Book excerpt: In each of the first three editions of the bestselling Law 101, Jay Feinman gave readers an upbeat and vivid examination of the American legal system. Since the third edition was published in 2010, much has happened: several key Supreme Court cases have been decided, we've seen sensational criminal trials, and the legal system has had to account for the latest developments in Internet law. This fully updated fourth edition of Law 101 accounts for all this and more, as Feinman once again provides a clear introduction to American law. The book covers all the main subjects taught in the first year of law school, and discusses every facet of the American legal tradition, including constitutional law, the litigation process, and criminal, property, and contracts law. To accomplish this, Feinman brings in the most noteworthy, infamous, and often outrageous examples and cases. We learn about the case involving scalding coffee that cost McDonald's half a million dollars, the murder trial in Victorian London that gave us the legal definition of insanity, and the epochal decision of Marbury vs. Madison that gave the Supreme Court the power to declare state and federal law unconstitutional. A key to learning about the law is learning legal vocabulary, and Feinman helps by clarifying terms like "due process" and "equal protection," as well as by drawing distinctions between terms like "murder" and "manslaughter." Above all, though, is that Feinman reveals to readers of all kinds that despite its complexities and quirks, the law is can be understood by everyone. Perfect for students contemplating law school, journalists covering legislature, or even casual fans of "court-television" shows, Law 101 is a clear and accessible introduction to the American legal system. New to this edition: Featured analysis of: -the Obamacare case -Citizens United -the DOMA decision -the Trayvon Martin case As well as recent legal developments pertaining to: -online contracting -mortgages -police investigations -criminal sentencing

This book was released on 2017-10-31 with total page 522 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Mississippi Law Journal, 1928, Vol. 1 The fundamental purpose of the journal is to perform a distinct and valuable service, (a) to the bar of the state by creating a forum Where interesting and Vital legal ques tions of a helpful nature to the profession and the judiciary of the state may be discussed. A forum in which matters peculiarly of interest to the lawyers and law students may find expression. It is true the bar of the state and the law students have had the benefits of great law journals, such as the American Bar J ournal and others of like nature, but these publications do not and can not take care of the local needs. One feature of the journal which should appeal to the bar will be the publication of the annotations of our decisions and statutes to the re-statement of the common law by the American Law Institute. A committee was ap pointed by the Bar Association at the Gulfport meeting charged with the duty of working out some plan where by our decisions and statutes might be annotated to thelaw as restated by the American Law Institute. The com mittee has been able to procure Chief J ustice Sidney Smith and Honorable George Butler of the J ackson Bar, together with members of the law faculty, to annotate our decisions and statutes to the subjects of the law already restated and those subjects partially restated by the American Law In stitute, namely, Conflict of Laws, Torts, Contracts, and Criminal Law. This feature of the journal alone should be of great value to the bar in Mississippi, especially, since the Mississippi Supreme Court will cite the re-statement of the law, (b) it will open a forum for the student of law who is not in the active practice, both in and out of the law school, for the discussion of timely and pertinent legal questions, together with comments on and criticisms of cases and questions of law passed upon by the Mississippi courts. These thought provoking legal discussions will be help ful to every progressive member of the bar. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Following its publication in 1974, Grant Gilmore's compact portrait of the development of American law from the eighteenth century to the mid-twentieth century became a classic. In this new edition, the portrait is brought up to date with a new chapter by Philip Bobbitt that surveys the trajectory of American law since the original publication. Bobbitt also provides a Foreword on Gilmore and the celebrated lectures that inspired The Ages of American Law. "Sharp, opinionated, and as pungent as cheddar."—New Republic "This book has the engaging qualities of good table talk among a group of sophisticated and educated friends—given body by broad learning and a keen imagination and spiced with wit."—Willard Hurst
