional developments in chronological order. An index allows readers to compare different aspects of Georgia's eight constitutions, such as the composition of the General Assembly, the powers of the Governor, and the jurisdiction of the Courts. Based on extensive research of original sources, A Constitutional History of Georgia reveals the evolution of the Georgia constitution up to 1948 as a gradual expansion of political democracy.

Book excerpt: The 526 documents printed in this volume run from 28 November 1813 to 30 September 1814. During this period Jefferson reviews the extant sources on the 1765 Stamp Act crisis to aid William Wirt, a Patrick Henry scholar; records his largely positive impressions of George Washington; and updates a reading list for law students that he had initially drawn up forty years earlier. In the spring of 1814 Jefferson becomes a trustee of the Albemarle Academy, the earliest direct ancestor of the University of Virginia. He is soon actively involved in planning for its establishment, helping to draft rules for governance of the academy's trustees and propose funding options, and he lays out an expansive vision for its future as an institution of higher learning. Jefferson also exchanges ideas on collegiate education with such respected scholars as Thomas Cooper and José Corrêa da Serra. Jefferson's wide-ranging correspondence includes a temperate response to a lengthy letter from Miles King urging the retired president to reflect on his personal religion, and a diplomatic but noncommittal reply to a proposal by Edward Coles that the author of the Declaration of Independence employ his prestige to help abolish slavery. Having learned of the British destruction late in August 1814 of the public buildings in Washington, Jefferson offers his massive book collection as a replacement for the Library of Congress. The nucleus for one of the world's great public libraries is formed early in 1815 when the nation purchases Jefferson's 6,707 volumes.
