Christian attempts to “correct” the standing constitutional order and reclaim marriage exclusively for heterosexuals will fail. The way forward is to advocate the replacement of civil marriage laws with civil unions for heterosexuals and homosexuals alike. Both Christians and secularists will find this alternative satisfying, for it allows everyone to receive from the state equal protection of their rights, and it allows the Church and other intermediary communal institutions to define and defend marriage as they have always understood it.

Clare Chambers shows how feminist and liberal principles require creation of a marriage-free state: one in which private marriages, whether religious or secular, would have no legal status. Part One makes the case against marriage. Chambers investigates the critique of marriage that has developed within feminist and liberal theory. Feminists have long argued that state-recognised marriage is a violation of equality. Chambers endorses the feminist view and argues, in contrast to recent egalitarian pro-marriage movements, that same-sex marriage is not enough to make marriage equal. The egalitarian case against marriage is the most fundamental argument of Against Marriage. But Chambers also argues that state-recognised marriage violates liberty, including the political liberal version of liberty that is based on neutrality between conceptions of the good. Part Two sets out the case for the marriage-free state. Chambers criticizes recent arguments that traditional marriage should be replaced with either a reformed version of marriage, such as civil partnership, or a purely contractual model of relationship regulation. She then sets out a new model for the legal regulation of personal relationships. Instead of regulating by status, the state should regulate relationships according to the practices they involve. Instead of regulating relationships holistically, assuming that relationship practices are bundled together in one significant relationship, the marriage-free state regulates practices on a piecemeal basis. The marriage-free state thus employs piecemeal, practice-based regulation. It may regulate private marriages, including religious marriages, so as to protect equality. But it takes no interest in defining or protecting the meaning of marriage.

Book excerpt: This book provides a comparative account of the abolition of concubinage in East Asia, offering a new perspective and revised analysis of the factors leading to – and the debates surrounding – the introduction of a new Marriage Reform Ordinance in Hong Kong in 1971. It uses this law as a platform to examine how the existence of concubinage – long preserved in the name of protecting Chinese traditions and customs — crucially influenced family law reforms, which were in response to a perceived need to create a ‘modern’ marriage system within Hong Kong’s Chinese community after the Second World War. This was, by and large, the result of continued pressure from within Hong Kong and from Britain to bring Hong Kong’s marriage system in line with international marriage treaties. It represented one of the last significant intrusions of colonial law into the private sphere of Hong Kong social life, eliminating Chinese customs which had been previously recognised by the colonial legal system’s family law. This book contextualizes the Hong Kong situation by examining judicial cases interpreting Chinese customs and the Great Qing Code, offering a comprehensive understanding of the Hong Kong situation in relation to the status of concubines in Republican China and other East Asian jurisdictions. It will be of particular interest to teachers and students of law, as well as researchers in gender studies, post-colonialism, sociology and cultural studies.

Appeals for the abolition of celibacy were couched primarily in the language of nature, social utility, and the patrie. The attack only intensified after the legalization of priestly marriage during the Revolution, as marriage and procreation were considered patriotic duties. Some radical revolutionaries who saw celibacy as a crime against nature and the nation aggressively promoted clerical marriage by threatening unmarried priests with deportation, imprisonment, and even death. After the Revolution, political and religious authorities responded to the vexing problem of reconciling the existence of several thousand married French priests with the formal reestablishment of Roman Catholicism and clerical celibacy. Unnatural Frenchmen examines how this extremely divisive issue shaped religious politics, the lived experience of French clerics, and gendered citizenship.
