Book excerpt: In the past year, cash-strapped districts have been handing out pink slips by the hundreds, and some, by the thousands. The Bureau of Labor Statistics estimates that nearly 60,000 teachers were laid off in 2009. State budget gaps and deficit projections, with federal stimulus funding already spent, suggest more of the same for 2010. Some observers expect current cuts to come faster even than those of the 1970s, when the baby boom generation waned, emptying out schools across the country. In this paper, the National Council on Teacher Quality (NCTQ) taps into its TR[superscript 3] (Teacher Rules, Roles and Rights; www.nctq.org/tr3) database to examine district policies, some mandated by state law, for making layoff decisions. TR[superscript 3] posts data from 100 school districts across all 50 states, including the 75 largest districts in the nation as well as the 25 largest districts in the states that would not be otherwise represented. These 100 districts represent 20 percent of all public school students in the United States. A list of recommendations that will help school districts navigate difficult layoff decisions while keeping student needs front and center in the process is also presented. But as federal support wanes and states face looming deficits, deep cuts are becoming unavoidable. School districts will almost certainly be forced to lay off teachers to make ends meet. Given decades of research showing that the quality of education a child receives depends more on the quality of his or her teacher than any other school factor, one might assume that schools would do everything possible to protect their best teachers from being cut. Unfortunately, most layoff decisions will completely ignore a teacher's performance. In fact, in 14 states, it is illegal for schools to consider any factor other than a teacher's length of service when making layoff decisions. The newest teachers always get cut first, even if they are "Teacher of the Year" award winners. Ignoring teacher performance in layoffs is a prime example of the "widget effect"--treating teachers like interchangeable parts. Quality-blind layoff policies threaten to make this year's layoffs catastrophic. Talented new teachers will lose their jobs while less effective teachers remain. More job losses will be necessary to meet budget reduction goals, because the least senior teachers are also the lowest-paid. As is all too common, the most disadvantaged students will be hit hardest, because they tend to have the newest teachers. These outcomes are intolerable. States and school districts still have time to put common sense back into their layoff policies. This document summarizes recent research on the effects of quality-blind layoffs and explains why layoff decisions should be based on what teachers achieve with their students, not when they started teaching.

Book excerpt: The current economic downturn has forced school districts across the country to deal with massive budget cuts over the past two years. In some cases, these cuts led districts to make the wrenching decision to lay off teachers. The basic principle is "last hired, first fired;" newer teachers are laid off before more veteran teachers, regardless of how well they do their jobs. Layoffs are not good for anyone, but they are worse when they result in the loss of top teachers. With so many jobs--and so many children's futures--potentially at stake, districts and teachers unions must act now to reform these outdated rules so that schools will be able to hold on to their most effective teachers if layoffs become necessary. This is especially critical for schools serving students who already face severe educational disadvantages. The first step in designing a smarter layoff system is to solicit input from those it will affect most directly: teachers themselves. Last spring, The New Teacher Project did just that by surveying more than 9,000 teachers in two large urban districts about layoff policies. Teachers in these two districts overwhelmingly rejected quality-blind layoff rules. The results of this survey provide a roadmap for implementing layoff rules that teachers will support and will allow schools to retain their best teachers. Under a quality-based system, layoffs would be made according to several factors, each weighted in accordance with existing research and teacher input. (Contains 2 figures and 13 footnotes.).
