The enacting of the Telecommunications Act of 1996 and the development of international trade agreements have fundamentally changed the environment in which your business operates, creating risks, responsibilities, and opportunities that were not there before. Until now, you'd have had a hard time finding a serious business book that offered any more than a cursory glance at this transformed world. But at last there's a resource you can depend on for in-depth analysis and sound advice. Written in easy-to-understand language, Telecommunications Law in the Internet Age systematically examines the complex interrelationships of new laws, new technologies, and new business practices, and equips you with the practical understanding you need to run your enterprise optimally within today's legal boundaries. * Offers authoritative coverage from a lawyer and telecommunications authority who has been working in the field for over three decades. * Examines telecommunications law in the U.S., at both the federal and state level. * Presents an unparalleled source of information on international trade regulations and their effects on the industry. * Covers the modern telecommunications issues with which most companies are grappling: wireless communication, e-commerce, satellite systems, privacy and encryption, Internet taxation, export controls, intellectual property, spamming, pornography, Internet telephony, extranets, and more. * Provides guidelines for preventing inadvertent violations of telecommunications law. * Offers guidance on fending off legal and illegal attacks by hackers, competitors, and foreign governments. * Helps you do more than understand and obey the law: helps you thrive within it.

Available in PDF, EPUB and Kindle. Book excerpt: Broadband communication expands our opportunities for entertainment, e-commerce and work at home, health care, education, and even e-government. It can make the Internet more useful to more people. But it all hinges on higher capacity in the "first mile" or "last mile" that connects the user to the larger communications network. That connection is often adequate for large organizations such as universities or corporations, but enhanced connections to homes are needed to reap the full social and economic promise. Broadband: Bringing Home the Bits provides a contemporary snapshot of technologies, strategies, and policies for improving our communications and information infrastructure. It explores the potential benefits of broadband, existing and projected demand, progress and failures in deployment, competition in the broadband industry, and costs and who pays them. Explanations of broadband's alphabet soup â€" HFC, DSL, FTTH, and all the rest â€" are included as well. The report's finding and recommendations address regulation, the roles of communities, needed research, and other aspects, including implications for the Telecommunications Act of 1996.

Available in PDF, EPUB and Kindle. Book excerpt: In 1996, Congress enacted comprehensive reform of the nation's statutory and regulatory framework for telecommunications by passing the Telecommunications Act, which substantially amended the 1934 Communications Act. The general objective of the 1996 Act was to open up markets to competition by removing unnecessary regulatory barriers to entry. At that time, the industry was characterised by service-specific networks that did not compete with one another: circuit-switched networks provided telephone service and coaxial cable networks provided cable service. The act created distinct regulatory regimes for these service-specific telephone networks and cable networks that included provisions intended to foster competition from new entrants that used network architectures and technologies similar to those of the incumbents. This intramodal competition has proved very limited. But the deployment of digital technologies in these previously distinct networks has led to market convergence and intermodal competition, as telephone, cable, and even wireless networks increasingly are able to offer voice, data, and video services over a single broadband platform. the current market environment, but not on how to modify it. The debate focuses on how to foster investment, innovation, and competition in both the physical broadband network and in the applications that ride over that network while also meeting the many non-economic objectives of U.S. telecommunications policy: universal service, homeland security, public safety, diversity of voices, localism, consumer protection, etc. This book explores these issues and includes the act in its entirety.

Book excerpt: The Nigerian telecommunications industry has continued to grow in a phenomenal manner following market liberalization reforms that commenced in the 1990s. As of 2017, the telecommunications industry was one of the fastest-growing economic sectors in Nigeria and the fourth largest contributor to the country’s Gross Domestic Product. The telecommunications industry, however, remains a highly technical and naturally dynamic industry that has not been a usual area for legal research in developing countries such as Nigeria. This book bridges that gap in knowledge by providing an analysis of the legal and policy instruments that regulate the industry. It comprises eleven chapters that discuss the historical evolution of telecommunications and its regulation; the development of the Nigerian telecommunications industry from 1886 to 2017; the legal basis for the regulation of the industry; the licensing and duties of service providers; the regulation of network infrastructure; the protection of consumers; the regulation of competition, interconnection, universal access, and environmental protection; and the resolution of industry disputes. This book will be useful to policy makers, legislators, regulators, lawyers, law students, investors, operators, and consumers, as well as any person interested in the Nigerian telecommunications industry.

Snider tells the story with the rigor of a scholar, the doggedness of an investigative reporter and the zeal of a reformer."--Paul Taylor, Executive Vice President, Pew Research Center "J.H. Snider offers an extremely comprehensive and well-documented look 'behind the curtain' at how the National Association of Broadcasters drives its national legislative agenda. This is must reading for not only political scientists but for all who are interested in media policy and how it gets made in Washington."-Chellie Pingree, President and CEO, Common Cause "This astute book is a first-rate work of original scholarship. It also provides an unsettling description of broadcasters' policy influence. When their own interests are involved, broadcasters cannot be trusted to act in the way they demand of all others in society. Readers will no doubt question whether J.H. Snider's recommended solution is a practical one. But no reader will question his call for new measures."-Thomas E. Patterson, Bradlee Professor of Government and the Press, Harvard University "Having played a role in the mad-cap drama of telecommunications legislation Snider documents, I can tell you he has captured the essence of the machinations, strange bedfellows, and almost single-minded, righteous self-interest that drives the telecommunications debate. Like it or not, this is how the power game is really played."-Stephen R. Effros, Former President (1976-1999), Cable Telecommunications Association "Speak Softly documents the broadcast industry's striking influence on public policy, including the landmark Telecommunications Act of 1996. As Congress gears up to re-write the Act, J.H. Snider's analysis is particularly timely."-Kevin Werbach, Professor, The Wharton School, University of Pennsylvania

Book excerpt: In 2013, the film American Hustle was released. Its 1979 ABSCAM-inspired plot created renewed public interest in Larry Pressler, the South Dakota senator who was the only public official to turn down the illegal FBI bribe. He immediately reported the incident to the FBI. When Senator Pressler was told Walter Cronkite referred to him on the evening news as a "hero" he stated, "I do not consider myself a hero... what have we come to if turning down a bribe is 'heroic'?" Capitalizing on the public's renewed interest, Pressler, who was disillusioned by the partisan two-party system, chose to get back in the ring. It had been eighteen years since he left office, but with an open Senate seat in 2014, Pressler felt a calling urging him to run. Despite serving his twenty-two years in office as a Republican, Pressler ran this time as an Independent-he was tired of the partisan bickering in Washington and was unwilling to submit to either party's special interests. This book tells the journey of this unexpected candidacy and instills hope that with some much-needed effort, we can achieve a political renaissance. About the Author Senator Larry Pressler is a former member of the U.S. House of Representatives (1975-1979) and the U.S. Senate (1979-1997). He is a Rhodes Scholar, a Harvard Law School graduate, a Vietnam combat veteran, a Fulbright professor, and a member of the U.S. Supreme Court Bar.
