Book excerpt: As technological developments multiply around the globeâ€"even as the patenting of human genes comes under serious discussionâ€"nations, companies, and researchers find themselves in conflict over intellectual property rights (IPRs). Now, an international group of experts presents the first multidisciplinary look at IPRs in an age of explosive growth in science and technology. This thought-provoking volume offers an update on current international IPR negotiations and includes case studies on software, computer chips, optoelectronics, and biotechnologyâ€"areas characterized by high development cost and easy reproducibility. The volume covers these and other issues: Modern economic theory as a basis for approaching international IPRs. U.S. intellectual property practices versus those in Japan, India, the European Community, and the developing and newly industrializing countries. Trends in science and technology and how they affect IPRs. Pros and cons of a uniform international IPRs regime versus a system reflecting national differences.

This book was released on 2005-06-08 with total page 952 pages. Available in PDF, EPUB and Kindle. Book excerpt: Distinguished economists, political scientists, and legal experts discuss the implications of the increasingly globalized protection of intellectual property rights for the ability of countries to provide their citizens with such important public goods as basic research, education, public health, and environmental protection. Such items increasingly depend on the exercise of private rights over technical inputs and information goods, which could usher in a brave new world of accelerating technological innovation. However, higher and more harmonized levels of international intellectual property rights could also throw up high roadblocks in the path of follow-on innovation, competition and the attainment of social objectives. It is at best unclear who represents the public interest in negotiating forums dominated by powerful knowledge cartels. This is the first book to assess the public processes and inputs that an emerging transnational system of innovation will need to promote technical progress, economic growth and welfare for all participants.

Book excerpt: One of the alleged benefits of the recent global movement to strengthen intellectual property rights (IPRs) is that such reforms accelerate transfers of technology between countries. Branstetter, Fisman, and Foley examine how technology transfer among U.S. multinational firms changes in response to a series of IPR reforms undertaken by 12 countries over the 1982-99 period. Their analysis of detailed firm-level data reveal that royalty payments for intangibles transferred to affiliates increase at the time of reforms, as do affiliate research and development (R & D) expenditures and total levels of foreign patent applications. Increases in royalty payments and R & D expenditures are more than 20 percent larger among affiliates of parent companies that use U.S. patents more extensively prior to reform and therefore are expected to value IPR reform most. This paper--a product of Trade, Development Research Group--is part of a larger effort in the group to understand the global impact of stronger intellectual property rights.

Book excerpt: Technology transfer has expanded rapidly over the past 20 years in Western Europe, North America and the Pacific Rim. It has been estimated that some 50% of new products and processes will originate outside the primary developer; academic and other research institutions are obvious sources of much of this new technology. In the NATO Co-operating countries, however, technology transfer is in its infancy; it is crucial for wealth creation and improvement in the quality of life that this mechanism is developed. The papers selected for inclusion in this book discuss issues related to the development of technology transfer in NATO Co-operating countries. The book identifies crucial research issues for science and technology policy researchers and, as a conclusion, offers some policy recommendations. The authors are drawn from NATO and Co-operating partner countries, from other parts of the world, and from international organisations. The focus of the book is on the institutional framework of knowledge and technology transfer; intellectual property rights as sources of information and tools for co-operation; international, national and regional aspects of knowledge and technology dissemination and diffusion; and networking. Audience: Academic institutions, research institutes, intellectual property practitioners, science and technology policy makers, technology transfer managers, high-tech industries.

Available in PDF, EPUB and Kindle. Book excerpt: Technology licensing is an important element of conduct in many industries and has attracted a fair amount of attention in recent years. While vertical industrial structure is quite common, the literature on technology licensing has not paid much attention to this aspect. Considering fixed-fee licensing, the authors show that upstream and downstream markets play important roles for a profitable licensing. The authors of this book also analyse the Technology Transfer (TT) challenges within the new climate regime, in terms of the process of innovation into an existing energy system, the related barriers and the supporting diffusion mechanisms, with the emphasis laid on the emerging opportunities within the new climate regime. Successful practices are also presented and discussed by both the developed and the developing countries in this respect. Also investigated in this book is the potential of transferring and implementing sustainable energy technologies through the Clean Development Mechanism of the Kyoto Protocol in Chile, China, Israel, Kenya and Thailand. Moreover, the available literature Geographical Indications (GIs) are surveyed and related geographical origin systems with particular emphasis on international markets. The authors also examine the matter of intellectual property (IP) and how it bears on the two economic sectors. Consideration is given to the role of patents, trade secrets, trademarks and copyrights and their relative value as strategic tools in the current competitive environment.

Book excerpt: The success of technology transfer agreements depends not just on the technical work, but on how well the arrangements to protect and dispose of the intellectual properties that make up the technologies are handled. Pertinent issues that impact the protection and disposition of intellectual properties during the technology transfer process at Sandia National Laboratories, a multiprogram laboratory operated for the Department of Energy by the Martin Marietta Corporation, are discussed. Subjects addressed include the contracting mechanisms (including the Cooperative Research and Development Agreement [CRADA] and the Work-for-Others agreement), proprietary information, The Freedom of Information Act, patents and copyrights, the statement of work, Protected CRADA Information, licensing considerations, title to intellectual properties, march-in rights, and nondisclosure agreements.

Available in PDF, EPUB and Kindle. Book excerpt: Like any contract, an international licensing agreement spells out the rights and obligations of the contracting parties, manages potential risks and supplies a contingency plan for each party in the event the contractual relationship breaks down. However, international licensing of intellectual property, software or technology confronts the contracting parties with its own distinct challenges. When planning, drafting and negotiating such agreements, it is imperative to know exactly what core issues need to be addressed. This book provides this know-how in an easy-to-use, clear and concise fashion. This expert guide to the complex world of international licensing agreements brings together all the essential materials needed when dealing with such agreements and covers the following: • business models that may be used by the contracting parties; • standard provisions encountered in an array of international licensing agreements; • analysis of the key clauses in various international licensing agreements inter alia trademark, software, franchise and technology licences with provisions as affected by jurisdiction; • effect of competition law in a variety of jurisdictions; • ensuring trademark protection at both national and international levels; • clear explanation of key franchising terminology and disclosure rules; and • effect of international dispute resolution rules in a range of jurisdictions. Alongside detailed contract analysis, the book details numerous case studies from an array of industries, with detailed commentary. Practitioners operating within or representing medium to large firms who normally have to prepare or provide advice on international licence arrangements will quickly find this reference material indispensable. The book’s thorough analysis of this complex area will also be welcomed by professionals working for universities, industry, interest groups, government departments and international organisations.

Book excerpt: The new Technology Transfer Block Exemption Regulation (in force from May 1, 2004) signals a profound change in the nature of the regulatory framework for technology licensing under EU competition law. This book examines the new Regulation in detail, placing it in the wider context of: (i) the modernisation reforms of EC competition law; and (ii) the treatment of IP rights over technology more generally. The book also considers the approach to assessment of IP issues set out in the Guidelines that accompany the Regulation; the authors discuss their legal basis and, where appropriate, criticise the approach taken by the Guidelines where the legal basis is unsure.

Big data and data mining, Internet of Things, artificial intelligence and blockchains are already affecting business models and leading to a social and economic transformations that have been dubbed by the fourth industrial revolution. Focusing on the framework of intellectual property rights, the contributions to this book analyse how the technical background of this massive transformation affects intellectual property law and policy and how intellectual property is likely to change in order to serve the society. Well-known authorities in intellectual property law offer in-depth chapters on the roles in this revolution of such concepts and actualities as the following: power and role of data as the raw material of the revolution; artificial inventors and creators; trade marks in the dimension of avatars and fictional game characters; concept of inventive step change where the person skilled in the art is virtual; data rights versus intellectual property rights; transparency in the context of big data; interrelations of data, technology transfer and antitrust; self-executable and ‘smart’ contracts; redefining the balance among exclusive rights, development, technology transfer and contracts; and proprietary information versus the public domain. The chapters also provide complete analyses of how big data changes decision-making processes, how sustainable development requires redefinition, how technology transfer is re-emerging as technology diffusion and how the role of contracts and blockchain as instruments of monitoring and enforcement are being defined. Offering the first in-depth legal commentary and analysis of this highly topical issue, the book approaches the fourth industrial revolution from the perspectives of technical background, society and law. Its authoritative analysis of how the data-driven economy influences innovation and technology transfer is without peer. It will be welcomed by practicing lawyers in intellectual property rights and competition law, as well as by academics, think tanks and policymakers.
