Book excerpt: Excerpt from A Treatise on the Law of Collisions at Sea Upon a former occasion I ventured to remark upon the growing complexity Of the Regulations. Since that date (1885) the alterations and pro posed alterations in the law have been in the direction, not of simplification, but further com plexity. It seems almost too much to expect a North Sea smacksman to apply With success such a law as Article 10 of the Regulations of 1884, as altered by Order in Council, and explained by The Ticeeclsdale. Book excerpt: Excerpt from A Treatise on the Subject of Collisions Between Warships and Merchant Vessels: According to Humble Contribution as Unification of the Laws on the Subject Among the Maritime Nations of the World On the third day of the meeting of the International Maritime Law Conference in the month of July, 1899, in the Fishmonger's Hall, London, the author of this book proposed the following resolution: - "In the case of collision between a warship and a merchant vessel, the International Maritime Committee hopes the State to which the warship belongs will pay the damages according to the general principle of the Maritime Law." Although the proposal may seem somewhat audacious, practically meaning, as it did, changing the law of the whole maritime world on the subject, it was not, nevertheless, advanced without preparation. Since the collision, in the year 1892, between the Imperial Japanese cruiser "Chishima" and a P. & O. steamer, "Ravenna," in which the former sank with more than seventy officers and seamen, the author devoted special attention to this particular subject. He made a study of that case, in his capacity of a legal adviser to the Japanese Admiralty, and he has since examined many similar cases which have come before the European courts. Book excerpt: Excerpt from The Rule of the Road at Sea and in Inland Waters, or Steering and Saiiling Rules: Collisions and Law of the Port Helm Ships' Lights, and the Rule of the Road, with Discussions; and the Regulations for Preventing Collisions at Sea, the Rules concerning Lights, and the Steering and Sailing Rules, with Diagrams. At about the same period Commanders P. H. Colomb and H W. Brent, H. B. M. Navy, published The Law of the Port Helm; An Examination into its History and Dangerous Action, with Suggestions for its Abolition, &c. These two publications, as well as others, including papers of William Sterling Lacon, Esq., on this important and interesting subject, have been largely drawn upon in the preparation of this work. The purpose being to provide, in as compact a form as possible, for the use of seamen in general in this country, and especially of the Navy, all attainable reliable facts and supposed sound arguments bearing upon the subject to guide them in arriving at correct conclusions, and to serve them in the hour of danger or need; no other apology need, therefore, be offered for any want of originality of language or thought that may appear. It will be observed that the Regulations for Preventing Collisions at Sea, issued in pursuance of the British Merchant Shipping Act, Amend ment Act of 1862, and which were adopted by act of Congress, approved 29th of April, 1864, have been slightly altered in phraseology by order in Council, dated January 9, 1863, (see Notes to Articles 2, 6, and 7 and by order in Council, dated August 4, 1868, (london Gazette, ) Articles 11 and 13 are explained. This latter order in Council being, as will be remarked, of a date subsequent to the papers and discussions above referred to, with the exception of the last paper, by T. Gray, Esq. (secretary to the -marine Department of the British Board of Trade, issued by authority September. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise, the Stability of Ships The Author has been induced to prepare this work by many considerations. In the first place, no general work upon the Stability of Ships exists, so far as he is aware, in our language, although several authors have treated the subject satisfactorily as parts of more comprehensive works. In the next place, both the science and the practice of the subject have recently undergone great developments, at home and abroad, the results being scattered over many and various publications; and it was undoubtedly desirable to bring them together, and place them into due relation to each other. Again, during the present, as during the last century, French investigators have taken a leading part in the extension of this branch of science, and it is essential to the sound education of English naval architects and others, that the results of their labours should be brought within easy reach. Finally, the number of persons who now are required, by their professional avocations in connection with ships, to obtain some knowledge of the doctrines of stability is so great, that this work may fairly be taken as a response, and a somewhat tardy response, to a demand which has long been felt for collected information on the subject, and which, during the last year, has become widespread and urgent. Book excerpt: Excerpt from A Treatise on the Rights and Duties of Merchant Seamen: According to the General Maritime Law, and the Statues of the United States The writer of this Treatise is no friend to the multiplication of law books. Yet he finds himself, at an early period, again about to commit to the public a legal publication, which, though it may need little in the way of introduction, to claim for its subject a ready attention, may require much in the way of apology for the manner in which it is treated. Having taken the persons employed in navigation out of the general law of Shipping, I sought to trace their rights and duties back to those venerable codes of the sea, in which the spirit of a thorough jurisprudence, such as might well relieve the middle ages of Europe from the epithet of "dark," seems to have been fully equal to all the wants of maritime affairs, as they existed at the time, and scarcely falls short of satisfying the exigencies of modern commerce. The pleasure of these investigations richly compensated for any labor. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books.
