I shall therefore make no apology for presenting to the public this treatise on the law of Marine Collisions. The importance of the subject-matter, the pleasure I have derived in pursuing this line of investigation, are the only justification offered. I have endeavored to state what the general maritime law governing the navigation of shipping is, rather than what it should be, as viewed from my point of observation. I have, however, had occasion in a few instances to dissent from the established canons of the courts, where it has appeared to me the reasons for the same are obsolete, and that a different rule would be better. The necessity for such a series of manuals became evident when, as a result of the great war, the tonnage of vessels under the American Flag was, within a brief period, increased many fold. To carry on the war and to meet the demands of ocean commerce after the war, the United States Government, through the Shipping Board and private shipyards, brought into existence a large mercantile marine. If these ships are to continue in profitable operation under the American Flag, the people of the United States must be trained to operate them. Steamship companies, ship-brokers and freight-forwarders must all be able to secure men necessary to carry on the commercial and shipping activities that make use of the ships. A successful merchant marine requires ships, men to man the ships, and business organization to give employment to the vessels. Book excerpt: Excerpt from A Treatise on the Subject of Collisions Between Warships and Merchant Vessels: According to Humble Contribution as Unification of the Laws on the Subject Among the Maritime Nations of the World On the third day of the meeting of the International Maritime Law Conference in the month of July, 1899, in the Fishmonger's Hall, London, the author of this book proposed the following resolution: - "In the case of collision between a warship and a merchant vessel, the International Maritime Committee hopes the State to which the warship belongs will pay the damages according to the general principle of the Maritime Law." Although the proposal may seem somewhat audacious, practically meaning, as it did, changing the law of the whole maritime world on the subject, it was not, nevertheless, advanced without preparation. Since the collision, in the year 1892, between the Imperial Japanese cruiser "Chishima" and a P. & O. steamer, "Ravenna," in which the former sank with more than seventy officers and seamen, the author devoted special attention to this particular subject. He made a study of that case, in his capacity of a legal adviser to the Japanese Admiralty, and he has since examined many similar cases which have come before the European courts. I am the more induced to do so, as it would seem from your Lordship's letter that the question is still open to consideration; and I doubt not that discussion will, as your Lordship observes, "lead to a sound conclusion in the end." Your Lordship, on bringing in your Bill for the reform of the Judicature, is reported in the "Times" of the 14th ultimo to have expressed yourself as follows: - "In respect of collisions at sea, it is proposed to do away with a rule which now holds good in the Court of Admiralty, and to adopt in its stead the rule of Common Law, as being more applicable to the general principle of contributory fraud or contributory negligence. The rule of law is, that if the plain-"tiff is in the wrong he cannot recover from the Defendant, and if the Defendant is in the wrong he cannot recover from the plaintiff. But what the Court of Admiralty does is this: If two ships run into each other, and both go to the bottom, as I understand the practice, the Court of Admiralty adds the value of both ships, and then divides the total between the two parties; so that if I were the owner of a ship worth only 10,000l. and one of your Lordships was the owner of one worth 50,000l., you see how well I should fare in comparison with the owner of the better ship if both vessels went down after a collision."
